PART A:.ENERAL =% Short title !" #o$$e!#e$e!t%: (1) These rules may be called the Punjab Tehsil/Town Municipal Administration Rules of Business !""!# (!) 2% They shall come into force at once# De&i!itio!'%: (1) $n these rules unless the subject or conte%t otherwise re&uires#' (i) (b)'i!e'') means all wor* done by the Tehsil/Town Municipal Administration in pursuance of the pro+isions of the Punjab ,ocal -o+ernment .rdinance !""1 (/$$$ of !""1) and these rules0 (b2e:l ,') mean the bye'laws made by Tehsil/Town 1ouncil under section 12! of the Punjab ,ocal -o+ernment .rdinance !""1 (/$$$ of !""1)0 (# 'e) means a particular matter under consideration and includes all papers relatin3 to it and necessary to enable the matter to be disposed of +i4# correspondence and notes and also any pre+ious papers on the subject or subjects co+ered by it or connected therewith0 (Chie& O&&i#er) means the officer inchar3e of the establishments pro+idin3 municipal ser+ices in a former municipal corporation municipal committee or town committee area under the repealed Punjab ,ocal -o+ernment .rdinance 12520 (Chie& O&&i#er1' U!it or Co U!it ) means a defunct Tehsil/ Town 1ommittee or Municipal 1orporation established under the repealed Punjab ,ocal -o+ernment .rdinance 1252 whose administrati+e set up has been *ept intact under the pro+isions of the Punjab ,ocal -o+ernment .rdinance !""1 (/$$$ of !""1)0 (Co)!#il) means the Tehsil/Town 1ouncil of the Tehsil/Town concerned0 (De#e!tr li+e or ?De#e!tr li+e") means conferment by the -o+ernment under the Punjab ,ocal -o+ernment .rdinance# !""1 (/$$$ of !""1) of its administrati+e and financial authority for the mana3ement of specified offices of the Pro+incial -o+ernment to the local 3o+ernments0 (Di'tri#t .o/er!$e!t) means a district 3o+ernment consistin3 of 6ila 7a4im and 8istrict Administration as pro+ided in 9ection 1: of the Punjab ,ocal -o+ernment .rdinance !""1 (/$$$ of !""1) and includes (1ity 8istrict -o+ernment)0 (.o/er!$e!t) means the -o+ernment of the Punjab 1,-;R8 8epartment0 (Lo# l F)!") means a fund established under 9ection 1"5 of the Punjab ,ocal -o+ernment .rdinance !""1 (/$$$ of !""1)0 (Lo# l T 0) means a ta% le+ied by Tehsil/Town 1ouncil under section 11< of the Punjab ,ocal -o+ernment .rdinance0 !""1 (/$$$ of !""1)0 (Or"i! !#e) means the Punjab ,ocal -o+ernment .rdinance !""1 (/$$$ of !""1)0 (Pro/i!#i l Lo# l .o/er!$e!t Co$$i''io! ) means a 1ommission appointed by the -o+ernment under section 1:1 of the Punjab ,ocal -o+ernment .rdinance !""1 (/$$$ of !""1)0 (P)(li# re-re'e!t ti/e) means an elected person to a political office0 (Teh'il/To,! O&&i#e') mean offices mentioned in 9chedule'$ to these rules0 (Teh'il/To,! M)!i#i- l O&&i#er) means an .fficer inchar3e Tehsil/Town offices appointed under the Punjab ,ocal -o+ernment .rdinance !""1(/$$$ of !""1)0 and (%i%) (Teh'il/To,! N +i$) shall ha+e the same meanin3 as is assi3ned to it in 1hapter'? of the Punjab ,ocal -o+ernment .rdinance !""1 (/$$$ of !""1)#

