Please be advised that we are the solicitors for Peterborough Housing Corporation with respect to the above-noted matter. A copy of your letter dated January 19, 2009 forwarded to Sondra Fitzgerald, RE: Landlord & Tenant Tribunal File # TEL-13854 has been referred to the writer. Of concern in this particular letter is the fact that on Page 3 you state the following: "I Have proof of negligence causing DEATH against Peterborough Housing, J _ specifically, d Childrens AID. I was a caregiver of AVA STOREY and Kristine's other children-and am FULLY aware of the situations, and the history of previous fires started by a child in the family, which lead to AVA"s death".

Upon review of this allegation, it is our opinion that such statement provided by yourself to Ms. Fitzgerald, is libelous in nature and totally unfounded. Moreover, such comments as disseminated by yourself are libelous but harmful to our client's reputation as a housing provider. Accordingly, please regard this letter as notice pursuant to the Libel and Slander Act, R.S.O. 1990, c. L12 concerning defamatory statements made in respect of our client, Peterborough Housing Corporation in the letter of January 19, 2009 provided to one Ms. Sondra Fitzgerald, RE: Landlord & Tenant.Tribunal File # TEL-13854.
