Eric Holder: Drone Strike To Kill U.S.
Citizen On American Soil Legal,
Hypothetically
WASHINGTON -- The Obama administration
believes it could technically use military force
t o ki l l an Ameri can on U. S. soi l i n an
"extraordinary circumstance" but has "no
intention of doing so," U.S. Attorney General
Eric Holder said in a letter disclosed last
Tuesday.
Holder's March 4 letter was disclosed by Sen.
Rand Paul (R-Ky.), who had asked whether
the Justice Department believed President
Barack Obama had the legal authority to order
a targeted strike against an American citizen
located within the United States.
The Obama admini strati on, Hol der sai d,
rej ected the use of mi l i tary force where
"well-established law enforcement authorities
in this country provide the best means for
incapacitating a terrorist threat." But in theory,
it'd be legal for the president to order such an
attack under certain circumstances, Holder
said.
"The question you have posed is therefore
entirely hypothetical, unlikely to occur, and one
we hope no presi dent wi l l ever have to
confront. It is possible, I suppose, to imagine
an extraordinary circumstance in which it
would be necessary and appropriate under the
Constitution and applicable laws of the United
States for the Presi dent to authori ze the
military to use lethal force within the territory of
the United States," Holder wrote.
"For example, the president could conceivably
have no choice but to authorize the military to
use such force if necessary to protect the
homel and i n t he ci r cumst ances l i ke a
catastrophic attack like the ones suffered on
December 7, 1941, and September 11, 2001,"
Holder continued, referring to the Japanese
attack on Pearl Harbor and the terrorist attacks
on the World Trade Center and Pentagon.
Holder said he would "examine the particular
f act s and ci r cumst ances" i f such an
emergency were to arise.
Paul, who had threatened to filibuster the
nomination of John Brennan as CIA director
over secrecy about the U.S. drone program,
said in a statement that Holder's "refusal to
rule out the possibility of drone strikes on
American citizens and on American soil is
more than frightening -- it is an affront the
Const i tut i onal due process ri ght s of al l
Americans." Holder's letter was first reported
by Adam Serwer of Mother Jones.

announced it will cancel all public tours due to
sequestration cuts, it's reported last Tuesday.
"Due to staffing reductions resulting from
sequestration, we regret to inform you that
White House Tours will be canceled effective
Saturday, March 9, 2013 until further notice.
Unf or t unat el y, we wi l l not be abl e t o
reschedule affected tours," the White House
said in an email.
Staffers at the Capitol were also informed that
the building's West Front entrance will be
closed starting next week to save money.

2,500 Year Old City Found
Buried In Chhattisgarh
RAIPUR - In a si gni fi cant archaeol ogi cal
discovery, remains of an ancient city, believed
to be 2,500 years old, have been found at
Tarighat, nearly 30 kilometres from here.
The surface findings at the archaeological site
located on the left bank of river Kharun, a
tributary of Sheonath river, indicate that the
ancient city buried underneath was a highly
developed urban settlement and flourished in
the third century BC.
Preliminary explorations have yielded Kushan
and Satavahan coins, a stone seal, potteries,
beads of semi-precious stones, terracotta and
bones. The Archaeological Survey of India
(ASI) has granted licence for excavation of the
site to the Chhatt-isgarh state archaeological
department on the basis of the findings.

back to third century BC. But, there may be

NEW DELHI - The government has decided
not to treat voluntary sex workers above the
age of 18 years as victims of trafficking, in its
new definition of the offence in criminal law.
Following objections by human rights and
women organizations, the government is set to
delete the term 'prostitution' as one of the
forms of exploitation which constitutes the
offence of trafficking in the Indian Penal Code.

