BENDITA MAE UY, Respondent. x----------------------------------------------------------x COMPLAINTAFFIDAVIT I, MEYRI ANN BASCO, Filipino, of legal age, single and the duly authorized representative of FELINES FAVORITE CORPORATION with its principal place of business at #15 St. Joseph st. Brgy. New Era, Quezon City, Philippines, after being sworn in accordance with the law, hereby depose and state that: 1. I am the duly authorized representative of FELINES FAVORITE CORPORATION (Corporation for brevity), a domestic stock corporation duly registered with the Securities and Exchange Commission (SEC) and organized by virtue and under the Laws of the Republic of the Philippines with Principal Place of Business at #15 St. Joseph st. Brgy. New Era, Quezon City, Philippines. A copy of the Board Resolution and Secretarys certificate granting my person the authority to prosecute this case is hereto attached as Annexes A and B, respectively.

2. Complainant is lodging a complaint for VIOLATION OF BATAS PAMBANSA BILANG 22, otherwise known as the Anti-Bouncing Checks Law, against MS. BENDITA MAE UY (Respondent for brevity), also Filipino, of legal age, and with business address at #1 Kasunduan St., Brgy Commonwealth, Quezon City, Philippines, where subpoena(s) and other notices from this Honorable Office, may be served.

3. Respondent is the proprietor of ALL-DAY PET STORE located and doing business at #1 Kasunduan St., Brgy Commonwealth, Quezon City, Philippines;

4. Respondent has purchased numerous boxes of cat food and merchandises and has issued two (2) Post-dated Checks to cover the payments for the purchased items, to wit: 1

5. Unfortunately, both the above stated checks bounced and were returned for having been drawn against CLOSED ACCOUNTS. Copies of the Checks are hereto attached as Annex C;

6. After numerous oral and written demands to make good the value of the checks, Respondent failed and refused to satisfy their obligation with the Complainant. A copy of the Letter dated February 14, 2012, sent by the Complainant to the Respondent is attached herewith as Annex D;

7. Due to the continued failure of the Respondent to make good their obligations, the Complainant-Corporation, through Counsels of FAMAPEPA LAW OFFICE, sent a Formal Demand Letter and Notice of Dishonor dated April 3, 2012. A copy of the Demand Letter with Registry Receipt and Return Card are herein attached as Annexes E-1 and E-2, respectively;

8. In view of the foregoing acts, Complainant Corporation suffered actual damages in the amount of FOUR HUNDRED AND TWENTY FIVE THOUSAND PHILIPPINE PESOS (PHP 425,000) which is covered by the dishonored checks, plus Attorneys fees in the amount of FIFTY THOUSAND PHILIPPINE PESOS (PHP 50,000) and incidental costs of prosecuting this case against them;

9. I am executing this Affidavit to attest to the truth of the foregoing statements in support of our complaint against MS. BENDITA MAE UY for Violation of Batas Pambansa Bilang 22, otherwise known as the Anti-Bouncing Checks Law of the Philippines, and for all legal purpose it may serve.