(!) @ords and e%pressions used but not defined in these rules shall ha+e the same meanin3s as are assi3ned to them under the Punjab ,ocal -o+ernment .rdinance !""1 (/$$$ of !""1)# <% Allo# tio! o& B)'i!e''@: (1) The Tehsil/Town Municipal Administration shall consist of Tehsil/Town .ffices as well as such 1. Anits that are located within its jurisdiction# (!) The business of Tehsil/Town Municipal Administration shall be distributed amon3st Tehsil /Town .ffices in the manner indicated in 9chedule'$# Pro+ided that the functions assi3ned to the 1ity 8istrict -o+ernment throu3h notification by the -o+ernment shall stand deleted from the business allocated to the Town Municipal Administration fallin3 within the area of that 8istrict -o+ernment0 Pro+ided further that this distribution of business shall not apply to 1. Anits which shall continue pro+idin3 municipal ser+ices under the e%ecuti+e control of Tehsil/Town 7a4im throu3h the Tehsil/Town Municipal .fficer until any contrary order is made by the -o+ernment# (:) Anless +aried and notified by the -o+ernment the decentrali4ed offices in a Tehsil/Town shall continue performin3 their assi3ned functions and pro+ide ser+ices to the people within their area of jurisdiction as they were doin3 on the commencement day of the .rdinance# ;% Or* !i+ tio! o& Teh'il/To,! O&&i#e'@: (1) Bach Tehsil/Town .ffice shall consist of Tehsil/Town .fficers and such officials as the -o+ernment may determine# (!) The Tehsil/Town Municipal .fficer shall by means of a standin3 order and with the appro+al of the Tehsil/Town 7a4im distribute the wor* amon3 the officers branches and sections of each Tehsil .ffice# (:) The duty lists of all the officials in Tehsil/Town Municipal Administration shall be prepared and compiled in the form of a boo*let by Tehsil/Town Municipal .fficer for ready reference# A copy of the same shall be submitted to the Tehsil/Town 7a4im and other concerned officers# (>) The duty lists shall be re+iewed by the Tehsil/Town .fficer and the 1hief .fficer on yearly basis for identifyin3 redundant Cobs in the office concerned and issue re+ised lists if deemed necessary# The Tehsil/Town .fficer or the 1hief .fficer on the basis of the re+iew carried out under sub'rule (>) may recommend reduction of posts or otherwise in the annual bud3et of his office# (=) $f in the opinion of the Tehsil/Town .fficer or the 1hief .fficer new posts are re&uired in an office under his jurisdiction he shall submit a detailed justification for creation of such new posts alon3 with the bud3et proposal# (<) The Tehsil/Town Municipal .fficer shall super+ise the wor* assi3ned to the offices branches and sections of each Tehsil/Town .ffice as well as 1. Anits under his control# (5) $n the absence of the Tehsil/Town Municipal .fficer for any reason the Tehsil/Town 7a4im may assi3n the char3e of the post of the Tehsil/Town Municipal .fficer to any Tehsil/Town .fficer or 1hief .fficer of the Tehsil/Town Municipal AdministrationD Pro+ided that in the e+ent of absence of the Tehsil/Town Municipal .fficer due to his transfer the case for postin3 of a re3ular Tehsil/Town Municipal .fficer shall be initiated without any delay# E0-l ! tio!@ Eor the purpose of this rule the absence of Tehsil/Town Municipal .fficer means lea+e of the officer for more than 1" days or relin&uishment of his char3e of the post due to his transfer# (F) $n absence of the Tehsil/Town .fficer or the 1hief .fficer the Tehsil/Town 7a4im may in consultation with the Tehsil/Town Municipal .fficer assi3n the additional char3e of the

post of the Tehsil/Town .fficer or the 1hief .fficer to any other Tehsil/Town .fficer or the 1hief .fficer as the case may be# 9% F)!#tio!' !" Po,er' o& the Teh'il/To,! N +i$%: (1) The Tehsil/Town 7a4im shall' (a) be the head of Tehsil/Town Municipal Administration and shall perform such functions and e%ercise such powers as ha+e been assi3ned to him under the .rdinance and these rules0 be responsible for co'ordination of all policy matters0 ha+e the powers to call for any case or information from any Tehsil/Town .ffice0 *eep informed the 8istrict -o+ernment on matters related to local ta%ation0 furnish such information relatin3 to administration of affairs of Tehsil/Town as the -o+ernment and 8istrict -o+ernment may call for0 communicate to the -o+ernment all important issues includin3 administration de+elopment plannin3 and ta%ation0 and enforce the policies of the -o+ernment#

