MICROSOFT SOFTWARE LICENSE AGREEMENT WITH COMPUTER

MANUFACTURER OR SOFTWARE INSTALLER, OR MICROSOFT


WINDOWS 8.1 SINGLE LANGUAGE
Thank you for choosing a computer preinstalled with, or updating to,
Microsoft Windows 8.1 Single Language. This is a license agreement between
you and the computer manufacturer or software installer that distributes
Windows 8.1 Single Language with your computer if you !rst obtain this
software as an update to Windows 8 "ia the Windows Store, this is an
agreement between you and Microsoft #orporation $or, based on where you
li"e, one of its a%liates& instead. This agreement describes your rights to use
the Windows 8.1 Single Language software. 'or your con"enience, we("e
organi)ed this agreement into two parts. The !rst part includes introductory
terms phrased in a *uestion and answer format the +dditional Terms and
Limited Warranty follow and contain greater detail. ,ou should re"iew the
entire agreement, including any linked terms, because all of the terms are
important and together create this contract that applies to you. ,ou can
re"iew linked terms by pasting the forward link into your browser window

or installer to determine its return policy and return the software or computer
for a refund or credit under that policy. ,ou must comply with that policy,
which might re*uire you to return the software with the entire computer on
which the software is installed for a refund or credit, if any.
Ho( $an I '#e the #o*t(a!e0 The software is licensed, not sold. -nder this
license agreement, we grant you the right to install and run one copy on the
computer on which you ac*uired the software $the licensed computer&, for
use by one person at a time, but only if you comply with all the terms of this
agreement. The software is not licensed to be used as ser"er software or for
commercial hosting, so you may not make the software a"ailable for
simultaneous use by multiple users o"er a network. 'or more information on

Ma+ I "a1e a %a$1'- $o-+0 ,es, you may make a single copy of the
software for backup purposes, and use that backup copy as described below.
Can I t!an#*e! the #o*t(a!e to anothe! '#e!0 ,ou may transfer the
software directly to another user, only with the licensed computer. The
transfer must include the software, proof of purchase, and, if pro"ided with
the computer, an authentic Windows label including the product key. ,ou may
not keep any copies of the software or any earlier "ersion. .efore any
permitted transfer, the other party must agree that this agreement applies to
the transfer and use of the software.
Ho( doe# Inte!net a$ti)ation (o!10 The !rst time you connect to the
/nternet while using the software, the software will automatically contact
Microsoft or its a%liate to con!rm the software is genuine and the license is
associated with the licensed computer. This process is called 0acti"ation.1
.ecause acti"ation is meant to identify unauthori)ed changes to the licensing
or acti"ation functions of the software, and to otherwise pre"ent unlicensed
use of the software, +o' "a+ not %+-a## o! $i!$'")ent a$ti)ation.
Doe# the #o*t(a!e $oe$t "+ -e!#ona in*o!"ation0 /f you connect your
computer to the /nternet, some features of the software may connect to
Microsoft or ser"ice pro"ider computer systems to send or recei"e
information, including personal information. ,ou may not always recei"e a
separate notice when they connect. /f you choose to use any of these
features, you agree to send or recei"e this information when using that
feature. Many of these features can be switched o2 or you can choose not to
use them.
Ho( doe# Mi$!o#o*t '#e +o'! in*o!"ation0 Microsoft uses the
information it collects through the software features to upgrade or !3 the
software and otherwise impro"e its products and ser"ices. /n certain
circumstances, Microsoft also shares it with others. 'or e3ample, Microsoft
shares error reports with rele"ant hardware and software "endors so that the
"endors can use the information to impro"e how their products run with
Microsoft products. ,ou agree that Microsoft may collect, use, and disclose
the information as described in the Windows 8.1 4ri"acy Statement at

What doe# thi# a&!ee"ent a--+ to0 This agreement $including any
printed paper license terms that accompany the software& applies to the
software, the media on which you recei"ed the software $if any&, and also any
Microsoft updates, supplements, and ser"ices for the software, unless other
terms come with them. /t also applies to Windows apps that are included with
Windows, which are separate from the software features. Standard

$Windows Store Terms of -se& go"ern any preinstalled apps that are not
Windows apps, unless other terms are pro"ided with such apps. /f you are
updating to Windows 8.1 Single Language, the licenses to any apps that were
preinstalled by your manufacturer or installer continue to apply after the
update.

