INTRODUCTION

Welcome to Aliso Villas Condominium Association

Condominium living has its blessings and its problems. In order to live
happily with our neighbors, it should be remembered that the essence
of condominium living indicates that there must be some curtailment of
individual rights in order to protect the interest of the community as a
whole.

The Board of Directors of the Association derives its powers and


responsibilities from the By-laws of the Association incorporated in
1971, and from the relevant Covenants, Conditions and Restrictions
(commonly known as the CC&Rs) which were designed to be a
general plan for the improvement, protection and maintenance of the
development

In Aliso Villas we own only the space defined in our CC&R's.


Everything else, including patios, decks, and garages (to which we
have exclusive use) is common property, owned and controlled by the
Association. Our rules and regulations help to protect us from
unnecessary liability, maintain our beautiful community, preserve
property values, and live peaceably side-by-side with each other.

We have 424 units in Aliso Villas. This is a big responsibility. In order


to live comfortably we must be respectful of other residents and of the
Common Area property. Together, we create a pleasant environment
in which to live and protect our investment. Each of us as individuals,
as well as all of us together, as a community should be committed to
enforcing and living by the Rules and Regulations in this manual.

DEFINITIONS
Please use the following definitions for a better understanding of the
Rules and Regulations.

HOMEOWNER: A person(s) who is of record an ow ner of a Aliso


Villas unit.

TENANT: A person(s) who leases or rents from a homeowner.

RESIDENT: A homeowner in residence, a tenant, their children and


relatives in residence, and any other person who resides primarily in a
unit with the permission of the homeowner or tenant.

GUEST: A non-resident who has been invited by a resident,


homeowner, or tenant and is accompanied by that homeowner or
tenant or member of their residence, enjoying the facilities of the
common area.

NOTE: Homeowners or tenants are responsible for the conduct and


actions of their guests and their children at all times. Homeowners or
tenants are responsible for any individual living with them including
and not limited to parents, friends, or roommates. Parents are
responsible for the actions and/or damage caused by their children.

FINE POLICY
Fines will be imposed according to these Rules. Fines will escalate for
repeated violations, acts, or omissions of the same character as those
previously determined by the Board to be an offense pursuant to the
Complaint and Hearing procedures set forth herein. The issue as to
whether a violation, act, or omission is "of the same character" may be
determined at the sole discretion or opinion of the Board of Directors
as established by a majority vote of all Directors on the Board.

Any subsequent violations will be charged $200.00 per violation and as


decided on an individual case basis the Board may pursue legal
action. Any costs due to damage of Common Areas will be charged
along with the Fine.

ARCHITECTURAL CONTROL POLICY
All Common Areas, specifically that area which is outside of the front
door or outside the patio gate, is a controlled area. No landscaping,
decoration (including painting), construction, or alteration of
landscaping or buildings is permissible, except as provided for by Aliso
Villas Homeowners Association or as provided elsewhere in these
Rules. All residents are advised to submit plans for ANY changes
BEFORE attempting to make changes.

Homeowners must submit plans for any proposed changes or


modifications to the Board of Directors for approval prior to making any
such changes or modifications. Plans, drawings, sketches, brochures,
or brief notes of the changes being contemplated must be sent to the
Business Office (at the address listed on the front cover of this booklet)
or may be presented directly to the Board of Directors at a regularly
scheduled meeting.

The Board of Directors has 30 days after having received the plans
and other information either from the homeowner at the monthly
homeowners meeting or from the property management company to
review any proposed construction, decoration or landscaping. The
homeowner is responsible for and must have all building permits and
satisfy all building codes. The homeowner must have the work done
by a licensed contractor and provide this information to the Board.

If the Board determines the proposed changes are not suitable, it may
ask the homeowner to alter the plans, or may disapprove the proposed
changes altogether. Any unauthorized changes are still subject to
Board's approval. Unauthorized changes are considered a violation
and subject to our fine policy and the homeowner may have to stop or
remove an unauthorized project.

If the Board has approved an architectural change, the homeowner


must have all of the work completed within 90 days. Otherwise, the
homeowner must resubmit the request with any new changes and
paperwork plus all previous paperwork.

AIR CONDITIONERS
Window air conditioners are no longer allowed. A central air
conditioning system is the only air conditioning allowed. The
homeowner must submit a plan in writing to the Board. The air
conditioning system must be installed by a licensed insured contractor.

The homeowner must submit the name of the contractor or business,
the address and phone number, and must have the air conditioning
system installed within 90 days after approval or go through the
approval process again. The rules for Architectural Control (see
above) must be followed to have the central air conditioning system
installed or the homeowner may be subject the fine policy and removal
of a non-approved central air conditioning system.

CLUBHOUSE
The clubhouse and facilities are designated for use by members for
Association activities.

Residents may reserve the clubhouse for personal functions. Such


activities must be approved by the Board of Directors or its appointed
representatives at least two (2) weeks prior to the event.

During any activity for minors there must be competent, responsible


adult supervision present at all times at a ratio of no less than one (1)
adult per ten (10) minors. The resident or homeowner reserving the
clubhouse must be present and in attendance at all times.

An application and agreement for clubhouse use, and an advance non


refundable fee ($40.00) and security deposit of $100.00, refundable if
clubhouse and area are left in same condition (clean and un-damaged)
as found, must be submitted to the Business Office. The usage fee
and security deposit set and revised periodically by the Board of
Directors.

If reserved, use of the clubhouse is limited to the clubhouse assembly


area, and rest rooms. At no time may residents be denied access to
the swimming pool or wading pool because of the clubhouse use.

The fire department rated legal capacity for the clubhouse is 26


persons and that limit should never be surpassed. Homeowners and
residents are responsible for the actions of their guests.