INDIA
National Interest: Our Bigger Defense Scandal

The only positive aspect of the Finmeccanica
hel i copt er deal i s t hat i nvest i gat i ng i t
conclusively may be easier as, unlike Bofors,
where holier-than-cow Sweden did nothing
and even got a major New Del hi avenue
named after Olof Palme, here the supplier
country is investigating.
Further, if bribes are traced to any Indians,
they must get the swiftest punishment in
fast-track courts and, in any case, the money
must be recovered from the suppliers by
invoking the integrity pact. You can't see what
defense they would have when their own
government has charged them with bribery.
But this is where the issue begins to get
complicated.
Should you then immediately cancel the deal
and start searching for VVIP helicopters yet
again? That may take another 6-9 years (as
AgustaWestland did in spite of the "bribes").
So complicated is our system. Meanwhile, our
pri me mini ster, president and other such
seriously threatened species will continue to fly
decades-old
Mi-17s that are so unprotected that one of
them was brought down by the odd Naxalite
bullet in Chhattisgarh just the other day. Yet
you may have no choice. There is far too
much muck flying. This government does not
have the nerve to nuance its response by
separating the machine from the bribe, or the
classic baby and the bathwater.
The problem is, this helicopter deal is not the
only one to suffer such a fate under the UPA.
In fact, while important for VVIP protection, it is
not a deal of any great military urgency. Think,
on the other hand, of the more seri ous
programmes that have been put i n col d
storage at the mere whiff of scandal. The
army's desperate quest for modern artillery
has stalled as almost all the key suppliers,
from Germany to Israel to Singapore, have
been blacklisted. Some key missile and radar
programmes are stalled as some of the Israeli
giants have been blacklisted. If the Guinness
Book had an ent r y on t he number of
armament suppliers blacklisted, it will be UPA
2 forever.
WITH a complex, elaborate, multi-layered and
and idiot-proofed mechanism, and with the
shoot -f rom-t he-hi p use of t he CBI and
blacklisting, the UPA has developed a defense
purchase syst em t hat can probabl y be
described as wrapped in latex. But what has it
achieved? This approach breeds indecision,
fear, suspicion and a you-cover-my-backside-
-and-I-will-cover-yours mindset. The best it can
do is create a situation where, the moment
stuff hits the fan, each participant can say, but
of course, I didn't do it. In the process, nobody
decides, anticipatory bans are imposed and
inquiries ordered, which lead nowhere. And of
course, in spite of all this, you cannot prevent
a scandal of the dimensions of Finmeccanica.
The state of India's defense acquisitions today
is a disaster much greater than any single
bribery scandal, particularly the one that has
just been revealed. The important point is not
that the UPA has gifted itself a grade one
defense purchase scam even under the watch
of a minister whose personal integrity has
never been questioned. The UPA will pay for
this politically. The more important issue is that
they have the shame of this scandal after
having banned half the world (Rheinmetall, the
German conglomerate we banned, now owns
109 ar mament f i r ms wor l dwi de) . Thi s
super-cautious government has achieved
other firsts in India's history: notably, and the
most dubious, the first defense procurement
scandal allegedly involving one of Government
of India's own companies, in fact a mini-ratna,
BEML, for Tatra trucks. And even while that
investigation meanders, ask the strategic
forces command and DRDO how i t has
brought nuclear missile units and artillery
regiments to a standstill.
India has the fourth largest armed forces in the
world, but its politico-military leadership still
has t he mi ndset of a smal l -t own ret ai l
consumer. One who goes out every evening
with a jhola, searching for the best bargains.

That is why all you hear about is one individual
deal or the other, each progressing in isolation.
In a global arms bazaar that is fast cartelizing
now with M&As, and where nothing comes
with an MRP (Maximum Retail Price) sticker
and which has no price discovery mechanism,
there is always slack available for crooks and
fixers. You can never fully eliminate them, but
you can probably make their lives tougher.
Here is how.
ARMAMENT systems have a long operational
life. The first MiG-21s came in 1964, and some
will remain with us for another decade, if not
longer. The Jaguars, bought in 1978, are
being upgraded for their third innings. T-72
tanks, BMP infantry fighting vehicles have
crossed 30 years in the Indian army's service,
and stay on. Indian armed forces' orders are
large. They can sustain large production units.
That we shoul d have t ri ed t o bui l d our
domest i c pr oduct i on capabi l i t i es i s a
no-brainer. But a combination of intellectual
and political laziness, military impatience and
ent r enched vest ed i nt er est s has kept
practically all defense production within the
publ i c sect or. Our PSUs and ordnance
factories have done some joint production, but
never really developed the expertise to do
anything el se on their own. What i s HAL
capable of, for example, after being a nearly
five-decade national monopoly with captive
consumers, besi des some more "j oi nt "
production? The establishment's suspicions of
the I ndi an pri vate sector are i ntri gui ng.
Securi t y l eaks? If you can trust pri vate
compani es around t he worl d wi t h your
armament details, why not fellow Indians?
Profiteering? You can't even mention that
argument, post Tatra-BEML.
Every decade is shadowed by a new defense
scandal in India. This will also take its course.

