219-14 Limitation on Subcontracting TASK ORDER COMPETITION Task Orders estimated to be above the thresholds identified below will be competed in Suite 1, unrestricted and Suite 2, small business. Small businesses will not have to comply with FAR Clause 52.219-14 Limitation on Subcontracting on task order competitions under Suite 1 task orders. Task Orders estimated to be at or below the thresholds identified below shall be initially competed as 100% small business set-asides in Suite 2, small business, and will comply with the restrictions of FAR Clause 52.219-14 Limitation on Subcontracting. The contractor holders under Suite 1 would be permitted to compete on task orders below the identified thresholds only if adequate competition or reasonable pricing was not obtained after issuance of the task order request for proposal and response from the Suite 2 contract holders. 149. In reference to Amendment 2, Question and Answer #13, it states .If the Prime Offeror is a small business under the NAICS code and can perform in excess of 50% of the work requirements in according

with the FAR Requirements; the team would qualify for award in the set-aside suite.. Upon review of the contract it is noted that FAR Clause 52.219-14 Limitations on Subcontracting is incorporated in both Section G-Task Order Competition and Section I. Since the set-aside suite only includes prime contractors that fit below the $7 million size standard, it would seem impossible for any such prime contractors in this suite to perform 50% of the work on every task order for up to $130 million of the estimated $260 million worth of task orders estimated for the set-aside suite. Are we to interpret this as the small business prime contractor must perform 50% of the work on each and every task order as well as the overall performance under this IDIQ? A149. YES IN ACCORDANCE WITH FAR PART 52.219-14 (Limitations on Subcontracting.), PRIME SMALL BUSINESS CONTRACTORS MUST BE CAPABLE OF PERFORMING IN EXCESS OF 50% OF THE LABOR ON THE CONTRACT. THAT DOES NOT HAVE TO EQUATE TO 50% OF THE INDIVIDUAL TASK ORDER LABOR.