(!) 7o order shall be issued without the appro+al of the Tehsil/Town 7a4im in cases enumerated in 9chedule'$$# (:) The cases enumerated in 9chedule'$$$ shall be submitted to the Tehsil/Town 7a4im for his information# The Tehsil/Town 7a4im may re&uire any other case to be submitted to him for information# (>) 8ecisions ta*en by the Tehsil/Town 7a4im shall not be +aried re+ersed or infrin3ed without consultin3 him# (=) The Tehsil/Town 7a4im shall ensure that the business of the Tehsil/Town Municipal Administration is carried out in accordance with the pro+isions of the .rdinance and other laws for the time bein3 in force# (<) $n the case of Pro+incial -o+ernment employees the Tehsil/Town 7a4im shall in consultation with the -o+ernment initiate action in accordance with the pro+isions of the rele+ant Bfficiency and 8iscipline Rules a3ainst those officers and employees who ha+e been reported to be inefficient undisciplined or corrupt by a Monitorin3 1ommittee# A% F)!#tio!' !" Po,er' o& the Teh'il/To,! M)!i#i- l O&&i#er%: $n addition to the duties and functions assi3ned to him under any other pro+isions of the Punjab ,ocal -o+ernment .rdinance !""1 (/$$$ of !""1) and these rules the Tehsil/Town Municipal .fficer shall' (a) (b) (c) (d) be the Principal Accountin3 .fficer of the Tehsil/Town Municipal Administration and shall be the focal person in the Tehsil/Town Municipal Administration0 co'ordinate the acti+ities of all Tehsil/Town .ffices and shall be responsible for e%ecution of sanctioned policy relatin3 to the Tehsil/Town Municipal Administration0 ha+e the powers to call for any case or information from any Tehsil/Town .ffice0 where the Tehsil/Town 7a4imGs orders appear to in+ol+e a departure from rules re3ulations or -o+ernment policy !refer the case to the -o+ernment for decision B and in matters of policy and important decisions the Tehsil/Town Municipal .fficer shall obtain appro+al of the Tehsil/Town 7a4im before communicatin3 such matters and decisions to the -o+ernment#

C% D)tie' !" &)!#tio!' o& Teh'il/To,! O&&i#er'%: (1) A Tehsil/Town .fficer in addition to the pro+isions of the Punjab ,ocal -o+ernment .rdinance !""1 (/$$$ of !""1) shall' (a) assist the Tehsil/Town Municipal .fficer in formulation of policy and brin3 the cases to the notice of the Tehsil/Town Municipal .fficer which are re&uired to be submitted to the Tehsil/Town 7a4im under these rules0 duly e%ecute the sanctioned policy0 e%ercise 3eneral super+ision o+er pro3rammes projects ser+ices and acti+ities of the office under his control0

submit all proposals for ta%ation find the bye'laws to the Tehsil/Town 1ouncil throu3h the Tehsil/Town Municipal .fficer and Tehsil/Town 7a4im0 pro+ided the ta%ation proposals shall be scrutini4ed by the Tehsil/Town .fficer (Einance) before submission to Tehsil/Town Municipal .fficer and Tehsil/Town 7a4im0 be responsible to the Tehsil/Town Municipal .fficer for the proper conduct of the business of the Tehsil/Town .fficeD subject to any 3eneral or special order of -o+ernment in this behalf issue standin3 orders specifyin3 the cases or other classes of cases which may be disposed of by an officer subordinate to the Tehsil/Town .fficer0 and be responsible for the careful obser+ance of these rules in Tehsil/Town .ffices under his control#