But the fourth largest armed forces in the
world, and an aspiring big power, can't get
there without a military industrial complex of its
own. There is a third-world, banana republic
kind of ring to every defense scandal in India:
12 helicopters, a bunch of guns, a factory to
make fuses for artillery, a few hundred trucks
and so on. This can only change if we think big
and invest in the future. And for that, India has
to embrace its own private sector and get its
PSUs to compete with them, rather than just
become adjuncts to foreign principals.
I can claim that in my years as a reporter I was
rarely fooled on a story. And never like I was
on one to do with armaments. In 1985, I was
writing a cover story for India Today on Rajiv
Gandhi's remarkable military modernization
search. I was shown around the research and
production facilities where the MBT Arjun was
being developed and built: the best tank in the
worl d, i n i ts cl ass, I was tol d. I have a
p h o t o g r a p h i c r e c o l l e c t i o n o f V. S.
Arunachalam, then head of the DRDO, lovingly
patti ng the front of the tank and saying,
"Shekhar, this is the best armor you can find
for love or money." I bought the Arjun story
wide-eyed. Twenty-eight years later, the tank
is still in some stage of development, and we
have bought two generations of T-72s and
T-90s meanwhile.
So here is a thought. What if the government
had just floated the GSQRs (General Staff
Qualitative Requirements) of the MBT and
sought bi ds f rom whoever was wi l l i ng,
including, say, Tata, Mahindra, Leyland, L&T,
all the companies that represent this great
I ndi an st r engt h i n aut omobi l es and
engineering. They would have collaborated
with the DRDO, found their own technology
partners and dealt with the foreign firms and
agents, the Haschkes and Quattrocchis. You
would then choose from competitive products
and prices. Chances are, if you had done that
early enough, by now one of them would have
sold the army 3,000 MBTs and exported a few
thousand as well, while creating jobs, taxes
and capabilities here. You can do the same
with planes, guns, ships, and submarines. Of
course, this will not finish all imports. Nor will it
ensure no scandals. But it will make for a
much healthier, safer and cleaner system. It
will also make India look more like a nation
deserving of armed forces of this size. And a
more f ormi dabl e resi dent i n t hi s t ough
neighborhood.

Pakistans Unsung Hero
Bishop Anthony Theodore Lobo

Bi shop Anthony Theodore Lobo, Bi shop
Emeritus of the Roman Catholic Diocese of
Rawalpindi, passed away in the early hours of
February 18, 2013. He fought his last battle of
prolonged illness lasting over five years in
spirituality, meditation, reading, writing and
serving his community. He was a Pakistani
from Karachi and a national icon people must
know about. On his death, Imran Khan paid
glowing tributes to him and his services to
Pakistan.
The late Bishop was a reputed and respected
f i gure. Hi s passi on, commi t ment s and
educational excellence cut across religious
divides in Pakistan. From a young priest in
charge of St Patricks High School Karachi, he
had the singular honor of being on the Senate
of four National Universities, i.e. Forman
Christian College University, Kinnaird College,
Shah Abdul Lat i f Uni versi t y and Si ndh
University Jamshoro. He leaves behind a
legacy of highly accomplished students and
admirers that can make any Pakistani proud.
His services in the field of education were
recognized by the President of Pakistan, who
conferred on him the Presidents "Pride of
Performance" Award in 1990.
Anthony Lobo loved his country and I was a
witness to his romantic notions for over 18
years. He had a glitter in his eyes when he
recounted standing as an altar boy on August
14, 1947, when Quaid-i-Azam Mohammad Ali
Jinnah joined the Catholi c communi ty of
Karachi with Mr. C. Gibbons for Thanksgiving
Prayers at St Patricks Cathedral Karachi. He
is the same C. Gibbons, who in companion-
-shi p of Mr. S. P. Si ngha, the Chri sti an
speaker of the Punjab Legislative Assembly,
Joshua Fazal Di n and Chandu Lal l were
instrumental in securing the majority for
Musl i m League i n 1945. To recount, the
casting vote for division of Punjab in favor of
Muslim League was cast by the Christian
speaker.
It was this ability to communicate across
religious divides that endeared him to people
all over the country. His fan club included
Presi dents, Pri me Mi ni sters, pol i ti ci ans,
bureaucrats, generals, scholars, educationists,
religious leaders, the impoverished and the
many unsung footsloggers. One of the most
moving scenes I recollect is when he reached
the house of Professor Ayaz Ahmad Khan of
St Marys College strapped with a portable
ventilator he used for breathing. He had come
despite his failing health condition to pay his
respect to a gallant son Captain Junaid, who
had been beheaded by terrorists in Swat. The
Bishop spent hours there and stood right
through the mi l i tary funeral panti ng and
praying. His presence in a Bishops robe next
to the national colors shot a wave of emotions
and patriotism amongst all those who were
present. He i nsi st ed on prayi ng and al l
Christians and Muslims joined him.
Throughout his life, he remained in contact
with his students who rose to highest levels in
the country and i nterceded on behal f of
Pakistanis. He maintained contacts with all the
Christian war heroes of Pakistan and the
families of those officers and soldiers, who had
sacrificed their lives in the line of duty. I
remember him reaching Lahore in May 2010
on a wheelchair with his portable ventilator on
the funeral of Mrs Iris Chaudhry, the wife of
Late Group Captain Cecil Chaudhry. Because
he coul d not cl i mb steps, he sat at the
doorway to attend the funeral prayers. I recall
his many telephone calls to the family of Group
Captain Cecil, when the bravest of national
heroes was fighting his last battle with cancer.
Being a spiritual leader of the small Catholic
community of Pakistan never deterred him
from playing his role in educational across the
entire country. His footmarks are all over the
Christian educational institutions in Pakistan.
In fact, he along with Bishop Alexander John
Mali k of the Church of Pakistan made a
formidable team of high class educational
reformists in Punjab. In the past 20 years, he
used hi s posi t i on as Chai rman, Roman
Catholic Education Commission of Pakistan
and Secretary General , Cathol i c Bi shop
Conf er ence of Paki st an t o ef f ect i vel y
contribute to private educational standards. He
established many Basti Schools in rural areas
of the country to impart high class modern
education to the least privileged segments of
Pakistani society.