.ecause the software is licensed, not sold, the manufacturer or installer and
Microsoft reser"e all rights $such as rights under intellectual property laws&
not e3pressly granted in this agreement. /n particular, this license does not
gi"e you any right to, and you may not= use or "irtuali)e features of the
software separately publish, copy $other than the permitted backup copy&,
rent, lease, or lend the software transfer the software $e3cept as permitted
by this agreement& attempt to circum"ent technical protection measures in
the software, re"erse engineer, decompile, or disassemble the software,
e3cept if the laws where you li"e permit this e"en when this agreement does
not. /n that case, you may do only what your law allows. When using /nternet>
based features or Microsoft 'amily Safety, you may not use those features in
any way that could interfere with anyone else(s use of them, or to try to gain
access to any ser"ice, data, account, or network, in an unauthori)ed manner.
ADDITIONAL TERMS
1. Li$en#e Ri&ht# and M'ti/U#e! S$ena!io#
a. #omputer. /n this agreement, 0computer1 means a hardware
system $whether physical or "irtual& with an internal storage de"ice
capable of running the software. + hardware partition or blade is
considered to be a computer. The software is licensed to run on only
one processor on the licensed computer.
b. Multiple "ersions. The software includes multiple "ersions $such as
?8>bit and :;>bit "ersions&, and you may install only one of those
"ersions.
c. Multiple or pooled connections. @ardware or software you use to
multiple3 or pool connections, or reduce the number of de"ices or
users that access or use the software, does not reduce the number
of licenses you need. ,ou may only use such hardware or software if
you ha"e a license for each copy of the software you are using.
d. Ae"ice connections. ,ou may allow up to 89 other de"ices to access
the software installed on the licensed computer for the purpose of
using !le ser"ices, print ser"ices, /nternet information ser"ices, and
/nternet connection sharing and telephony ser"ices on the licensed
computer. ,ou may allow any number of de"ices to access the
software on the licensed computer to synchroni)e data between
de"ices. This section does not mean, howe"er, that you ha"e the
right to install the software, or use the primary function of the
software $other than the features listed in this section&, on any of
these other de"ices.
e. -se in a "irtuali)ed en"ironment. /f you use "irtuali)ation software
to create one or more "irtual computers on a single computer
hardware system, each "irtual computer, and the physical
computer, is considered a separate computer for purposes of this
agreement. This license allows you to install only one copy of the
software for use on one computer, whether that computer is
physical or "irtual. /f you want to use the software on more than
one "irtual computer, you must obtain separate copies of the
software and a separate license for each copy. #ontent protected by
digital rights management technology or other full>"olume disk
dri"e encryption technology may be less secure in a "irtuali)ed
en"ironment.
f. Bemote access. The software contains Bemote Aesktop and Bemote
+ssistance technologies.
C Bemote Aesktop. Bemote Aesktop or similar technologies is
licensed for outbound use from this computer. ,ou may access
certain editions of Windows software running on a separately
licensed host computer from this computer by using Bemote
Aesktop.
C Bemote +ssistance. ,ou may use Bemote +ssistance or similar
technologies to share an acti"e session without obtaining any
additional licenses for the software. Bemote +ssistance allows
one user to directly connect to another user(s computer,
usually to correct problems.
3. .indin& A!%it!ation and Ca## A$tion Wai)e!
a. +pplication. /f you li"e in the -nited States, this Section 8 applies to
any dispute E4CEPT DISPUTES RELATING TO THE
ENFORCEMENT OR 5ALIDIT6 OF 6OUR, MICROSOFT2S, THE
MANUFACTURER2S OR INSTALLER2S, OR 6OUR,
MICROSOFT2S, OR THE MANUFACTURER2S OR INSTALLER2S
LICENSORS2 INTELLECTUAL PROPERT6 RIGHTS. Aispute means
any dispute, action, or other contro"ersy between you and the
manufacturer or installer, or you and Microsoft, concerning the
software $including its price& or this agreement, whether in contract,
warranty, tort, statute, regulation, ordinance, or any other legal or
e*uitable basis. 0Aispute1 will be gi"en the broadest possible
meaning allowable under law.
b. Dotice of Aispute. /n the e"ent of a dispute, you or the
manufacturer or installer, or Microsoft, must gi"e the other a Dotice
of Aispute, which is a written statement of the name, address, and
contact information of the party gi"ing it, the facts gi"ing rise to the
dispute, and the relief re*uested. Send it by -.S. Mail to the
manufacturer or installer, +TTD= LEF+L AE4+BTMEDT. Mail a Dotice
of Aispute with Microsoft to Microsoft #orporation, +TTD= L#+
+B./TB+T/GD, Gne Microsoft Way, Bedmond, W+ <89H8>:?<<. +

