Sectio& 1. Title. - This Act shall be known as (T)e Vote*+, Re-i,t*.tio& Act o/ 199'.(
Sec. 0. Decl.*.tio& o/ Polic1. - It is the policy of the State to systematize the present method of registration in order to
establish a clean, complete, permanent and updated list of oters!
Sec. 2. De/i&itio& o/ Te*3,. - As used in this Act:
a! Re-i,t*.tio& refers to the act of accomplishing and filing of a sworn application for registration by a "ualified oter
before the election officer of the city or municipality wherein he resides and including the same in the book of registered
oters upon approal by the #lection $egistration %oard&
b! Re-i,t*.tio& Reco*4 refers to an application for registration duly approed by the #lection $egistration %oard&
c! "oo5 o/ Vote*, refers to the compilation of all registration records in a precinct&
d! Li,t o/ Vote*, refers to an enumeration of names of registered oters in a precinct duly certified by the #lection
$egistration %oard for use in the election&
e! Illite*.te o* Di,.ble4 pe*,o& refers to one who cannot by himself prepare an application for registration because of
his physical disability and'or inability to read and write&
f! o33i,,io& refers to the (ommission on #lections )(*+#,#(-&
g! Electio& Re-i,t*.tio& "o.*4 refers to the body constituted herein to act on all applications for registration&
h! Vote*+, I4e&ti/ic.tio& Nu3be* ).I/- refers to the number assigned by the (ommission on #lections to a registered
oter that shall consist of three )0- parts:
1! The current address )city'municipality and proince-&
2! the current precinct assignment of the oter& and
0! the permanent birth and name code uni"ue to eery oter&
i! Politic.l P.*tie, refer to local, regional or national political parties e3isting and duly registered and accredited by
the (ommission&
4! P*eci&ct refers to the basic unit of territory established by the (ommission for the purpose of oting&
k! P*eci&ct M.p, refers to a sketch or drawing of a geographical area stated in terms of streets or street blocks or
sitios the residents of which would belong to a particular precinct&
l! Polli&- pl.ce refers to the place where the %oard of #lection Inspectors conducts its proceeding and where the
oters cast their otes&
m! Voti&- ce&te* refers to the building or place where the polling place is located&
n! Electio& O//ice* refers to the highest official or authorized representatie of the (ommission in a city or
municipality& and
o! "o.*4 o/ Electio& I&,pecto*, refers to the body which conducts the election in the polling place of the precinct
usually composed of three )0- public school teachers appointed by the (ommission!
Sec. 6. Pe*3.&e&t Li,t o/ Vote*, - There shall be a permanent list of oters per precinct in each city or municipality
consisting of all registered oters residing within the territorial 4urisdiction of eery precinct indicated by the precinct maps!
Such precinct-leel list of oters shall be accompanied by an addition'deletion list for the purpose of updating the list!
5or the purpose of the 1667 general registration, the (ommission shall cause the preparation and posting of all precinct
maps in eery barangay nationwide! 5ie days before the 1667 general registration, indiidual precinct maps shall be posted
at the door of each polling place! Subse"uently, the #lection *fficer shall be responsible for the display, throughout the year,
of precinct maps in his office and in the bulletin board of the city or municipal hall!
The precinct assignment of a oter in the permanent list of oters shall not be changed or altered or transferred to another
precinct without the e3press written consent of the oter: 8roided, howeer, That the oter shall not unreasonably withhold
such consent! Any iolation thereof shall constitute an election offense which shall be punished in accordance with law!
Sec. 7. P*eci&ct, .&4 t)ei* E,t.bli,)3e&t. - In preparation for the general registration in 1667, the (ommission shall draw
updated maps of all the precincts nationwide! 9pon completion of the new precinct maps, all the precincts established in the
preceding elections shall be deemed abolished! 5or the purpose of the general registration, the (ommission shall create
original precincts only! Spin-off precinct may be created after the regular elections of 166: to accommodate additional oters
residing within the territorial 4urisdiction of the original precincts!
The (ommission shall introduce a permanent numbering of all precincts which shall be indicated by Arabic numerals and a
letter of the #nglish alphabet! *riginal or mother precincts shall be indicated by the Arabic numeral and letter ;A of the
#nglish alphabet! Spin-off or daughter precincts shall be indicated by the Arabic numeral and letter of the #nglish alphabet
starting with letter % and so on!
/o territory comprising an election precinct shall be altered or a new precinct be established at the start of the election
period!
Splitting of an original precinct or merger of two or more original precincts shall not be allowed without redrawing the precinct
map's one hundred twenty )12<- days before election day!