Pakistans Unsung Hero

In his pri vate capacity, he mentored and
financially sustained many underprivileged, but
most deserving individuals across religious
l i nes, t o ri se as Paki st an s out st andi ng
scholars, academicians, scientists and social
activists. He had the ability to communicate
with emphatic vigor. Benazir Bhutto shaheed
and General (retd) Pervez Musharraf were
amongst his avid fans as also subject of curt
personal admonishment.
Bishop Lobo was disturbed by the negative
socio-economic effects of the nationalisation of
missionary educational institutions in the 70s.
He felt that selective discriminatory insertions
i n the Constitution al i enated non-Musl i m
Pakistanis and deprived communities of their
nurseries. They were no longer in a position to
reassert the role they played in Pakistan
Movement and first 20 years of Pakistans
development; the fastest growing economy of
Asia. He cherished the days when men and
women of hi s fl ock were Paki stan s best
educationists, health specialists, accountants,
police and armed forces officers and ran the
railways to perfection. Political alienation
resulted in migrations abroad, plummeting of
educational standards and proliferation of
vices. In an exhaustive study with a German
sociologist, he reached the conclusion that
education was the only way that religious
minorities of Pakistan could move forward. As
a Holy Father, he was quick to adopt many
Christian and Hindu high achievers as his sons
and give them the moral support to become
go-getters. One such luminary was Shahbaz
Bhatti shaheed.

schools. Faced with financial constraints for
this privatization challenge, he traveled world
over collecting funds and ultimately making it
possible to pay government dues, carry out
renovations and get them running. Till 2008,
when traveling for him became prohibitive, he
spent summers traveling world over collecting
al ms and donat i ons f or hi s educat i onal
projects.
As a push towards his dreams, in 1995, he
launched an ambitious project by the name of
Boys Town in Lalazar Rawalpindi. His vision
was to catch Christian talent at primary level
and groom them in-house with world class
educational standards. In December 2005, he
requested me to leave my lucrative job and
join his mission for education. Talking of his
financial constraints, he said that he was not in
a position to pay me an equitable salary and
i nst ead God woul d do i t . I r esi gned
immediately and was appointed the founding
Rector of St. Marys College Rawalpindi, the
f i rst Roman Cat hol i c Hi gher Educat i on
Institution of Pakistan. The project began with
two-pence and continues to grow, despite
inability of Bishop Lobo to travel and collect
donations.
Bishop Lobo has left behind a very large group
of devotees, admi rers, benefi ci ari es and
institutions. It is up to us to live up to these
l ofty tradi ti ons and make i ndi vi dual and
organisational contributions to the visions of
offsetting social imbalances and benefitting our
country.

shot and killed, has tested positive for rabies.
Albany County's Department of Health and
Cohoes Police had issued an alert after a
woman was bi tt en by a grey f ox i n t he
Jef ferson Avenue/ Lansi ng Park area of
Cohoes.
"Quick action was taken by Cohoes Police,
Animal Control and the Albany County Health
Department to make sure the publi c was
protected," said Albany County Executive
Daniel P. McCoy. "It is important to remember
whenever any animal, particularly a wild or
stray animal is acting strangely, to stay away
and contact animal control."

USCIS Revises Employment
Eligibility Verification Form I-9
WASHI NGTON - U. S. Ci t i zenshi p and
Immigration Services (USCIS) published a
revised Employment Eligibility Verification
Form I-9 for use. All employers are required to
complete a Form I-9 for each employee hired
in the United States, says a press note of
SCIS.
Improvements to Form I-9 include new fields,
reformatting to reduce errors, and clearer
instructions to both employees and employers.
Employers should begin using the newly
revised Form I-9 (Rev. 03/08/13)N for all new
hires and reverifications.
Employers may continue to use previously
accepted revisions (Rev.02/02/09)N and (Rev.
08/07/09) Y until May 7, 2013.
After May 7, 2013, employers must only use
Form I-9 (Rev. 03/08/13)N.