Clubhouse activities are limited to the hours between 9:00 A.M. and
9:00 P.M. daily. The Clubhouse must be left clean and locked by the
end of the next day. After 8 PM, all Clubhouse activities must be
limited to the clubhouse interior and the clubhouse doors closed.

No alcoholic beverages are allowed, whether it is an Association or


private function. All laws both Federal and State must be observed.

Clubhouse furniture, equipment or other property of the Association
must not be removed from the clubhouse.

Guest parking for Clubhouse activities must be on the public streets.


Signs or banners shall not be displayed outside. A bouquet of
balloons is permissible, but must be removed at the end of the
function.

No barbecuing or food preparation is permitted in the pool area.

No smoking is permitted.

Unduly loud or disturbing noise is not permitted.

No live or loud music is permitted.

Absolutely no pets are permitted in the clubhouse.

At no time may the clubhouse be used for business purposes except


for Association activities.

Damage to any of the clubhouse facilities, to Association property, or


to any resident’s property, or failure to properly clean up after any
clubhouse activity will result in forfeiture of the security deposit, and
gives rise to an obligation to reimburse the Association for any
additional costs or expenses incurred above and beyond the value of
the security deposit.

Violation of clubhouse or Association Rules may result in forfeiture of


the security deposit, a subsequent hearing, and the possibility of a fine.

COMMON AREA
There shall not be any object left upon, nor stored in, the Common
Area.

Clothesline poles shall not be installed upon the exterior of any unit or
in the Common Area of the community. Patio walls, fences, dividers,
porch railings or any surface plainly visible from the Common Area
shall not be used for drying of towels, clothing, screens, equipment or
other objects foreign to the specified area.

Homeowners and residents are responsible for the conduct or actions


of anyone living with them, their children and guests.

There shall be no climbing on any exterior portion of any building
including fences, railings, roofs, nor upon any tree or object within the
Common Area.

Ball playing near Aliso Villas buildings, garages and other structures is
damaging to the structures and paint, and is prohibited.

No entertainment including but not limited to parties, dinners, or picnics


is allowed.

Any damage or injury to the buildings, recreational facilities, gates,


fences, Common Areas, equipment, or other Aliso Villas property
caused by homeowners, residents, their children or their guests shall
be repaired at the expense of the homeowner and subject to the fine
policy.

No moon bounces, play houses, forts, basketball hoops or other


similar items are allowed in the Aliso Villas community.

DECKS, FENCES, PATIOS, RAILINGS & STEPS


Carpeting may not be glued on decks or steps or any place on
Common Areas.

Holiday lights and trimmings may be put up Thanksgiving weekend


and must be taken down by the end of January.

Climbing on Common Area fences and buildings is prohibited.

The Association will allow a patio fence to be extended as long as the


following criteria is met:
A written request by the homeowner must be sent to the Business
Office detailing the requested extension. The request should contain a
description of the materials to be used, an elevation of the fences and
a map/site plan with all appropriate dimensions.

If approved, a written approval letter will be sent to the applicant with


specific guidelines. Construction/demolition may not begin until this
approval letter is received by the applicant. Under certain
circumstances, the Board may request written permission from all
surrounding homeowners.

Remedies: If at any time there is abuse to the fence by children,


animals, etc., the owner will be charged for the repair of the damage

and is subject to the fine policy. Failure to pay the repair bill will be
cause for legal action.

Patio or deck covers and extended patio fences will be considered by


the Association only if a written request is made together with
complete plans to the Business Office.

Covers must conform to community standards and be approved by the


Board of Directors. Standards may be obtained from the Business
Office. All future maintenance of the covers are the responsibility of
each owner and this fact must be disclosed to all future purchasers of
the unit. After approval the work must be completed within 90 days or
the homeowner must go through the approval process again.

Work on both patio covers and extended fences must be done by a


licensed/insured contractor approved by the Board of Directors.

Enforcement: Should an unauthorized cover or extended fence be


installed without prior written approval, the Board of Directors may
require it to be removed/modified so as to conform to community
standards. If removal/modification/maintenance is refused by the
current owner, the Association will repair/modify/remove the cover or
fence and bill the owner for the costs. Should the owner refuse to pay
the bill, the Association may then proceed with legal action to collect.

No mops, brooms or other equipment are to be stored where they are


visible from the exterior of the units. No towels, rugs, clothing, etc.
shall be placed on patios, decks, fences or any other part of the
structure of the Common Area. No trash or trash containers may be
stored on decks or patios.

The storage of personal items, except for normal patio items in the
patio and deck areas, is not permitted in any Common Areas as
defined by the CC&Rs and which include areas adjacent to each unit,
the open parking areas, areas under stairs, decks, patios, slopes,
sidewalks, streets, etc. If personal items are observed being stored in
any of these areas, one warning letter will be sent asking that the items
be removed within 30 days. After 30 days, the enforcement procedure
starts and a fine may be assessed to the owner of the unit and/or the
Association may elect to have the personal items removed and stored
at the owner's expense.

Only proper outdoor furniture may be used on decks and patios. (No
cots, old unsightly couches, chairs, excess toys, playhouses, etc.).

Outside radio poles, antennas, or clotheslines are not permitted.

Tree trimming within the confines of any patios is the responsibility of
the homeowner. Trees and foliage must look neat and be trimmed
regularly.

Potted plants on decks and patios must have saucers (plastic, glass or
ceramic not CLAY OR TERRA COTTA) to collect water and silt, which
in the past has caused damage to decks, patios, flashings and walls.
Clay and terra cotta leak water and ROT WOOD.

A homeowner may not have vines or other plants growing on stucco,


patio fences, decks or wrought iron railings. Such vines have caused
wood rot, stucco damage, rust and staining. If a homeowner has vines
or similar plants, the homeowner will be asked to remove them. The
homeowner is subject to the fine policy and will be billed for any
damages.