Sec. '. A**.&-e3e&t o/ P*eci&ct,. - #ery barangay shall hae at least one )1- precinct! #ach precinct, shall hae no more
than two hundred )2<<- oters and shall comprise contiguous and compact territories!
a! A precinct shall be allowed to hae less than 2<< registered oters under the following conditions:
1! As soon as the 2<<-limit for eery precinct has been reached, a spin-off or daughter precinct shall be
created automatically by the (ommission to accommodate oters residing within the territorial 4urisdiction of the original
precinct! Thereafter, a separate list of new oters shall be prepared by the #lection *fficer& and
2! An island or group of islands with less than two hundred )2<<- oters may comprise one )1- original
precinct!
b! #ery case of alteration of precincts shall be duly announced by posting a notice thereof in a conspicuous place in
the precinct, in the office of the election officer and in the city or municipal hall and by proiding political parties and
candidates a list of all the precincts at the start of the campaign period& and
c! (onsolidation or merger of at most three )0- precincts may be allowed: 8roided, That the computerized counting
shall be implemented: 8roided, further, That the merger of such precincts shall be effected ninety )6<- days before election
day!
Sec. 8. Ge&e*.l Re-i,t*.tio& o/ Vote*,. - Immediately after the barangay elections in 1667, the e3isting certified list of
oters shall cease to be effectie and operatie! 5or purposed of the +ay 166: elections and all elections, plebiscites,
referenda, initiaties, and recalls subse"uent thereto, the (ommission shall undertake a general registration of oters before
the %oard of #lection Inspectors on =une 1>, 1?, 21, and 22 and, sub4ect to the discretion of the (ommission, on =une 2: and
26, 1667 in accordance with this Act!
Sec. 8. S1,te3 o/ o&ti&ui&- Re-i,t*.tio& o/ Vote*,. - The personal filing of application of registration of oters shall be
conducted daily in the office of the #lection *fficer during regular office hours! /o registration shall, howeer, be conducted
during the period starting one hundred twenty )12<- days before a regular election and ninety )6<- days before a special
election!
Sec. 9. 9)o 3.1 Re-i,te*. - All citizens of the 8hilippines not otherwise dis"ualified by law who are at least eighteen )1:-
years of age, and who shall hae resided in the 8hilippines for at least one )1- year, and in the place wherein they propose to
ote, for at least si3 )@- months immediately preceding the election, may register as a oter!
Any person who temporarily resides in another city, municipality or country solely by reason of his occupation, profession,
employment in priate or public serice, educational actiities, work in the military or naal reserations within the 8hilippines,
serice in the Armed 5orces of the 8hilippines, the /ational 8olice 5orces, or confinement or detention in goernment
institutions in accordance with law, shall not be deemed to hae lost his original residence!
Any person, who, on the day of registration may not hae reached the re"uired age or period of residence but, who, on the
day of the election shall possess such "ualifications, may register as a oter!
Sec. 1:. Re-i,t*.tio& o/ Vote*,. - A "ualified oter shall be registered in the permanent list of oters in a precinct of the city
or municipality wherein he resides to be able to ote in any election! To register as a oter, he shall personally accomplish an
application form for registration as prescribed by the (ommission in three )0- copies before the #lection *fficer on any date
during office hours after haing ac"uired the "ualifications of a oter!
The application shall contain the following data:
a! /ame, surname, middle name, and'or maternal surname&
b! Se3&
c! Date, and place of birth&
d! (itizenship&
e! (iil status, if married, name of spouse&
f! 8rofession, occupation or work
g! 8eriods of residence in the 8hilippines and in the place of registration&
h! #3act address with the name of the street and house number for location in the precinct maps maintained by the
local office of the (ommission, or in case there is none, a brief description of his residence, sitio, and barangay&
i! A statement that the applicant possesses all the "ualifications of a oter&
4! A statement that the applicant is not a registered oter of any precinct& and
k! Such information or data as may be re"uired by the (ommission!
The application for registration shall contain three )0- specimen signatures of the applicant, clear and legible rolled prints of
his left and right thumbprints, with four )>- identification size copies of his latest photograph, attached thereto, to be taken at
the e3pense of the (ommission!
%efore the applicant accomplishes his application for registration, the #lection *fficer shall inform him of the "ualifications
and dis"ualifications prescribed by law for a oter, and thereafter, see to it that the accomplished application contains all the
data therein re"uired and that the applicantAs specimen signatures, fingerprints, and photographs are properly affi3ed in all
copies of the oterAs application!
Sec. 11. Di,;u.li/ic.tio&. - The following shall be dis"ualified from registering:
a! Any person who has been sentenced by final 4udgment to suffer imprisonment of not less than one )1- year, such
disability not haing been remoed by plenary pardon or amnesty: 8roided, howeer, That any person dis"ualified to ote
under this paragraph shall automatically reac"uire the right to ote upon e3piration of fie )?- years after serice of sentence&
b! Any person who has been ad4udged by final 4udgment by a competent court or tribunal of haing committed any
crime inoling disloyalty to the duly constituted goernment such as rebellion, sedition, iolation of the firearms laws or any
crime against national security, unless restored to his full ciil and political rights in accordance with law: 8roided, That he
shall automatically reac"uire the right to ote upon e3piration of fie )?- years after serice of sentence& and
c! Insane or incompetent persons declared as such by competent authority unless subse"uently declared by proper
authority that such person is no longer insane or incompetent!
Sec. 10. ).&-e o/ Re,i4e&ce to A&ot)e* it1 o* Mu&icip.lit1. - Any registered oter who has transferred residence to
another city or municipality may apply with the #lection *fficer of his new residence for the transfer of his registration
records!