manufacturer or installer, or Microsoft, will send any Dotice of
Aispute to you by -.S. Mail to your address if we ha"e it, or
otherwise to your e>mail address. ,ou and the manufacturer or
installer, or Microsoft, will attempt to resol"e any dispute through
informal negotiation within :9 days from the date the Dotice of
Aispute is sent. +fter :9 days, you or the manufacturer or installer,
or Microsoft, may commence arbitration.
c. Small claims court. ,ou may also litigate any dispute in small claims
court in your county of residence or the manufacturer(s or
installer(s principal place of business, if the dispute meets all
re*uirements to be heard in the small claims court. ,ou may litigate
in small claims court whether or not you negotiated informally !rst.
d. .inding arbitration. I* +o' and the "an'*a$t'!e! o! in#tae!, o!

o! <'!+. /nstead, all disputes will be resol"ed before a neutral
arbitrator, whose decision will be !nal e3cept for a limited right of

may enforce the arbitrator(s award.

f. +rbitration procedure. +ny arbitration will be conducted by the
+merican +rbitration +ssociation $the 0+++1& under its #ommercial
+rbitration Bules. /f you are an indi"idual and use the software for
personal or household use, or if the "alue of the dispute is JKH,999
-SA or less whether or not you are an indi"idual or how you use the
software, its Supplementary 4rocedures for #onsumer>Belated
Aisputes will also apply. To commence arbitration, submit a
#ommercial +rbitration Bules Aemand for +rbitration form to the
+++. ,ou may re*uest a telephonic or in>person hearing by
following the +++ rules. /n a dispute in"ol"ing J19,999 -SA or less,
any hearing will be telephonic unless the arbitrator !nds good
cause to hold an in>person hearing instead. 'or more information,