All landscaping within patios and decks must be kept neat. This is the
responsibility of the homeowner. This includes but is not limited to
trimming trees, shrubs, vines and flowers. Landscape cannot
overhang on roofs or fences. Any landscaping or anything else that
causes problems including but not limited to structural, infrastructure or
property damage must be addressed by the homeowner as defined by
the Board.

The homeowner will be responsible for any repairs, removal,


replacement or fines to the patios or decks whether there are one or
two patios. Any tree, shrub or large item to be planted in any patio
must be approved by the Board.

Umbrellas in good condition (with no advertising) may be used on


decks and in patios.

Some units have two (2) patios. Homeowners are responsible for all of
the above for both patios.

DOORS
All replacement doors must be approved by the Board of Directors
prior to installation. Doors must be painted to match the existing trim
colors used in the community. Metal screen doors or wood screen
doors must be of a type and color approved by the Board of Directors.

All doors and screen doors must be maintained in good repair by the
homeowner. Those found to be in poor condition must be repaired or
replaced within 30 days or they will be repaired or replaced by the

Association. The homeowner will be responsible for any repairs and/or
replacement and for any fines.

DRAINAGE
No owner or occupant of any unit within the community shall obstruct,
alter, change or remove any drainage structure or facility without the
prior written approval of the Board of Directors, nor shall any owner or
occupant of any unit within the community add additional drainage
structure or facility without such prior written approval of the Board.
Unauthorized additions may have to be removed and a fine may be
imposed.

DRIVEWAYS, PARKING LOTS AND


CUL-DE-SACS
Driveways, parkways, and cul-de-sacs are not alleys, but rather
entrances to the homes in the community and must be treated as
such.

Driveways are under the California Vehicle Code by County Resolution


#77-1601. Cars parked in red zones will be towed at the owner's
expense. A fine may also be imposed. If your vehicle is towed, call
the Mission Viejo Police (PH: 949-770-6011) and they will advise you
of the company that has possession of the vehicle.

Every unit has two assigned parking spaces: the enclosed garage and
one outside space marked with the unit number. Residents or guests
can use only the garage, the assigned space or the public street. If
someone uses a resident’s assigned space, the resident may have the
offending vehicle towed.

No storing of vehicles is allowed at Aliso Villas . Only vehicles in


operating condition may be parked in the uncovered parking area.
Boats, trailers, commercial trucks, derelict vehicles, recreational
vehicles or offensive and unsightly vehicles are not permitted to park
anywhere in Aliso Villas .

The C,C,&R's of the Association specifically state "No boat, trailer,


recreational vehicle, camper, truck or vehicular machine shall be
permitted to remain on any street or on any part of the property...".

For the purposes of further defining this section, the following vehicles
will not be permitted to park or to be stored on Association property:

Trucks: Any modified truck, flatbed, stake-bed, or van with higher than
a one ton rating, and trucks with an expired license, expired
registration or in inoperable condition.

Automobiles: Modified automobiles, vans, buses, limousines,


abandoned automobiles, or any automobile with and expired license or
expired registration.

Other Vehicles: All boats, trailers of any kind, recreational vehicles,


jet-ski carriers, truck campers or camper vans and derelict vehicles.

WHEN A VEHICLE IS IN QUESTION, ITS PROHIBITION, IF ANY,


WILL BE SOLELY DETERMINED BY THE BOARD OF DIRECTORS.

All vehicles must have a current registration, insurance and license


plates. This includes driving or parking in our driveways, parking lots,
cul-de-sacs and garages. Only drivers with a current driver's license
may operate a vehicle within Aliso Villas.

THE SPEED LIMIT IS 10 MILES PER HOUR IN THE DRIVEWAYS,


PARKING AREAS AND CUL-DE-SACS.

Illegally parked vehicles in a specific, reserved parking space may be


towed at the vehicle owner's expense.

If the residents or guests of any unit park a vehicle emitting excessive


oil and/or any agent causing damage to the asphalt or its seal, the
owner of that unit will not only be subject to a fine, but also be liable for
the costs of repair of the damage. This also includes the use of
excessive soap used in the washing of vehicles.

A WORD OF CAUTION:

There is absolutely no playing in driveways, parking lots or cul-


de-sacs. Parents should be aware that the streets within the
community are well traveled by automobile traffic and are not intended
to be used as a playground for children. Please caution children not to
play in dangerous areas.

No parking is permitted in curb areas painted red, or in front of fire


hydrants, or in marked fire lanes. Any vehicles parked in these areas
may be towed without notice at the vehicle owner's expense.

No bicycle, motorcycle, mini-bike, skateboard or other type of vehicle


which may cause injury to pedestrians or damage to property, may be
ridden upon the sidewalks or landscaped areas of the community,

except that a tricycle or small bicycle with "training wheels" shall be
permitted on the Common Area walkways when ridden properly by a
child of the size and age for which such a cycle is intended and in the
company of a responsible adult. In all cases, right-of-way shall be
given to pedestrians.

No motorcycles are to be operated on common areas except for


leaving and entering the premises on black top areas only.

No noxious or offensive activities, including but not limited to the


outdoor repair of automobiles, shall be carried on upon the property.
No vehicle which is not in operating condition shall be parked or left on
any street or parking area.

Any vehicle found in violation of the above parking rules be towed at


the vehicle owner's expense, and the owner may be fined.

GARAGES
County law and the Association Bylaws state that garages may be
used for parking vehicles and storage only, and shall not be converted
for living or recreational activities. Also, they are not to be used as
playrooms, workshops, mechanic's sheds, offices, sleeping quarters,
dog kennels, etc. Remember - garages are Common property.