(!) @hile submittin3 a case for the orders of the Tehsil/Town 7a4im or Tehsil/Town Municipal .fficer it shall be duty of the Telisil/Town .fficer to su33est a definite line of action# D% .e!er l -ro#e")re &or "i'-o' l o& ()'i!e''%: (1) $nstructions as to the manner of disposal of the business of the Tehsil/Town Administration shall be issued by the Tehsil/Town Municipal .fficer with the appro+al of Tehsil/Town 7a4im# (!) $f any doubt arises as to the Tehsil/Town .ffice to which a case properly pertains the matter shall be referred to the Tehsil/Town Municipal .fficer who with the appro+al of the Tehsil/Town 7a4im shall refer the case to the -o+ernment and the orders thus passed shall be final# (:) All orders shall be made in writin3# @here a +erbal order is made the officer recei+in3 the order shall reduce it in writin3 and as soon as may be show it to the authority ma*in3 the order# (>) $f any order contra+enes any law rule or policy decision it shall be the duty of the officer ne%t below the officer ma*in3 such order to point it out to the officer ma*in3 the order and the latter shall refer the case to the ne%t hi3her authority# (=) $f any doubt or dispute arises as to the interpretation of these rules the case shall be referred to the -o+ernment whose decision thereon shall be final# E% Or"er', I!'tr)$e!t', A*ree$e!t' !" Co!tr #t'%: (1) All e%ecuti+e actions of the Tehsil/Town Municipal Administration shall be e%pressed to be ta*en in the name of the Tehsil/Town Municipal Administration# (!) 9ubject to the pro+isions of the .rdinance and the rules framed thereunder e+ery order instrument a3reement or contract of the Tehsil/Town Municipal Administration shall be e%pressed to be made in the name of the Tehsil/Town Municipal Administration and shall be e%ecuted by the Tehsil/Town 7a4im or an officer duly authori4ed by him for this purpose# (:) The Tehsil/Town Municipal .fficer shall si3n the notifications on behalf of the Tehsil/Town Municipal Administration for publication in the official -a4ette PART B:OFFICE PROCEDURE =0% Co!')lt tio! $o!* o&&i#e'%: (1) @hen the subject of a case concerns office' (a) (b) more than one

the Tehsil/Town .fficer concerned or the 1hief .fficer shall be responsible for consultin3 the other offices0 and no orders shall be issued nor shall the case be submitted to the Tehsil/Town 7a4im until it has been considered by all the offices concernedD Pro+ided that in cases of ur3ency and with the appro+al of the Tehsil/Town 7a4im this re&uirement may be dispensed with but the case shall at the earliest opportunity thereafter be brou3ht to the notice of the other office concerned in writin3#

(!) @hen a case is referred by one office to another office for consultation all rele+ant facts and the points necessitatin3 the reference shall be clearly brou3ht out# (:) $n the e+ent of difference of opinion amon3st the offices the Tehsil/Town .fficer or the 1hief .fficer primarily concerned shall refer the case to the B%ecuti+e 1ommittee constituted under rule 1>#

(>) A Tehsil/Town .fficer or a 1hief .fficer may as* throu3h Tehsil/Town Municipal .fficer to see a case of another office if it is re&uired for the disposal of a case pendin3 in his office# (=) $n case a Tehsil/Town .fficer or a 1hief .fficer has submitted a case directly to the Tehsil/Town 7a4im for any co3ent reason the Tehsil/Town 7a4im shall after recordin3 his decision return the case throu3h the Tehsil/Town Municipal .fficer# $n case the Tehsil/Town Municipal .fficer considers that the proposal of the Tehsil/Town .fficer or the 1hief .fficer or the decision of the Tehsil/Town 7a4im is a3ainst the policy of the -o+ernment or is contrary to the laws or rules for the time bein3 in force :he shall refer the case to the -o+ernment for decision# (<) The Tehsil/Town Municipal .fficer may as* to see a case of any office in+ol+in3 important policy &uestion# ==% Re&ere!#e to the Teh'il/To,! N +i$%: (1) 7o order re3ardin3 Tehsil/Town Municipal Administration shall be issued without the appro+al of the Tehsil/Town 7a4im in cases in+ol+in3 important policy or departure from important policy or cases enumerated in 9chedule'llD E0-l ! tio!%: 8eparture from policy includes departure from a pre+ious decision of the Tehsil/Town 7a4im# (!) The Tehsil/Town 7a4im may re&uire any case to be submitted to him for information# =2% Co!')lt tio! ,ith Teh'il/To,! Fi! !#e O&&i#e%: (1) 7o Tehsil/Town .ffice shall without pre+ious consultation with the Tehsil/Town Einance .ffice authori4e any order which in particular in+ol+esD (a) (b) (c) (d) (e) relin&uishment remission or assi3nment of re+enue relatin3 to local funds actual or potential or furnish a 3uarantee a3ainst it or 3rant of all *ind of leases0 e%penditure for which no pro+ision e%ists0 le+y of ta%es duties fee or cases listed in Part $$ of 9econd 9chedule of the Punjab ,ocal -o+ernment .rdinance !""1# re'appropriations within bud3et 3rants0 and interpretation of bye'laws made by the Einance .ffice#