The application for transfer of registration shall be sub4ect to the re"uirements of notice and hearing and the approal of the
#lection $egistration %oard, in accordance with this Act! 9pon approal of the application for transfer, and after notice of such
approal to the #lection *fficer of the former residence of the oter, said #lection *fficer shall transmit by registered mail the
oterAs registration record to the #lection *fficer of the oterAs new residence!
Sec. 12. ).&-e o/ A44*e,, i& t)e S.3e it1 o* Mu&icip.lit1. - Any oter who has changed his address in the same city
or municipality shall immediately notify the #lection *fficer in writing! If the change of address inoles a change in precinct,
the %oard shall transfer his registration record to the precinct book of oters of his new precinct and notify the oter of his
new precinct All changes of address shall be reported to the office of the proincial election superisor and the (ommission
in +anila!
Sec. 16. Illite*.te o* Di,.ble4 Applic.&t,. - Any illiterate person may register with the assistance of the #lection *fficer or
any member of an accredited citizenAs arms! The #lection *fficer shall place such illiterate person under oath, ask him the
"uestions, and record the answers gien in order to accomplish the application form in the presence of the ma4ority of the
members of the %oard! The #lection *fficer or any member of an accredited citizenAs arm shall read the accomplished form
aloud to the person assisted and ask him if the information gien is true and correct The accomplished form shall be
subscribed by the applicant in the presence of the %oard by means of thumbmark or some other customary mark and it shall
be subscribed and attested by the ma4ority of the members of the %oard!
The attestation shall state the name of the person assisted, the name of the #lection *fficer or the member of the accredited
citizenAs arm who assisted the applicant, the fact that the #lection *fficer placed the applicant under oath, that the #lection
*fficer or the member of the accredited citizenAs arm who assisted the applicant read the accomplished form to the person
assisted, and that the person assisted affirmed its truth and accuracy, by placing his thumbmark or some other customary
mark on the application in the presence of the %oard!
The application for registration of a physically disabled person may be prepared by any relatie within the fourth ciil degree
of consanguinity or affinity or by the #lection *fficer or any member of an accredited citizenAs arm using the data supplied by
the applicant! The fact of illiteracy or disability shall be so indicated in the application!
Sec. 17. Electio& Re-i,t*.tio& "o.*4. - There shall be in each city and municipality as many as #lection $egistration
%oards as there are election officers therein! In thickly populated cities'municipalities, the (ommission may appoint additional
election officers for such duration as may be necessary!
The %oard shall be composed of the #lection *fficer as chairman and as members, the public school official most senior in
rank and the local ciil registrar, or in this absence, the city or municipal treasurer! In case of dis"ualification of the #lection
*fficer, the (ommission shall designate an acting #lection *fficer who shall sere as (hairman of the #lection $egistration
%oard! In case of dis"ualification or non-aailability of the ,ocal $egistrar or the +unicipal Treasurer, the (ommission shall
designate any other appointie ciil serice official from the same locality as substitute!
/o member of the %oard shall be related to each other or to any incumbent city or municipal electie official within the fourth
ciil degree of consanguinity or affinity! If in succeeding elections, any of the newly elected city or municipal officials is related
to a member of the board within the fourth ciil degree of consanguinity or affinity, such member is automatically dis"ualified
to presere the integrity of the #lection $egistration %oard!
#ery registered party and such organizations as may be authorized by the (ommission shall be entitled to a watcher in
eery registration board!
Sec. 1'. o3pe&,.tio& o/ t)e Me3be*, o/ t)e "o.*4. - #ach member of the %oard shall be entitled to an honorarium to
Two Bundred 8esos )82<<!<<- for each day of actual serice rendered in the %oard, which amount the (ommission may
ad4ust eery three )0- years thereafter! /o member of the %oard shall be entitled to traelling e3penses!
Sec. 18. Notice .&4 #e.*i&- o/ Applic.tio&,. - 9pon receipt of applications for registration, the #lection *fficer shall set
them for hearing, notice of which shall be posted in the city or municipal bulletin board and in his office for at least one )1-
week before the hearing, and furnish copies thereof to the applicant concerned, the heads or representaties of political
parties, and other accredited groups or organizations which actiely participate in the electoral process in the city or
municipality! *n the date of the hearing, the #lection *fficer shall receie such eidence for or against the applicant!
A registrant whose application is not seasonably ob4ected to shall be notified in writing stating therein that no ob4ection was
raised against his application and that he need not appear on the date set for the hearing of his application! 8hysical
presence of the applicant concerned shall, howeer, be mandatory in all cases where ob4ections against his application hae
been seasonably filed with the proper #lection $egistration %oard for him to rebut or refute eidence presented in opposition
thereto!
All applications for registration shall be heard and processed on a "uarterly basis! 5or this purpose, the #lection $egistration
%oard shall meet and conene on the third +onday of April, =uly, *ctober, and =anuary of eery calendar year, or on the ne3t
following working day if the designated days fail on a non-working holiday, e3cept in an election year to conform with the one
hundred twenty )12<- days prohibitie period before election day! Should one day be sufficient for the processing of all
accepted applications, the %oard shall ad4ourn from day to day until all the applications shall hae been processed!