Garage doors should remain closed and locked at all times, and
opened only when entering or leaving the garage. Garage doors must
be closed quietly. Slamming garage doors is damaging to the door
and building, as well as annoying to the neighbors. If a resident
damages a garage door or building, they will be responsible for all
repair or replacement costs.

Electric openers are intended to open and close the garage doors for
the entry or exit of vehicles from the garages. The openers cause
noise and vibration when in use and can cause a disturbance to other
residents, especially to residents of the upstairs units directly over the
garages. Please use the electric openers with regard for other
residents in your building.

Garage doors openers must be professionally installed and are the


homeowner's responsibility.

Garage door springs are the responsibility of the homeowner.

Due to their inherent noise, please do not use washers or dryers after
10:00 p.m. or before 7:00 a.m.

Residents are not allowed to store dangerous, combustible, or


flammable products in their garage including but not limited to paint,
paint products and solvents.

Disposal of such products should be at a hazardous waste


disposal site. Under no circumstances can they be put into trash
containers for pick-up, or dumped into the storm drains.

No garage sales are allowed in Aliso Villas. Under no circumstance is


the Common Area to be used for display of any kind.

HOLIDAYS
No July 4th fireworks of any type may be ignited anywhere in the
Common Area and restricted Common Areas (i.e. patios, garages) of
the Association (City Ordinance) at any time. Remember, Aliso Villas
is in a FIRE ZONE.

When there is a legal holiday, the trash collection will be picked up one
day later; therefore, the trash is to be put out one day later at the
"designated" hours.

Holiday lights and trimmings may be put up on Thanksgiving weekend


and must be taken down by the end of January.

INSURANCE
Nothing shall be done, kept, or permitted to exist in any building or in
the Common Area, which will result in increase of the rate of insurance
therein.

No owner shall permit anything to be done or kept in his unit which


would result in the cancellation of insurance, or which would be in
violation of any law. The owner shall not permit or suffer waste to exist
in any condominium or garage area.

It is highly recommended that each owner contact his/her insurance


agent regarding "Homeowner" insurance on the individual units. The
Association insurance provides coverage on the entire exterior of the
building, it does not cover the interior of any unit. The Association

insurance does not cover such things as a rupture of the unit water
heater and consequent flooding of adjoining units. Damage to
contents inside the unit are not covered by Association insurance.

The Association's insurance company, as of published date is State


Farm Insurance: Agent: Bill Blodgett - phone: 714-772-1234.

It is HIGHLY recommended that each homeowner obtain individual


Homeowner insurance which will cover any deductibles resulting from
a claim on the Master policy.

Recent court decisions may make Homeowners liable for certain


liabilities that occur on common areas. An additional umbrella policy is
recommended. If you have questions regarding the Association
insurance coverage, please contact PCM at 949-768-7261.

KEYS
Pool keys cannot be duplicated. If the key is lost, a replacement key
can be obtained from PCM. The Association does charge a fee (at this
time the fee is $40 per key) for the replacement.

Mailbox keys are the homeowner’s responsibility. Replacement keys


may be obtained from the Mission Viejo Post Office. The repair of the
mailboxes is also the responsibility of the Post Office.

Positively no notices, flyers, or advertisements may be attached or


posted on any mailbox.

LANDSCAPING
The Association is responsible for maintaining landscaping in the
Common Area.

The slopes were landscaped, not only for aesthetic value, but also for
structural control. Slope maintenance is very expensive and all
residents, children and guests must stay off the slopes. The
homeowner will be responsible for any damage or replacement costs,
and is subject the violation fine policy.

Residents are not permitted to remove, replace and/or add


landscaping or make any attachments to sprinkler water lines in the
common areas.

The discharge or placement of any dirt, trash, flower pots, building
materials, paint, patio plant trimmings, gasoline, oil, solvents or
noxious chemicals into the Common Areas, including streets or
planted areas, is strictly prohibited.

Sprinklers shall not be tampered with. Acts of vandalism have cost


thousands of dollars per year. Please report any such acts to PCM. If
possible, furnish the address of the person vandalizing the system.
The homeowner where the person resides will be responsible for fines
and the Association will bill them for any damages. Remember:
Vandalism is a crime and the Association will prosecute the parties
responsible.
No bicycles, tricycles, skateboards or other wheeled toys or vehicles
are permitted on lawns, landscaped areas or around pool areas. The
homeowner will be responsible for all damages and fines.

Any recreational activity which damages landscaped or other Common


Area will not be permitted. The homeowner will be responsible for all
damages and fines. (Bounce Houses destroy the lawns and are NOT
allowed)

All plant containers must be of earthenware, stoneware, or wood.


Colored pots are permitted if they match the exterior color scheme.

Residents should not interfere with the duties of the gardeners. They
have a job to do and a schedule to keep. If you have any special
problems or requests, please refer them to PCM.

With Board of Directors approval, homeowners can plant decorative


plants in the area immediately outside the front entrance doors. All
homeowner's planting areas must be approved by the Board of
Directors.

NOTE: Homeowners must dispose of all debris and trash from their
area. Mulch, fertilizer, bags of planting mix, soil additives, gardening
tools, etc. must be kept hidden indoors and cannot be left in the
garden area.

LEASING A UNIT
The purpose of this section is to state the Rules regarding tenants in
Aliso Villas, and to explain some precautions recommended to protect
your Aliso Villas investment.

Any "FOR LEASE" sign must be no larger than the size commonly
used by Real Estate companies (18" x 24"). Only one sign is permitted
and it can be displayed only in a window of the unit.

Tenant(s) must be given a copy of the Rules Booklet. It is a good


practice to have them sign for it as part of your lease agreement. This
may help protect you in the event there are violations of the Aliso Villas
Rules and Regulations.

