Some people believe that there should be fixed punishments for each type of crime.

Other, however, argue that the circumstances of an individual crime, and the motivation for committing it, should always be taken into account when deciding on the punishment. Discuss both these views and give your opinion.

Since ancient times, law has been defined to make justice and punish the culprit. However, in recent years law in every country is defined on the basis various factors. In my opinion, every person has a right to survive and should be given a chance to defend himself even if he has committed a crime. On the one hand, some people do not believe in equality and tend to overpower a weak person resulting in breaking of law. Intentionally committing crime for own benefits and satisfaction should be punished accordingly. For example, in Saudi Arabic, for raping a woman leads to death penalty. Furthermore, having a standard procedures and categorizing punishments according to the severity of the crime will make the judicial process faster. Recently, University of Melbourne researched about the laws in various countries and the rate justice was provided to the victims, where North Korea ranks on top for less crime and quick judgment. On the other hand, each individual should have a right to express his version of story and not punishing accused just on the basis of the complaint. Some crimes, may happen while defending themselves and unfortunately this may lead to action which may result in crime. Although this judicial process may take longer to make decisions, depending on the motive and intentions of the crime the accused of should be penalized. For example, In Indian judicial system, the lone terrorist caught during 26/11 attacks was giving a fair trial to give his point of view, delaying justice by 4 years. In conclusion, no one deny that justice should be made at a faster rate. However, I believe that every human being should be given a fair chance to defend himself and punishment should be decided on basis of motive and situations which resulted in breaking of law.