linkid78;H;<K to the +++. ,ou agree to commence arbitration only
in your county of residence or in the manufacturer(s or installer(s
principal place of business $or in Ling #ounty, Washington if your
dispute is with Microsoft&. The manufacturer or installer agrees to
commence arbitration only in your county of residence. The
arbitrator may award the same damages to you indi"idually as a
court could. The arbitrator may award declaratory or inIuncti"e
relief only to you indi"idually, and only to the e3tent re*uired to
satisfy your indi"idual claim.
g. +rbitration fees and incenti"es.
i. Aisputes in"ol"ing JKH,999 -SA or less. The manufacturer or
installer will promptly reimburse your !ling fees and pay the
+++(s and arbitrator(s fees and e3penses. /f you reIect the
manufacturer(s or installer(s last written settlement o2er made
before the arbitrator was appointed $0last written o2er1&, your
dispute goes all the way to an arbitrator(s decision $called an
0award1&, and the arbitrator awards you more than the last
written o2er, the manufacturer or installer will gi"e you three
incenti"es= $1& pay the greater of the award or J1,999 -SA $8&
pay twice your reasonable attorney(s fees, if any and $?&
reimburse any e3penses $including e3pert witness fees and
costs& that your attorney reasonably accrues for in"estigating,
preparing, and pursuing your claim in arbitration. The
arbitrator will determine the amounts.
ii. Aisputes in"ol"ing more than JKH,999 -SA. The +++ rules will
go"ern payment of !ling fees and the +++(s and arbitrator(s
fees and e3penses.
iii. Aisputes in"ol"ing any amount. /n any arbitration you
commence, the manufacturer or installer will seek its +++ or
arbitrator(s fees and e3penses, or your !ling fees it
reimbursed, only if the arbitrator !nds the arbitration fri"olous
or brought for an improper purpose. /n any arbitration the
manufacturer or installer commences, it will pay all !ling, +++,
and arbitrator(s fees and e3penses. /t will not seek its
attorney(s fees or e3penses from you in any arbitration. 'ees
and e3penses are not counted in determining how much a
dispute in"ol"es.
h. #laims or disputes must be !led within one year. To the e3tent
permitted by law, any claim or dispute to which Section 8 applies
must be !led within one year in small claims court $Section 8.c& or
in arbitration $Section 8.d&. The one>year period begins when the
claim or dispute !rst could be !led. /f such a claim or dispute is not
!led within one year, it is permanently barred.
i. Se"erability. /f the class action wai"er in Section 8.e is found to be
illegal or unenforceable as to all or some parts of a dispute, then
Section 8 $arbitration& will not apply to those parts. /nstead, those
parts will be se"ered and proceed in a court of law, with the
remaining parts proceeding in arbitration. /f any other pro"ision of
Section 8 is found to be illegal or unenforceable, that pro"ision will
be se"ered with the remainder of Section 8 remaining in full force
and e2ect.
I. Microsoft as party or third>party bene!ciary. /f Microsoft is the
computer manufacturer or you obtain the software as an update to
Windows 8 "ia the Windows Store, Microsoft is a party to this
agreement. Gtherwise, Microsoft is not a party but is a third>party
bene!ciary of your agreement with the manufacturer and installer
to resol"e disputes through informal negotiation and arbitration. /f
your dispute is with Microsoft, Microsoft agrees to do e"erything the
manufacturer or installer agrees to do in Section 8, and you agree
to do e"erything regarding Microsoft that Section 8 re*uires you to
do regarding the manufacturer or installer. ,ou may commence an
arbitration or small claims court case against Microsoft in your
county of residence or Ling #ounty, Washington.
=. Choi$e o* La(
The laws of the state or country where you li"e go"ern all claims and disputes
concerning the software $including its price& or this agreement, including
breach of contract claims and claims under state consumer protection laws,
unfair competition laws, implied warranty laws, for unIust enrichment, and in
tort, e3cept that the '++ go"erns all pro"isions relating to arbitration. /f you
ac*uired the software in any other country, the laws of that country apply.
This agreement describes certain legal rights. ,ou may ha"e other rights,
including consumer rights, under the laws of your state or country. ,ou may
also ha"e rights with respect to the party from whom you ac*uired the
software. This agreement does not change those other rights if the laws of
your state or country do not permit it to do so.
>. A$ti)ation
a. More on how acti"ation works. The software will notify you whether
the installed copy of the software is properly licensed. Auring
acti"ation, the software will send information about the software
and your computer to Microsoft. This information includes the
"ersion, language, and product key of the software, the /nternet
protocol address of the computer, and information deri"ed from the
hardware con!guration of the computer. 'or more information about
acti"ation, see go.microsoft.com5fwlink56linkid78898:8. /f the
licensed computer is connected to the /nternet, the software will
automatically connect to Microsoft for acti"ation. ,ou can also
acti"ate the software manually by /nternet or telephone. /n either
case, /nternet and telephone ser"ice charges may apply.
b. Be>acti"ation. Some changes to your computer components or the
software may re*uire re>acti"ation of the software.
c. +cti"ation failure. Auring online acti"ation or reacti"ation, if the
licensing or acti"ation functions of the software are found to be
counterfeit, improperly licensed, or include unauthori)ed changes,
acti"ation will fail and the software will attempt to repair itself by
replacing any tampered Microsoft software with genuine Microsoft
software. The software will notify you if the installed copy of the
software is improperly licensed or includes unauthori)ed changes.
/n addition, you may recei"e reminders to obtain a properly licensed
copy of the software. ,ou may not be able to obtain certain updates
or upgrades from Microsoft if your copy of the software is found to
be improperly licensed.
d. #ustomi)ation. Some of the information collected during acti"ation
is sent to Microsoft after acti"ation to pro"ide customi)ed ser"ices
to you. 'or e3ample, ser"ices such as the Windows Error Beporting
and the Windows Store send some of this information in order to
pro"ide ser"ices customi)ed for the type of computer hardware that
is running this software. Similarly, the Microsoft account ser"ice
may also send some of this information to make it easier for you to
create new Microsoft accounts. 'or more information, see

?. Inte!net/.a#ed Feat'!e#@ P!i)a$+
Some software features use /nternet protocols, which send to Microsoft $or its
suppliers or ser"ice pro"iders& computer information, such as your /nternet
protocol address, the type of operating system, browser, and name and
"ersion of the software you are using, and the language code of the computer
where you installed the software. Microsoft uses this information to make the
/nternet>based features a"ailable to you, in accordance with the Windows 8.1
4ri"acy Statement at go.microsoft.com5fwlink56linkid78898:8 and information
that may be presented to you in the Windows user interface. Some /nternet>
based features may be deli"ered and updated at a later dateMif, for e3ample,
you ac*uire an application that relies on one of those ser"ices, or to help
make the software safer or more reliable.
a. Windows -pdate. /f you use the Windows -pdate ser"ice in the
software, updates or downloads to the Windows -pdate ser"ice will
be re*uired for proper functioning of the ser"ice, from time to time,
and will be downloaded and installed without further notice to you.
b. Windows digital rights management technology. Some content
owners use Windows digital rights management technology $ABM&
to protect their copyrights and other intellectual property, including
by disabling the software(s ability to play protected content if
Windows ABM fails. ,ou agree that Microsoft may include a
re"ocation list with the licenses.
c. Windows Media 4layer. When you use Windows Media 4layer, it
checks with Microsoft for compatible online music ser"ices in your
region and new "ersions of the player. ,ou may only use Windows
Media 4layer as described at go.microsoft.com5fwlink56

