The Development Rights and Responsibties Agreement (ORRA) review and approval procedures are found in Chapter 1-25 ofthe County Code ‘The petition from Oakdale Investments LLC was submitted to the County on October 3, 2012. On October 25, 2012, the BOCC voted to accept the petkion and move forward with staff eview. Since that time, staf and the Developer have worked together to create the attached draft ORRA and draft APFO Letter of Understanding ("LOU"). The Adequate Public Faiities review will ako be incorporated into the ORRA process. In addition, this DARA is under review concurrent with a Phase | PUD Plan application to rezone ‘pproximately 950 acres from Agricultural to PUD, If the BOCC agrees to continue to pursue the DRRA, the Eaglehead/Linganore PUD ORRA wll be referred to the Planning Commission, per 1:25-5 ofthe Frederick County Code, for a determination as to whether the proposed DRRA fs consistent with the Comprehensive Plan. After the Planing Commission review, the OCC will hold a public hearing to consider the Eaglehead/inganore DRRA.