Sec. 18. ).lle&-e, to Ri-)t to Re-i,te*. - Any oter, candidate or representatie of a registered political party may
challenge in writing any application for registration, stating the grounds therefor! The challenge shall be under oath and be
attached to the application, together with the proof of notice of hearing to the challenger and the applicant!
*ppositions to contest a registrantAs application for inclusion in the oterAs list must, in all cases, be filed not later than the
second +onday of the month in which the same is scheduled to be heard or processed by the #lection $egistration %oard!
Should the second +onday of the month fall on a non-working holiday, oppositions may be filed on the ne3t following working
day! The hearing on the challenge shall be heard on the third +onday of the month and the decision shall be rendered before
the end of the month!
Sec. 19. Po<e* to A43i&i,te* O.t) .&4 I,,ue Su33o&,. - 5or purposes of determining the right of the applicants to be
registered as a oter, the #lection *fficer shall hae the power to administer oath, issue subpoena duces tecum and swear in
witnesses! The fees and e3penses incidental thereto shall be paid in adance by the party in whose behalf the summons is
issued!
Sec. 0:. App*o=.l .&4 Di,.pp*o=.l o/ Applic.tio&. - The #lection *fficer shall submit to the %oard all applications for
registration filed, together with the eidence receied in connection therewith! The %oard shall, by ma4ority ote, approe or
disapproe the applications!
9pon approal, the #lection *fficer shall assign a oters identification number and issue the corresponding identification card
to the registered oter! If the %oard disapproes the application, the applicant shall be furnished with a certificate of
disapproal stating the ground therefor! In cases of approal or disapproal, any aggrieed party may file a petition for
e3clusion or inclusion, as the case may be, with the proper +unicipal or +etropolitan Trial (ourt as proided for in this Act!
Sec. 01. Public.tio& o/ Actio& o& Applic.tio& /o* Re-i,t*.tio&. - Cithin fie )?- days from approal or disapproal of
application, the %oard shall post a notice in the bulletin board of the city or municipal hall and in the office of the #lection
*fficer, stating the name and address of the applicant, the date of the application, and the action taken thereon! The #lection
*fficer shall furnish a copy of such notice personally, or by registered mail or special deliery to the applicant and heads or
representaties of registered political parties in the city or municipality!
Sec. 00. P*e,e*=.tio& o/ Vote*+, Re-i,t*.tio& Reco*4,. - The #lection *fficer shall compile the original copies of the
approed applications for registration per precinct and arrange the same alphabetically according to surname! Be shall
presere the book of oters and ensure its integrity! The second and third copies of the registration records shall be sent to
the proincial and national central files within three )0- days after the approal of the %oard!
Sec. 02. P*o=i&ci.l File. - There shall be a proincial file consisting of the duplicate copies of all registration records in each
precinct of eery city and municipality in the proince! It shall be in the custody of the 8roincial #lection Superisor and shall
be compiled and arranged by precinct, by municipality and alphabetically by surnames of oters!
Should the book of oters in the custody of the #lection *fficer be lost or destroyed at a time so close to election day that
there is no time to reconstitute the same, the corresponding book of oters in the proincial file shall be used during the
oting!
Sec. 06. N.tio&.l e&t*.l File. - There shall be a national central file under the custody of the (ommission in +anila
consisting of the third copies of all approed oter registration records in each city or municipality! It shall be compiled by
precinct in each city'municipality and arranged alphabetically by surname so as to make the file a replica of the book of
oters in the possession of the #lection *fficer! Thereafter a national list shall be prepared following the alphabetical
arrangements of surnames of oters!
There shall be a national file consisting of the computerized otersA list )(.,-, both in print and in diskette, submitted by the
#lection *fficers in each city and municipality concerned, under the custody of the (ommission in +anila!
The computerized otersA list shall make use of a single and uniform computer program that will hae a detailed sorting
capability to list oters alphabetically by the precincts where they ote, by the barangays, municipalities, cities or proinces
where they reside and by their oters identification number ).I/-!
Sec. 07. Vote*+, I4e&ti/ic.tio& .*4. - The oters identification card issued to the registered oter shall sere as a document
for his identification! In case of loss or destruction, no copy thereof may be issued e3cept to the registered oter himself and
only upon the authority of the (ommission!
The (ommission shall adopt a design for the oterAs identification card which shall be, as much as possible, tamper proof! It
shall proide the following: the name and address of the oter, his date of birth, se3, photograph, thumbmark, and the
number of precinct where he is registered, the signature of the oter and the chairman of the #lection $egistration %oard and
the oterAs identification number ).I/-!
Sec. 0'. Vote*+, I4e&ti/ic.tio& Nu3be* >VIN?. - The (ommission shall assign eery registered oter a oterAs identification
number ).1/- consisting of three parts, each separated by a dash! 5or e3ample: 7?<1-<<161-(1>?%(D!
a! 8art 1: (urrent Address of the .oter
1! The first two digits 7? stand for the proince& and
2! The last two digits, <1, stand for the city, municipality, or a district, particularly in +anila!