d. Windows Aefender. /f turned on, Windows Aefender will search your
computer for many types of malicious software $0malware1&,
including "iruses, worms, bots, rootkits, 0spyware1, 0adware,1 and
other potentially unwanted software. /f you choose the
recommended security settings when you !rst start using the
software, such malware and other potentially unwanted software
rated 0high1 or 0se"ere1 will automatically be remo"ed. This
remo"al may result in other software on your computer ceasing to
work or your breaching a license to use that software. /t is possible
that software that is not unwanted may be remo"ed or disabled. /f
you use Windows Aefender and Windows -pdate, Windows
Aefender is regularly updated through Windows -pdate.
e. Malicious software remo"al. The software may periodically scan for
and remo"e malware from your computer, using the malicious
software remo"al tool most recently downloaded to your computer.
+fter the scan completes and at regular inter"als, a report will be
sent to Microsoft with speci!c information about malware detected,
errors, and other information about your computer. This information
is used to help protect your computer from malicious software, as
well as to impro"e the software and other Microsoft products. ,ou
may disable the software(s reporting functionality by following the
instructions found at go.microsoft.com5fwlink56linkid78;1K8H.
f. SmartScreen 'ilter. /f enabled, the SmartScreen 'ilter will check the
addresses of webpages and downloads you attempt to "iew against
a fre*uently updated list of webpages and downloads that ha"e
been reported to Microsoft as unsafe or suspicious. SmartScreen
will also check downloaded programs that you attempt to run
against a list of commonly downloaded or run programs to help you
make more informed trust decisions. More information can be found

go.microsoft.com5fwlink56linkid7889188. .y enabling SmartScreen
in either Windows or /nternet E3plorer, you consent to this feature,
and you agree to use the SmartScreen 'ilter only in conIunction
with Windows or /nternet E3plorer. ,ou may not, either manually or
by enabling or authori)ing any software or ser"ice, copy, display,
distribute, collect, or store any data pro"ided by the SmartScreen
'ilter.
g. /4": Detwork +ddress Translation $D+T& Tra"ersal ser"ice $Teredo&.
Each time you start your licensed computer, Teredo will attempt to
locate a public /nternet 4rotocol "ersion : $/4":& ser"ice on the
/nternet. This occurs automatically when your licensed computer is
connected to a public or pri"ate network, but does not occur on
managed networks such as enterprise domains. /f you use a
program that re*uires Teredo to use /4": connecti"ity, or if you
con!gure your !rewall to always enable /4": connecti"ity, then
Teredo will periodically contact the Microsoft Teredo ser"ice o"er the
/nternet. The only information sent to Microsoft is standard
computer information and the name of the ser"ice re*uested $for
e3ample teredo.ip":.microsoft.com&. The information sent from
your computer by Teredo is used to determine if your computer is
connected to the /nternet and if it can locate a public /4": ser"ice.
Gnce the ser"ice is located, information is sent to maintain a
connection with the /4": ser"ice.
h. 4lug and 4lay and 4lug and 4lay E3tensions. ,our computer may not
ha"e the dri"ers needed to communicate with hardware that you
connect to your computer. /f so, the update feature of the software
can obtain and install the correct dri"er on your computer. +n
administrator can disable this update feature.
i. Aigital certi!cates. The software uses digital certi!cates to con!rm
the identity of /nternet users sending N.H9< standard encrypted
information, to digitally sign !les and macros, and to "erify the
integrity and origin of !le contents. The software may retrie"e and
update certi!cates, certi!cate re"ocation lists, and the list of
trusted certi!cation authorities, o"er the /nternet.
I. Detwork awareness. This feature determines whether a system is
connected to a network by either passi"e monitoring of network
tra%c or acti"e ADS or @TT4 *ueries. The *uery transfers only
standard T#45/4 or ADS information for routing purposes. ,ou can
switch o2 the acti"e *uery feature through a registry setting.
k. +ccelerators. When you click on or mo"e your mouse o"er an
+ccelerator in /nternet E3plorer, any of the following may be sent to
