You said you would respond to our query about the risk assessment figures in two weeks. That was on 17 April. We had hoped to avoid this, but because of time constraints we now have to make a formal request for the reply to our query and the following information: (1) a copy of Network Rail's latest risk assessment for the Long Rock Mexico Crossing (the full report), which we requested on 4 February and 20 March; and (2) a copy of Network Rail's latest risk assessment for the foot crossing at Hayle Station (the full report), which we requested on 4 February and 20 March. You may not be aware that on 28 March we had a meeting with Ian Prosser and Matthew McNeil of the ORR, at which our difficulty in obtaining information from Network Rail was one of the items discussed. Mr McNeil confirmed that ORR is subject to the Freedom of Information Act and would, if requested, have to supply us with any information in its possession relating to this case. However, he did ask us to refrain from making such a request until Mr Prosser had had a chance to speak to your colleague, David Higgins. Whilst we have no desire to make trouble for you, please understand that we are now operating to a strict timetable which expires on 23 May and, in order to give ourselves any chance of receiving an FOI response in time, we would have to make our request to ORR very soon. We have been advised that this is the sort of information which is routinely exchanged by the parties to any formal proceedings such as public inquiries or judicial reviews.
