A Bylaw to Regulate Payment of Development Cost Charges by Installments.

EXPLANATORY NOTE

Bylaw No. 4753 provides for payment of Development Cost Charges in excess of $30,000 by
installments subject to compliance with the provisions and requirements of the Local
Government Act and applicable regulations.

WHEREAS it is deemed necessary and desirable to permit all Development Cost Charges
greater than $30,000 imposed pursuant to applicable bylaws in the Township of Langley be
paid by installments;

NOW THEREFORE, the Municipal Council of the Corporation of the Township of Langley, in
Open Meeting Assembled, ENACTS AS FOLLOWS:

1. This Bylaw may be cited for all purposes as “Development Cost Charges Installment
Regulations Bylaw 2009 No. 4753”.

2. All Development Cost Charges payable in the Township of Langley when the total
amount payable calculated pursuant to applicable bylaws exceeds $30,000 may be
paid by installments.

RECOMMENDATION(S):
That Council receive the “Development Cost Charges Installment Regulations” report for
information; and further

That Council give first, second and third reading to Bylaw No. 4753 lowering the threshold for
payment of Development Cost Charges by installments from $50,000 to $30,000.

EXECUTIVE SUMMARY:
Provincial regulations provide for the payment of Development Cost Charges by installments, if
such payments have been assessed above $50,000. However, local governments do have the
ability to adopt bylaws that authorize a lower threshold.

Staff has recently been approached to consider the lowering of the minimum amount for
accepting payments through installments to assist the business community and to reduce the
financial impact particularly felt by small businesses. As such, staff is recommending the
threshold for accepting DCC payments made by installments be reduced to $30,000. In
accordance with the provincial regulations, payments made through the installment option must
be completed within 2 years of the date of subdivision approval or building permit issuance.

PURPOSE:
The purpose of this report is to obtain Council’s approval of a bylaw that provides for payment of
Development Cost Charges greater than $30,000 by installments.

BACKGROUND/HISTORY:
The Local Government Act states that Development Cost Charges (DCCs) established under a
bylaw must be paid at time of approval of a subdivision or issuance of a building permit. It
further provides for the Minister (of Community Development) to establish regulations for the
payment of DCCs by installments.

Current regulations established by the Minister state that DCCs may be paid by installments
only if greater than $50,000, unless a bylaw adopted by Municipal Council authorizes a lower
threshold amount.

DISCUSSION/ANALYSIS:
Historically, policies relating to payment of DCCs in the Township have been based on
provincial statutes, regulations and guidelines. With respect to payments made by installments
the Township has not taken advantage of the flexibility provided through more recent provincial
regulations enabling local governments to allow payments less than $50,000 by installments.

In light of the current economic situation and to create a more favourable environment for
smaller businesses, staff is recommending the threshold for accepting DCC payments made by
installments be reduced from the current $50,000 to $30,000. As there are significant
administrative costs related to tracking of payments being deferred through the installment
option, staff do not recommend its extension to all payments but rather those above $30,000.