The code assignment for proinces, cities and municipalities shall follow the 9rban (ode deised by the /ational (ensus
and Statistics *ffice )/(S*-!
b! 8art II: (urrent 8recinct Assignment of the .oter
1! The first four digits, <<16, stand for the permanent number of the precinct where the oter is currently
assigned: and
2! The letter indicates whether it is a mother or a daughter precinct!
The number assigned to the precinct in eery city or municipality shall be permanent but the oter may transfer his precinct
number! The .I/ reflects the current precinct assignment of the oter!
c! 8art III: 8ermanent %irth and /ame (ode 9ni"ue to the .oter
1! The letter, (, stands for the month, i!e!, A for =anuary, % for 5ebruary, and so forth&
2! The ne3t two digits, 1>, stand for the date of birth&
0! The ne3t two digits, ?1, stand for the year of birth& and
>! The last three letters, %(D, stand for the name code, i!e!, %ayani (ruz Daide!
The last three letters shall stand for the first letter of the first name, the middle name, and the last name in that order!
The (ommission shall ensure that 8art III hereof of the oterAs identification number ).I/- shall be permanent and uni"ue to
each oter! If necessary, the (ommission may e3pand and modify the same!
d! The combined birth and name code is assigned during the lifetime of eery oter! 9pon transfer of the oter to
another precinct, the first two parts of the .I/ shall change!
Sec. 08. De.cti=.tio& o/ Re-i,t*.tio&. - The board shall deactiate the registration and remoe the registration records of
the following persons from the corresponding precinct book of oters and place the same, properly marked and dated in
indelible ink, in the inactie file after entering the cause or causes of deactiation:
a! Any person who has been sentenced by final 4udgment to suffer imprisonment for not less than one )1- year, such
disability not haing been remoed by plenary pardon or amnesty: 8roided, howeer, That any person dis"ualified to ote
under this paragraph shall automatically reac"uire the right to ote upon e3piration of fie )?- years after serice of sentence
as certified by the clerks of courts of the +unicipal'+unicipal (ircuit'+etropolitan'$egional Trial (ourts and the
Sandiganbayan&
b! Any person who has been ad4udged by final 4udgment by a competent court or tribunal of haing caused'committed
any crime inoling disloyalty to the duly constituted goernment such as rebellion, sedition, iolation of the anti-subersion
and firearms laws, or any crime against national security, unless restored to his full ciil and political rights in accordance with
law& 8roided, That he shall regain his right to ote automatically upon e3piration of fie )?- years after serice of sentence&
c! Any person declared by competent authority to be insane or incompetent unless such dis"ualification has been
subse"uently remoed by a declaration of a proper authority that such person is no longer insane or incompetent&
d! Any person who did not ote in the two )2- successie preceding regular elections as shown by their oting records!
5or this purpose, regular elections do not include the Sangguniang Dabataan )SD- elections&
e! Any person whose registration has been ordered e3cluded by the (ourt& and
f! Any person who has lost his 5ilipino citizenship!
5or this purpose, the clerks of court for the +unicipal'+unicipal (ircuit'+etropolitan'$egional Trial (ourts and the
Sandiganbayan shall furnish the #lection *fficer of the city or municipality concerned at the end of each month a certified list
of persons who are dis"ualified under paragraph )a- hereof, with their addresses! The (ommission may re"uest a certified
list of persons who hae lost their 5ilipino (itizenship or declared as insane or incompetent with their addresses from other
goernment agencies!
The #lection *fficer shall post in the bulletin board of his office a certified list of those persons whose registration were
deactiated and the reasons therefor, and furnish copies thereof to the local heads of political parties, the national central file,
proincial file, and the oter concerned!
Sec. 08. Re.cti=.tio& o/ Re-i,t*.tio&. - Any oter whose registration has been deactiated pursuant to the preceding
Section may file with the #lection *fficer a sworn application for reactiation of his registration in the form of an affidait
stating that the grounds for the deactiation no longer e3ist any time but not later than one hundred twenty )12<- days before
a regular election and ninety )6<- days before a special election!
The #lection *fficer shall submit said application to the #lection $egistration %oard for appropriate action!
In case the application is approed, the #lection *fficer shall retriee the registration record from the inactie file and include
the same in the corresponding precinct book of oters! ,ocal heads or representaties of political parties shall be properly
notified on approed applications!
Sec. 09. .&cell.tio& o/ Re-i,t*.tio&. - The %oard shall cancel the registration records of those who hae died as certified
by the ,ocal (iil $egistrar! The ,ocal (iil $egistrar shall submit each month a certified list of persons who died during the
preious month to the #lection *fficer of the place where the deceased are registered! In the absence of information
concerning the place where the deceased is registered, the list shall be sent to the #lection *fficer of the city or municipality

this list to the national central file and the proper proincial file!
The #lection *fficer shall post in the bulletin board of his office a list of those persons who died whose registrations were
cancelled, and furnish copies thereof to the local heads of the political parties, the national central file, and the proincial file!