Suggested Precautions:

1. Obtain a DEPOSIT, even if leasing to a close friend or


relative. This ensures that you will receive financial assistance in the
event there are damages to your property.
2. Personally MEET and TALK with your prospective
tenant(s). It is not unusual that homeowners fail to properly screen
tenants, and the resulting problems can be serious and expensive.

3. Again, deliver a copy of the Rules booklet to EACH tenant


every time you lease, and have them sign for it to prove receipt. When
properly informed about parking, pets, garbage and noise control, both
tenants and their neighboring residents will be happier.

NOISE
All homeowners and tenants have the right to peaceful enjoyment of
their respective properties and the Common Areas.

Notwithstanding the preceding Rules and Regulations, any act by any


tenant, owner or guest that is interpreted to be detrimental to the
peaceful enjoyment or the welfare of the Common Areas shall be
treated as a violation and remedied by the Board of Directors in
accordance with the procedure described herein:

1. Anyone caught causing a general nuisance within Aliso Villas will


be subject to the normal fine structure.

2. A 10:00 P.M. to 7:00 A.M. Quiet time shall be observed by all


residents and guests in consideration of their neighbor's right to
peaceful enjoyment of their property.

3. Radios, televisions, audio equipment, musical instruments, and
noise emitting machinery, shall be operated in a manner and at a time
so as not to unreasonably disturb other residents.

4. Because sounds reverberate strongly in the Common Areas, noise


levels at the pool, wading pool, playground, clubhouse, patios,
walkways, other Common Areas and from vehicle sound systems shall
be kept at a volume that does not disturb other residents.

5. Loud or offensive language in the Common Area is not permitted.

6. Disorderly conduct in the Common Area is not permitted.

7. Domestic disturbances are not under the control of the Board of


Directors and should be reported to the Mission Viejo Police
Department at 949-770-6011.

8. Dog owners are prohibited from letting their dog bark to the extent
that the barking causes a disturbance to the peace and comfort of
other residents.

PETS
PET OWNERS ARE RESPONSIBLE FOR CLEANING UP AFTER
THEIR PETS (BOTH CATS AND DOGS) AT ALL TIMES. PET
DROPPINGS SHOULD BE IMMEDIATELY CLEANED UP AND
DEPOSITED IN AN APPROPRIATE TRASH CONTAINER. AT NO
TIME SHOULD THEY BE BURIED OR DISPOSED OF IN ANY
MANNER ACCEPT ABOVE.

Dogs must be on a leash at all times, held by a person capable of


controlling the animal. Dogs cannot be allowed to roam free.

All dogs and cats must have an identification collar. Any unidentified
pets may be reported to animal control.

Pets are not allowed in gated/fenced pool areas, in the clubhouse or


on the playground.

Pets must not be left unattended or tied to a tree, stake or post in the
Common Area.

For health and animal control reasons, there should be no feeding of


animals in any Common Area, nor food left out for stray animals.

Cats should wear collars and be vaccinated and litter box trained.
Outdoor cats should be neutered to eliminate the problem of spraying
common areas. "Spray" clean up will be charged back to the
homeowner.

Patios, decks or garages may not be used as kennels. Dogs cannot


be left unattended in these areas.

Cats must be kept off roofs. Cats tend to use the gravel roofs as litter
boxes, causing a very unpleasant odor for the nearby residents and
requiring cleanup.

The Association shall have the right to prohibit the maintenance of any
animal, which in the opinion of the Directors of the Association,
constitutes a nuisance or a danger to any other resident or to the
property, or interferes with any person's reasonable and comfortable
enjoyment of his property (CC&Rs).

The CC&Rs of the Association allow up to two common household


pets such as birds, cats or dogs per unit. Garages, decks, and patios
are not to be used as kennels. Each owner/resident has the
responsibility to clean up after their pets. Cats are not allowed to be
on the roofs of the community. When walking dogs, they must be on a
leash at all times. Pets must be cleaned up after in an immediate and
appropriate manner.

Exotic pets such as snakes, birds of prey, lions, tigers, etc. are not
permitted.

Pet owners must comply with all sanitary practices and control their pet
so as not to destroy, ruin, or otherwise damage Homeowner or
Association property or landscaping.

No animals may be kept in a garage at any time.

Homeowners will be held responsible for the actions of their pets or of


their tenant's pets.

Enforcement: Should any of the above policies be violated, the fine


procedure will begin, and in addition t the animals may be reported to
County Animal Control.

If further violations occur, the Association may then prohibit


through legal injunction the right to maintain the animal(s).

PLAYGROUND
Playground hours are from 9:00 AM to 9:00 PM daily. Use of the
playground area other than at these times is strictly forbidden.

Loud or disturbing noise is prohibited. Positively no activity that


infringes upon the peaceful use and enjoyment of the facilities by
residents will be permitted.

Conventional radios and televisions are prohibited in the playground


area. "Walkman" type radios, tape and CD players and televisions
with individual headsets are permitted. Remember that the playground
is ringed by a number of units, and the people in these units may want
to eat their meals, read or sleep in reasonable peace.

Homeowners and residents are responsible for their guests' conduct or


actions. All persons using the playground MUST abide by any
additional rules posted in the playground area.

Without exception, no food or beverages in glass containers are


permitted in the playground area.

Absolutely no pets of any kind are permitted in the playground area.

No alcoholic beverages are allowed at any time.

Use of the playground facilities while under the influence of alcohol,


narcotics, drugs or medicines is prohibited.

Smoking is prohibited in the playground area.

Bicycles, skates, Frisbees or similar objects may not be brought inside


the playground area.

Aliso Villas Condominium Association expressly assumes no


responsibility for the safety or acts of any persons.