(!) 7o proposal which re&uires pre+ious consultation with the Einance .ffice under sub'rule (1) and to which the Einance .ffice has not concurred shall be proceeded with unless a decision to that effect lies been ta*en by the Tehsil/Town 1ouncil# Eormal orders shall only be issued after the Einance .ffice has e%ercised scrutiny o+er the details of the proposal# =<% Le* l A"/i#e%: The Tehsil/Town Municipal .fficer shall consult the Tehsil/Town 7a4im re3ardin3 cases/matters re&uirin3 le3al ad+ice# =;% E0e#)ti/e Co$$ittee%: (1) The Tehsil/Town 7a4im shall constitute an B%ecuti+e 1ommittee with the Tehsil/Town Municipal .fficer as its 1hairman and all Tehsil/Town .fficers and 1hief .fficers its members to deal with all matters concernin3 two or more offices all matters of administrati+e financial or public policy to facilitate coordination amon3 the offices of the Tehsil/Town Municipal Administration to pro+ide a+enue for the consideration of matters of common interest and to tender ad+ice in any case that may be referred to the Tehsil/Town 1ouncil or the Tehsil/Town 7a4im# (!) A Tehsil/Town .fficer or a 1hief .fficer who wishes a particular matter to be discussed in the B%ecuti+e 1ommittee meetin3 shall apprise the Tehsil/Town Municipal .fficer of his intention of doin3 so and forward ten copies of a brief note on the subject which would form the basis of discussion# (:) The Tehsil/Town Municipal .fficer shall issue notice of the meetin3 to3ether with the a3enda well in ad+ance of the meetin3 pro+ided that ur3ent items may be considered at short notice# (>) Minutes of the meetin3 shall be recorded by an officer nominated by the Tehsil/Town Municipal .fficer who shall attend the meetin3 for the purpose and circulate such minutes after appro+al by the Tehsil/Town Municipal .fficer#

(=) $n the e+ent of a difference of opinion on any issue amon3st the members of the B%ecuti+e 1ommittee the case shall be submitted to the Tehsil/Town 7a4im throu3h the Tehsil /Town Municipal .fficer# =9% M !!er o& ')($i''io! o& # 'e'%: (1) @hen a case is re&uired to be submitted to the Tehsil/Town Municipal .fficer it shall be the responsibility of the Tehsil/Town .fficer or the 1hief .fficer concerned to ensure that all rele+ant papers references and e%tracts of the laws and rules are submitted alon3 with the case for &uic* disposal# (!) $n his note the Tehsil/Town .fficer or the 1hief .fficer concerned shall certify that all the rele+ant papers re&uired for the disposal of the case ha+e been submitted# (:) All files and records shall be *ept and maintained by the Tehsil .ffice or 1hief .fficer unit concerned in the prescribed manner# (>) Any officer who notices that tamperin3 of records has been made by his staff or collea3ue he shall brin3 it to the notice of the Tehsil/Town Municipal .fficer for an appropriate action a3ainst the accused# (=) 7o pa3e of the file either of the note portion or of the correspondence portion shall be remo+ed# (<) All notes shall be temperately written and shall be free from personal remar*s# (5) Proper decorum shall be obser+ed in commentin3 upon the notes recorded by the senior officers and where an error is to be pointed out and an opinion is to be critici4ed it shall be done in a respectful lan3ua3e# (F) $f a note has been written in the note portion erroneously it shall be crossed out and a new note shall be written# =A% Meeti!*'%: (1) The Tehsil/Town .fficer and the 1hief .fficer shall endea+or to con+ene meetin3s of all the officers under his control once in a month to discuss' (i) (ii) (iii) important pendin3 cases0 specific problems callin3 for 3eneral e%pression of +iews or e%chan3e of ideas0 and &uestions of 3eneral interests concernin3 the Tehsil/Town .ffice or the 1hief .fficer unit as the case may be#

(!)