Sec. 2:. P*ep.*.tio& .&4 Po,ti&- o/ t)e e*ti/ie4 Li,t o/ Vote*,. - The %oard shall prepare and post certified list of oters
ninety )6<- days before a regular election and si3ty )@<- days before a special election and furnish copies thereof to the
proincial, regional and national central files! (opies of the certified list, along with a certified list of deactiated oters
categorized by precinct per barangay, within the same period shall likewise be posted in the office of the #lection *fficer and
in the bulletin board of each city'municipal hall! 9pon payment of the fees as fi3ed by the (ommission, the candidates and
heads of registered political parties shall also be furnished copies thereof!
The %oard shall also furnish two )2- certified copies for said certified list of oters, along with a certified list of deactiated
oters to the %oard of #lection Inspectors for posting in the polling place and for their reference on election day!
Sec. 21. Se.li&- o/ P*eci&ct "oo5 o/ Vote*,. - The %oard shall notify within fifteen )1?- days before the start of the
campaign period of all registered political parties and members of the %oard of #lection Inspectors to inspect and erify the
completeness of the oterAs registration records for each precinct compiled in the book of oters!
After erification and certification by the %oard of #lection Inspectors and party representaties as to the completeness of the
otersA registration records in the precinct book of oters, the %oard shall seal the book of oters in the presence of the
former at the start of the campaign period and take custody of the same until their distribution to the %oard of #lection
Inspectors on election day! The #lection *fficer shall delier the sealed precinct book of oters to the chairman of the %oard
of #lection Inspectors when the latter secures its official ballots and other paraphernalia for election day!
Sec. 20. o33o& Rule, Go=e*&i&- %u4ici.l P*ocee4i&-, i& t)e M.tte* o/ I&clu,io&, E@clu,io&, .&4 o**ectio& o/
N.3e, o/ Vote*,. -
a! 8etition for inclusion, e3clusion or correction of names of oters shall be filed during office hours&
b! /otice of the place, date and time of the hearing of the petition shall be sered upon the members of the %oard and
the challenged oter upon filing of the petition! Serice of such notice may be made by sending a copy thereof by personal
deliery, by leaing it in the possession of a person of sufficient discretion in the residence of the challenged oter, or by
registered mail! Should the foregoing procedures not be practicable, the notice shall be posted in the bulletin board of the city
or municipal hall and in two )2- other conspicuous places within the city or municipality&
c! A petition shall refer only to one )1- precinct and implead the %oard as respondents&
d! /o costs shall be assessed against any party in these proceedings! Boweer, if the court should find that the
application has been filed solely to harass the aderse party and cause him to incur e3penses, it shall order the culpable
party to pay the costs and incidental e3penses&
e! Any oter, candidate or political party who may be affected by the proceedings may interene and present his
eidence&
f! The decision shall be based on the eidence presented and in no case rendered upon a stipulation of facts! If the
"uestion is whether or not the oter is real or fictitious, his non-appearance on the day set for hearing shall be prima facie
eidence that the challenged oter is fictitious& and
g! The petition shall be heard and decided within ten )1<- days from the date of its filing! (ases appealed to the
$egional Trial (ourt shall be decided within ten )1<- days from receipt of the appeal! In all cases, the court shall decide these
petitions not later than fifteen )1?- days before the election and the decision shall become final and e3ecutory!
Sec. 22. %u*i,4ictio& i& I&clu,io& .&4 E@clu,io& .,e. The +unicipal and +etropolitan Trial (ourts shall hae original and
e3clusie 4urisdiction oer all cases of inclusion and e3clusion of oters in their respectie cities or municipalities! Decisions
of the +unicipal or +etropolitan Trial (ourts may be appealed by the aggrieed party to the $egional Trial (ourt within fie
)?- days from receipt of notice thereof! *therwise, said decision shall become final and e3ecutory! The regional trial court
shall decide the appeal within ten )1<- days from the time it is receied and the decision shall immediately become final and
e3ecutory! /o motion for reconsideration shall be entertained!
Sec. 26. Petitio& /o* I&clu,io& o/ Vote*, i& t)e Li,t. - Any person whose application for registration has been disapproed
by the %oard or whose name has been stricken out from the list may file with the court a petition to include his name in the
permanent list of oters in his precinct at any time e3cept one hundred fie )1<?- days prior to a regular election or seenty-
fie )7?- days prior to a special election! It shall be supported by a certificate of disapproal of his application and proof of
serice of notice of his petition upon the %oard! The petition shall be decided within fifteen )1?- days after its filing!
If the decision is for the inclusion of oters in the permanent list of oters, the %oard shall place the application for registration
preiously disapproed in the corresponding book of oters and indicate in the application for registration the date of the
order of inclusion and the court which issued the same!
Sec. 27. Petitio& /o* E@clu,io& o/ Vote*, /*o3 t)e Li,t. - Any registered oters, representatie of a political party or the
#lection *fficer, may file with the court a sworn petition for the e3clusion of a oter from the permanent list of oters giing
the name, address and the precinct of the challenged oter at any time e3cept one hundred )1<<- days prior to a regular
election or si3ty-fie )@?- days before a special election! The petition shall be accompanied by proof of notice to the %oard
and to the challenged oter and shall be decided within ten )1<- days from its filing!