POOL AND WADING POOL


For purposes of these Rules, "pool area(s)" shall be construed to
include the gated/fenced area behind the clubhouse, surrounding and
including the 2 pools.

Pool Hours are from 9:00 AM to 9:00 PM daily. Use of the pool area
other than at these times is strictly forbidden.

No admittance to the pool is allowed unless the resident has a properly
numbered key.

Loud or disturbing noise is prohibited. Positively no activity that


infringes upon the peaceful use and enjoyment of the facilities by
residents will be permitted. Conventional radios and televisions are
prohibited in the pool area.

"Walkman" type radios, tape and CD players and televisions with


individual headsets are permitted. Remember that the pool is ringed
by a number of units, and the people in these units may want to eat

All gates to pool areas are to remain closed and locked at all times. A
key is required for admittance.

Use of the pool and wading pool is limited to homeowners, tenants and
their invited guests. Three (3) guests is the maximum per unit.
Residents over the age of 14 and under the age of 18 are allowed one
(1) guest who must be 14 years of age or older. Guests must be
accompanied by a resident at all times.

For safety reasons children under 14 years of age are not allowed
within the gated/fenced pool area unless accompanied by an adult (18
years of age or older).

Diving, dunking, shoulder riding, pushing, screaming or jumping on


other swimmers or objects is prohibited. Running, roughhousing or
horseplay are not permitted in the pool area. No “Marco Polo” type
games are allowed after 4:00 p.m., as the noise disturbs nearby
residents.

Without exception, no food or beverages in glass containers are


permitted in the pool area.

Absolutely no pets of any kind are permitted in the pool area.

The wading pool is for tots only.

Bicycles, skates, Frisbees or similar objects may not be brought inside


the pool area.

All trash must be placed in proper receptacles.

No alcoholic beverages are allowed at any time.

Use of the pool or wading pool facilities while under the influence of
alcohol, narcotics, drugs or medicines is prohibited.

Pool users must shower before entering the pool or wading pool.
Persons using suntan lotions, oils or creams should shower again
before re-entering pool or wading pool.

Lifeguard equipment must not be tampered with as it is for emergency


use only.

Infants, whether in diapers or training pants are not permitted in the


pools. Infants brought to the pool area must have diapers and
waterproof pants with elastic leg and waist openings over them.
Health regulations require the closing of the pool should feces
contaminate the water.

Persons with skin disorders, communicable diseases or open wounds


are not permitted in the pool or wading pool.

Smoking is prohibited in the pool area.

Floating devices, balls, swim toys, swim fins, diving gear, wet suits of
any kind and boogie boards are prohibited in the pool and wading pool.

Appropriate swimming attire is required in the pool and wading pool.


Cutoffs are not allowed. Nude swimming and sunbathing are
prohibited.

Any person with long hair must wear a cap or put the hair into ponytails
or braids. The hair cannot be held in place with metal pins or clips.

Barbecuing or food preparation is not permitted in the pool area. No


food is allowed in the pool or wading pool area.

The restroom facilities, including bathrooms and showers are to be


used only for their intended purposes and only as posted. The
restroom facilities are to remain locked and closed at all times. A key
is required for admittance. Loitering in those facilities is prohibited.

Aliso Villas Condominium Association expressly assumes no


responsibility for the safety or acts of any persons. All persons enter
and use the pool areas and facilities at their own risk. No lifeguard is
on duty at any time. No one should swim alone.

Infraction of these rules will not only subject the homeowner to a
possible fine, but could also lead to denial of pool use to the
homeowner or residents of the unit.

PROPERTY MANAGEMENT
PCM of California provides a service to the Homeowner Association.
Their objective is to make your residence in the community as
comfortable and trouble-free as possible. Phone them with normal
maintenance requests such as broken sprinklers, to report vandalism,
or to report any major liability risks. Be aware that a request for other
than routine maintenance often requires the prior approval of the
Board of Directors

The office phone number is 949-465-2287 or 949-465-2427. Please


be prepared and keep your calls brief. The normal office hours are
9:00 a.m. to 12:00 p.m. and 1:00 p.m. to 5:00 p.m. Monday through
Friday.

For true emergencies, where property damage is probable or an


immediate health or liability hazard exists after normal office hours,
please call the same phone number and follow the directions on the
phone system.

The Aliso Villas Board of Directors meets the second week of each
month at 7:30 p.m. in the meeting room at the pool. There are no
meetings in August and December.

RESPONSIBILITIES
Every resident owner is financially responsible for any damage caused
whatsoever by his household or guests. Every absentee homeowner
is financially responsible for any damage whatsoever caused by
his/her tenant and the tenant’s household or guests.

The Association has the responsibility to maintain such items as roofs,
rough plumbing (generally plumbing within the walls), “main” water and
sewer lines and irrigation lines. However, should a leak develop with
one of these items and is repaired in a timely fashion by the
Association, damage caused by a leak to personal property or
household fixtures of a member or resident will be the owner's or
resident's responsibility. It is the resident's responsibility to report any
problems immediately.

The Association accepts no responsibility for the repair/replacement of


household fixtures/personal property including but not limited to
flooring, ceilings, furniture, stereos or audio equipment, automobiles,
etc. If inspections are repeatedly requested, with no evidence of an
existing leak in the roof, the cost of the requested inspections will be
forwarded to the owner.

ROOFS / ROOF LEAKS


Only authorized persons are permitted on the roofs. Our roofs are
fragile and easily damaged. Roofs may not be used for sunbathing,
window cleaning or cat boxes.

No antennas, plants, etc. of any kind are permitted on the roofs.

The Association is responsible for repairing the roofs. Please report all
roof leaks promptly to PCM of California.

SECURITY AND SAFETY


To maintain the highest level of security possible inside Aliso Villas
community, cooperation of all residents is required in being aware of
any unusual, suspicious, or illegal activities or trespassing. Any such
activity should immediately be reported to the Mission Viejo Police
Department at 949-770-6011.

NORDIC SECURITY SERVICES is the Security company hired to


provide security services to Aliso Villas, please contact them at
714-751-0347

BEACH CITIES TOWING provides our towing services, please contact


them at 949-472-4383, anytime you need to have someone towed
from your parking stall or behind your garage.

Bicycle riding is permitted on city streets provided that the rules of the
road are observed. Safety helmets are required by law. In the interest

of pedestrian safety, skateboarding, bicycle riding, roller-blading, roller-
skating and similar activities on the sidewalks is strictly prohibited.
Except as noted in the section dealing with driveways, parking lots and
cul-de-sacs, sidewalks are for pedestrian traffic only.

In the interest of safety, it is recommended that recreational activities,


including but not limited to, skateboarding, ball playing, Frisbee
throwing, roller skating/blading, and riding of "big-wheel" type toys not
be conducted on the streets, sidewalks or other Common Areas of
Aliso Villas.

Due to the high cost of repairs and repainting, and the potential
exposure to liability in case of an accident, skateboard riding and street
hockey are strictly prohibited in Aliso Villas.

Door to door solicitation in the community is not allowed and should be


reported to the Mission Viejo Police Department as an act of
trespass at (949)770-6011.

Homeowners and residents shall be held responsible for the actions of


their children, tenants, and guests.

Aliso Villas adopts the curfew laws of the City of Mission Viejo.

Climbing of walls, trees, fences, gates, buildings or other


structures in the community is not permitted.

A speed limit of 10 m.p.h. must be observed within the community.


Any accidents or reckless driving should be recorded, with car
description, license number and any other descriptive details available,
and reported immediately to the Mission Viejo Police Department at
949-770-6011.

Yard or garage sales are prohibited.

There shall be no obstruction of the Common Area including streets or


sidewalks. Personal property (such as, but not limited to bicycles,
toys, clothing, lounge chairs) are not to be stored or left in the
Common Area.

There shall be no loitering in the street, at the entrances, or in any area


or manner that may create a hazard or inconvenience to the
Association, to any homeowner, or to any resident. Due to the
extreme safety hazard, this includes, but is not limited to, bicycling
near the entrance areas.

Flammable or toxic substances maintained for any purpose may not be


stored within Aliso Villas.

Vandalism is prohibited and vandals will be prosecuted to the fullest
extent of the law. Any observed vandalism should be reported
immediately to the Mission Viejo Police Department at 949-770-
6011, furnishing any descriptions, addresses, names, etc. The
Management Company (PCM) should also be advised.

All applicable local, state and federal laws must be obeyed at all times.

SIGNS
No signs, posters or displays shall be shown or displayed from
residences, excepting one sign or notice of customary and reasonable
dimension which states that the unit is for rent or for sale. Signs
advertising a unit "FOR SALE" or "FOR RENT/LEASE" shall be of the
size commonly used by Real Estate companies (18" X 24"). All signs
are to be removed within forty-eight (48) hours after the signing of the
sale or rental agreement. Signs may not be affixed to the building or
mailboxes.

Anything that detracts from the appearance of Aliso Villas community


is strictly prohibited.

STREET LAMPS
Malfunctioning street lamps may be reported to PCM of California or
directly to the Edison Company at 800-611-1911 or 800-655-4555 and
online at www.sce.com. Edison will request the pole number (usually
on a metal plate on the pole) as well as the address of the nearest
condominium.

TERMITE WORK
The Association is responsible for the treatment of the structures for
termite control. When selling a unit, the owner is responsible for a
termite inspection of the unit at the owner's expense. If the inspection
discovers a termite infestation, contact Diversified for treatment
arrangements.

TRASH

Garbage or rubbish and recycle containers must be kept in the
garage until pick-up day.

Garbage or rubbish and recycle containers may be temporarily placed


for pick-up not earlier than 6:00 P.M. the evening prior to pick-up.
Containers must be returned to homeowner's garage by 12:00
Midnight the day of the garbage pick-up. If garbage or rubbish and
recycle materials are not put in a proper container, securely tied in
plastic garbage bags and do not have the address number on them,
the homeowner is subject to a fine.

This means that a resident cannot just sit out the garbage bags or
place them beside the garbage or recycle containers. Residents must
put the bags into the proper containers.

Garbage or rubbish and recycle containers shall not be placed in


Common Area flower beds or in a location that blocks a neighbor’s
garage.

TV ANTENNAS/DISHES
Association approval is required PRIOR to the installation of such
devices. All requests for 24" diameter and under DBSS/MMDS
antennae must be submitted, in writing, to the Board of Directors. In
the case of non-owner occupied units (i.e.: rental units) the request
must be submitted by the owner of the unit, not the tenant. No TV
antennas are allowed.

All requests MUST, without exception, contain the following


information:

A. The NAME, along with the complete ADDRESS and TELEPHONE


number of the LICENSED INSTALLER or COMPANY installing the
dish on the property.

B. The installer/company's CALIFORNIA STATE CONTRACTOR'S


LICENSE NUMBER.

C. A copy of the installer/company's CALIFORNIA STATE


WORKMAN'S COMPENSATION CERTIFICATE NUMBER.

D. A sketch showing the proposed installation location within the unit,


along with the proposed wiring path for coaxial cable and ground wire.
The Homeowner must also include the mounting method, mounting

type, and information pertaining to the weatherproofing of the
mounting, cables, etc.