If the decision is for the e3clusion of the oter from the list, the %oard shall, upon receipt of the final decision, remoe the
oterAs registration record from the corresponding book of oters, enter the order of e3clusion therein, and thereafter place
the record in the inactie file!
Sec. 2'. Ve*i/ic.tio& o/ Re-i,te*e4 Vote*,. - The #lection officer shall, in order to presere the integrity of the permanent
list of oters, file e3clusion proceedings when necessary, and erify the list of the registered oters of any precinct by regular
mail or house to house canass!
The (ommission may enlist the help of representaties of political parties and deputize non-goernment organizations
)/E*s-, ciic organizations and barangay officials to assist in the erification and house to house canass of registered
oters in eery precinct!
Sec. 28. Vote* E@clu4e4 T)*ou-) I&.4=e*te&ce o* Re-i,te*e4 <it) .& E**o&eou, o* Mi,,pelle4 N.3e. - Any registered
oter who has not been included in the precinct certified list of oters or who has been included therein with a wrong or
misspelled name may file with the %oard an application for reinstatement or correction of name! If it is denied or not acted
upon, he may file on any date with the proper +unicipal (ircuit, +unicipal or +etropolitan Trial (ourt a petition for an order
directing that his name be entered or corrected in the list! Be shall attach to the petition a certified copy of his registration
record or identification card or the entry of his name in the certified list of oters used in the preceding election, together with
the proof that his application was denied or not acted upon by the %oard and that he has sered notice to the %oard!
Sec. 28. Vote*, E@clu4e4 T)*ou-) I&.4=e*te&ce o* Re-i,te*e4 <it) .& E**o&eou, o* Mi,pelle4 N.3e. - Any registered
oter whose registration record has not been included in the precinct book of oters, or whose name has been omitted in the
list of oters or who has been included therein with a wrong or mispelled name may file with the %oard an application for
inclusion of his record, or reinstatement or correction of his name as the case may be! If it is denied or not acted upon, the
oter may file on any date with the proper +unicipal or +etropolitan Trial (ourt a petition for an order directing that the oterAs
name be entered or corrected in the list! The oters shall attach to the petition a certified true copy of his registration record
or identification card or the entry of his name in the list of oters used in the preceding election, together with proof that his
application was denied or not acted upon by the %oard and that he has sered notice thereof to the %oard!
Sec. 29. A&&ul3e&t .t "oo5 o/ Vote*,. - The (ommission shall, upon erified petition of any oter or election officer or duly
registered political party, and after notice and hearing, annul any book of oters that is not prepared in accordance with the
proisions of this Act or was prepared through fraud, bribery, forgery, impersonation, intimidation, force or any similar
irregularity, or which contains data that are statistically improbable! /o order, ruling or decision annulling a book of oters
shall be e3ecuted within ninety )6<- days before an election!
Sec. 6:. Reco&,titutio& o/ Lo,t o* De,t*o1e4 Re-i,t*.tio& Reco*4,. - The (ommission shall reconstitute all registration
records which hae been lost or destroyed by using the corresponding copies of the proincial or national central files! In
case of conflict the (ommission shall determine which file shall be used for reconstitution purposes! If this is not feasible, the
(ommission shall conduct a general registration of oters in the affected area: 8roided, That there is a scheduled election
before the ne3t scheduled general registration of oters in accordance with the *mnibus #lection (ode! All such oters shall
retain their oterAs identification number! $econstituted forms shall be clearly marked with the word ;reconstituted!;
It shall be the duty of the #lection *fficer to immediately report to the (ommission any case of loss or destruction of
registration record in his custody!
The reconstitution of any lost or destroyed registration records shall not affect the criminal liability of any person who is
responsible for such loss or destruction!
Sec. 61. E@.3i&.tio& o/ Re-i,t*.tio& Reco*4,. - All registration records'computerized oters list in the possession of the
#lection officer, the 8roincial #lection Superisor, and the (ommission in +anila shall, during regular office hours, be open
to e3amination by the public for legitimate in"uiries on election related matters, free from any charge or access fee!
,aw enforcement agencies may, upon prior authorization and sub4ect to regulations promulgated by the (ommission, hae
access to said registration records should the same be necessary to and in aid of their inestigatie functions and duties!
Sec. 60. Ri-)t to I&/o*3.tio&. - The duly authorized representatie of a registered political party or of a bonafide candidate
shall hae the right to inspect and'or copy at their e3pense the accountable registration forms and'or the list of registered
oters in the precincts constituting the constituency of the bonafide candidate or at which the political party is fielding
candidates! The inspection and copying shall be conducted during business hours of the (ommission and shall be sub4ect to
reasonable regulations!
Sec. 62. o3pute*iA.tio& o/ Pe*3.&e&t Li,t o/ Vote*,. - A permanent and computerized list arranged by precinct, city or
municipality, proince and region shall be prepared by the (ommission! Thereafter, another list shall be prepared consisting
of the names of the oters, arranged alphabetically according to surnames!
The computer print-outs of the list of oters duly certified by the %oard are official documents and shall be used for oting and
other election related purposes as well as for legitimate research needs!
The total number of oters in the permanent list shall be the basis for the printing of the official ballots by the (ommission!
Sec. 66. Re.,,i-&3e&t o/ Electio& O//ice*,. - /o #lection *fficer shall hold office in a particular city or municipality for
more than four )>- years! Any election officer who, either at the time of the approal of this Act or subse"uent thereto, has
sered for at least four )>- years in a particular city or municipality shall automatically be reassigned by the (ommission to a
new station outside the original congressional district!
Sec. 67. Electio& O//e&,e,. - The following shall be considered election offenses under this Act
a! to delier, hand oer, entrust or gie, directly or indirectly, his oterAs identification card to another in consideration of
money or other benefit of promise& or take or accept such oterAs identification card, directly or indirectly, by giing or causing
the giing or money or other benefit or making or causing the making of a promise therefore&
b! to fail, without cause, to post or gie any of the notices or to make any of the reports re-ac"uired under this Act&
c! to issue or cause the issuance of a oterAs identification number or to cancel or cause the cancellation thereof in
iolation of the proisions of this Act& or to refuse the issuance of registered oters their oterAs identification card&
d! to accept an appointment, to assume office and to actually sere as a member of the #lection $egistration %oard
although ineligible thereto, to appoint such ineligible person knowing him to be ineligible&
e! to interfere with, impede, abscond for purpose of gain or to preent the installation or use of computers and deices
and the processing, storage, generation, and transmission of registration data or information&
f! to gain, cause access to use, alter, destroy, or disclose any computer data, program, system software, network, or
any computer-related deices, facilities, hardware or e"uipment, whether classified or declassified&
g! failure to proide certified oters and deactiated oters list to candidates and heads of representaties of political
parties upon written re"uest as proided in Section 0< hereof&
h! failure to include the approed application form for registration of a "ualified oter in the book of oters of a
particular precinct or the omission of the name of a duly registered oter in the certified list of oters of the precinct where he
is duly, registered resulting in his failure to cast his ote during an election, plebiscite, referendum, initiatie and'or recall! The
presence of the form or name in the book of oters or certified list of oters in precincts other than where he is duly registered
shall not be an e3cuse hereof&
i! the posting of a list of oters outside or at the door of a precinct on the day of an election, plebiscite, referendum,
initiatie and'or recall, and which list is different in contents from the certified list of oters being used by the %oard of #lection
Inspectors& and
4! .iolation of the proisions of this Act!
Sec. 6'. Pe&.ltie,. - Any person found guilty of any #lection offense under this Act shall be punished with imprisonment of
not less than one )1- year but not more than si3 )@- years and shall not be sub4ect to probation! In addition, the guilty party
shall be sentenced to suffer dis"ualification to hold public office and depriation of the right of suffrage! If he is a foreigner, he
shall be deported after the prison term has been sered! Any political party found guilty shall be sentenced to pay a fine of
not less than *ne hundred thousand pesos )81<<,<<<- but not more than 5ie hundred thousand pesos )8?<<,<<<-!
Sec. 68. Fu&4i&-. - The amount of Two billion pesos )2,<<<,<<<,<<<- is hereby included in the Eeneral Appropriations Act
for the fiscal year 1667 to defray the e3penses for the registration actiities!
Sec. 68. MultiBp.*ti,.& Mo&ito*i&- .&4 E=.lu.tio& o33ittee. - A +onitoring and #aluation (ommittee is hereby
created composed of seen )7- members to be based on party representation of the seen )7- ma4or political parties that
fielded presidential candidates in the 1662 synchronized elections! The (ommittee is an ad hoc body attached to the
(ommission but not sub4ect to its superision and control!
The task of the (ommittee is to monitor and ealuate the system, procedures or guidelines prepared by the (ommission for
the conduct of the general registration and the continuing system of registration in accordance with this Act!
The (ommittee shall prepare two reports outlining the findings and recommendations for immediate action or institution of
correctie measures by the (ommission and'or (ongress! The first report shall be submitted to the (ommission and
(ongress three )0- months before the holding of the general registration! The second report shall be due at the end of the
year on the initial implementation of the system of continuing registration!
The amount not less than 5ifty million pesos )8?<,<<<,<<<- but not more than *ne hundred million pesos )81<<,<<<,<<<- is
hereby allocated from the Two billion pesos )82,<<<,<<<,<<<- allocation proided in the preceding section for the operations
of the (ommittee! This amount shall be held in trust by the (ommission sub4ect to the usual accounting and auditing
procedures!
Sec. 69. Rule, .&4 Re-ul.tio&,. - The (ommission shall promulgate the necessary rules and regulations to implement the
proisions of this Act not later than ninety )6<- days before the first day of registration as proided for in this Act!
Sec. 7:. Sep.*.bilit1 l.u,e. - If any part of this Act is held inalid or unconstitutional, the other parts or proisions hereof
shall remain alid and effectie!
Sec. 71. Repe.li&- l.u,e. - All laws, decrees, e3ecutie orders, rules and regulations inconsistent with this Act are hereby
repealed or modified accordingly!
Sec. 70. E//ecti=it1. - This Act shall take effect fifteen )1?- days after its publication in at least two )2- newspapers of general
circulation!