Because the Association has more than one building architectural style
within the project, the Association has designated antennae locations
on a unit-by-unit basis, with all dish installation located NO higher than
the upper fascia board of the unit. Under NO circumstances will
roof mounting be permitted. All mini-dishes MUST be mounted on
wooden surfaces only (i.e., fascia boards) without piercing the stucco
surface, or any wood trim surface that leads directly into the interior
wall area of the unit.

All coax wiring MUST be stapled and concealed as neatly as possible


along the underside of the fascia boards, and routed according to
Association mandated points of entry. Weatherproof wire guide MUST
be installed wherever cable enters the unit. Ground wire MUST be run
in such a manner as to be as invisible as possible to its termination
point.

Upon final installation and inspection by the Association, the


Association's painting contractor will paint all exposed wiring, and
mounts, the same color as the background material it is mounted on,
with the cost of such painting billed directly to the unit owner.

Requests for approval will be handled by the Board of Directors, en


masse, ONLY during monthly Board meetings. Requests will NOT be
reviewed or approved at any other time during the month. In the event
a monthly meeting does not take place as scheduled, for reasons of,
but not limited to, holiday, lack of quorum, etc., requests will be
handled at the next scheduled meeting. This may result in a delay in
approving the request, so Homeowners should plan ahead.

Upon review of the installation plan by the Board of Directors, the


Homeowner will be notified in writing regarding approval. At that time,
the Homeowner will also receive any additional installation guidelines
deemed necessary by the constraints of your particular unit. It is the
Homeowner's responsibility to convey all installation requirements to
the installer. [The Homeowner acknowledges that they and the
installer have fully complied with all installation requirements as set
forth by the Association.]

In the case of removing installed equipment, the homeowner must get


approval in writing from the Board. Tenants must have the
homeowner get approval to remove the dish for them; tenants cannot
make the request. It shall be the responsibility of the homeowner to
return the area to an acceptable condition, filling in all holes and
repainting the surfaces involved in the original mounting to the
complete satisfaction of Aliso Villas Condominium Association.

Upon review of the removal plan by the Board of Directors, the
Homeowner will be notified in writing regarding approval. At that time,
the Homeowner will also receive any additional removal guidelines
deemed necessary by the constraints of your particular unit. It is the
Homeowner's responsibility to convey all installation requirements to
the contractor. [The Homeowner acknowledges that they and the
contractor have fully complied with all removal requirements as set
forth by the Association.]

Costs relating to the installation of, maintenance to, damage caused


by, or removal of such equipment shall be at the sole expense of the
homeowner.

Whether a satellite dish is in existence, installed or removed, it is the


responsibility of the homeowner to disclose to any future homeowner
any costs related to these above and that these responsibilities go with
the sale of the property.

It is to be understood by all owners and residents that these rules


pertain only to those DBSS installations involving dish diameters of
twenty-four inches (24" or less). No other over-the-air (standard
TV/AM/FM) antenna installations are permitted at any time.

Non-approved installation will subject the homeowner to the fine policy.


Non-approved dishes will be and removed and disposed of at the
homeowner's expense.

Remember that this is a "Condominium", under California law, and that


you DO NOT own the building surfaces of your unit. The building itself
is owned by the Association. The Homeowner only owns the airspace
within the unit, as set forth in the trust deed.

USE OF FAMILY UNITS

Our Bylaws state that "units shall be used for residential purposes
only.

No business or commercial activity, including but not limited to,


automobile repair, shall be maintained or conducted in any
condominium.

WINDOW TREATMENTS

It is against Association policy to put aluminum foil, sheets, or
cardboard or any such substance in windows. It is suggested that
those desiring brightly colored drapes or curtains, please line them so
that a more presentable and conservative appearance within the
community is maintained.

Blinds or sunshades of any kind must be installed inside the windows.


They may not be hung from the eaves or overhangs.

Maintenance of doors, windows and screens is the responsibility of the


homeowner. They must be kept in good condition in accordance with
Aliso Villa’s standards.

WORD TO THE WISE


Do not use strong abrasives on your fiberglass tubs and fixtures.

Garage doors require 30 inch springs.

Keep the weep holes at the bottom of your windows open so the rain
will not collect in the slide and spill over.

Keep your doors and windows locked. Keep garage doors closed and
locked.

Mission Viejo Company, the builder of these units, advises strongly


against the use of waterbeds as "the units cannot withstand the forces
a waterbed would exert on the structure." Please be advised that if a
waterbed is to be used, the owner should have a special waterbed
insurance policy, along with "condominium contents" insurance in the
event any damage is caused which would make the owner liable.

Remember to oil your furnace and change the filters often.

The bathtubs require caulking around the soap dishes, overflow drains,
mixer valves, shower heads, etc. to prevent water leaks from causing
damage to floors and ceilings of units below. The owner of the unit in
which the leak occurs is responsible for repairing such leaks and for
the repair of any damage caused by these leaks to other units.

MISCELLANEOUS

Orange County Ordinance 36.015 states that it is against the law to
leave children under the age of 14 years without a responsible person
in charge. Remember also that there is a 10:00 p.m. curfew in effect.

Persons caught or suspected of vandalizing or otherwise damaging or


defacing any property belonging to the Association or a resident will be
prosecuted to the full extent of the law.

Skateboards and bicycle ramps are not permitted anywhere is the


Aliso Villas community.

Bicycles, Big Wheels, skateboards, roller blades, etc. are not permitted
on the sidewalks around the units. This is for the safety of
pedestrians.

Cycles or wheeled toys creating excessive noise or causing a


nuisance are not permitted. Wheeled toys must have rubber tires.

Please remind children that pedestrians have the right-of-way.

The use of guns anywhere in the Aliso Villas community is NOT


permitted. This includes B-B. and pellet guns.

No Frisbee throwing, street hockey or ball playing of any kind is


permitted in the community.
