The irresistible-force of Truth, Justice and the American Way appears to have emerged victorious, although hurdles persist; the House is to Vote on Defunding ObamaCare, although the strategy doesnt quite befit what this physician had envisioned, starting six weeks ago *although its inching closer]:
Leadership sources tell me the House GOP will soon vote on a continuing resolution that simultaneously funds the federal government and defunds ObamaCare. Speaker John Boehner and Majority Leader Eric Cantor are expected to announce the decision at Wednesdays closed-door conference meeting.
This means the conservatives who have been urging Boehner to back a defunding effort as part of the CR have won a victory, at least in terms of getting the leadership to go along with their strategy. But getting such a CR through the Democratic Senate and signed into law will be very difficult, and many House Republican insiders say a Plan B may be needed.
Heres how my sources expect this gambit to unfold: The House passes a defund CR, throws it to the Senate, and waits to see what Senator Ted Cruz and his allies can do. Maybe they can get it through, maybe they cant. Boehner and Cantor will be supportive. But if Cruz and company cant get it through the Senate, the leadership will urge Republicans to turn their focus to the debt limit, avoid a shutdown, and pass a CR that doesnt defund ObamaCare.
For the moment, though, the leadership is officially undecided. No decisions have been made, or will be made, until House Republican members meet and talk tomorrow, says Michael Steel, Boehners spokesman.
To recap, to preclude a two-pronged attack on the GOPand now noting that the decision by Boehner last week to split-off ObamaCare-$ [inadvertently] constituted a step-in-the-right-directionconsider:
HR 2009 *Keep the IRS Off Your Health Care Act of 2013+ was passed by the House and could be appended to the CR covering the Treasury Department; HR 2300 *Empowering Patients First+ could be appended to the CR covering the Health and Human Services Department; the remaining eight departments could then be amalgamated into one CR and passed [thereby envisioned to be passed by the Senate and signed by the POTUS]. In this fashion, the GOP would not be portrayed as the Party of NO! because it would have adopted [and funded] its alternative-plan, and the GOP would not be 579
portrayed as having shut down government because it would have upheld its duties [per the Constitution, Article I, Section 7] to originate government-funding bills.
There would be no D-justification to avoid passing monies that would fund the rest of the government and, thus, regardless of the fate of ObamaCare, the risk of a government shut-down would be gone. Meanwhile, focus could be trained solely on what an increasing number of Americans fervently desire, thereby allowing for the GOP to champion the interests of a burgeoning electorate grown tired of BHO. That his antics have drawn increasing fire from the left is HUGE [including the elitist crowds], and the culmination of angst regarding misconduct domestic and foreign would be afforded a useful outlet *including yesterdays political-speechifying while he knew the Naval Base was being shot-upbut didnt know who/what/where/when/why/howeven condemned THROUGHOUT THE DAY on MSNBC].

It was learned that one must double-post comments when an article appears in the Courier Times and the Intelligencer; this approach should be mirrored to yield maximum exposure. It seems loco-regional efforts to help GOP-Congressmen do the right thing have extended statewide, noting that Shuster [PA-9] was challenged-by-the Tea-Party Movement. Also, after a group launched an ad-blitz against Congress ObamaCare Bribe, it was concluded that defunding ObamaCare need not be viewed as 'Suicide' After All. And the crazy-politicians have been out in-force, as Reid Blamed Colorado Floods [which caused massive destruction] On 'Climate Change' [and predictably used the occasion to slam House Republicans for partisanship and wasting the "taxpayer's time" trying to repeal ObamaCare].
Although a bit off-topic, it is necessary to confront John McCains recent behavior within the overall context of his lengthy career; regarding this particular battle, McCain advised 580
the GOP not to Shut-Down Gov't, despite the repeated claims that this was rhetorically the emanation from the Dsbecause the Rs consistently focused solely on ObamaCare.
Witness how he has portrayed a foreign policy that has attracted few adherents. Despite reports that al-Qaeda Islamists permeate the Syrian rebels ,an issue that will be probed, time-permitting, over the weekend}, McCain posed with some while in Syria and, with kerry, cited-syria-analyst-with-false-credentials [who wrote a discredited essay last week in the WSJ]. Perhaps in reaction to embarrassment [of both himself and BHO], he will attack putin in pravda ,an action that constitutes cinema rather than potency-. He claims the us-lost-credibility-on-egypt and now has 'no credibility' in Arab world because [inter alia] Kerry's Message Sabotaged Egypt Mission; in reaction, analysts feel it's BHO, McCain and Graham *Grahamnesty+ who made 'huge mistake' in Egypt.
Also, McCain views the Next few weeks as a 'critical time in the life or death' of immigration reform and he is guardedly optimistic on house passage; as his Wife is Meeting With the Former First Lady of Mexico and his daughter Meghan McCain has Lost Her Base [The Media], his erratic behavior prompted an Official Arizona GOP Body to Pass a Formal Rebuke of John McCain andperhaps as a resultSen. John McCain has Hinted at 2016 Retirement. {It is so-sad that he has become self-marginalized.}
Polling shows 70% voters 'concerned' about future coverage, as 51%-favor-government-shutdown-until- healthcare costs are cut by Congress; a feeble defense has been mounted by Sebelius when she claimed people 'WILL CAN MAY GET COVERED' as another entity [MCDONALDS] pled for relief from ObamaCare. First, inasmuch as this is Constitution Day, its vital to remember the Anti-Federalists; sentiments in this essay were mirrored last week by Mark *The Great One+ Levin on his radio-show [noting that he/I are Cheltenham High School grads]; the key-point is that both camps shared common goals that had to be fleshed-out, yielding the view that the Bill of Rights would ensure individual protectionsand that Federalism would provide a final balance between the *united+ states and the united *states+.

Untouched for almost seven decades, the tunnel used in the Great Escape has finally been unearthed. The 111-yard passage nicknamed Harry by Allied prisoners was sealed by the Germans after the audacious break-out from the POW camp Stalag Luft III in western Poland. Despite huge interest in the subject, encouraged by the film [starring Steve McQueen, James Garner, Richard Attenborough, and Charles Bronson], the tunnel remained undisturbed over the decades because it was behind the Iron Curtain and the Soviet authorities had no interest in its significance.

But at last British archaeologists have excavated it, and discovered its remarkable secrets. Many of the bed boards which had been joined together to stop it collapsing were still in position. The ventilation shaft, ingeniously crafted from used powdered milk containers known as Klim Tins, remained in working order. Scattered throughout the tunnel, which is 30 ft. below ground, were bits of old metal buckets, hammers and crowbars which were used to hollow out the route.
A total of 600 prisoners worked on three tunnels at the same time. They were nicknamed Tom, Dick and Harry and were just 2 ft square for most of their length. It was on the night of March 24-25, 1944, that 76 Allied airmen escaped through Harry. Barely a third of the 200 prisoners many in fake German uniforms and civilian outfits and carrying false identity papers who were meant to slip away managed to leave before the alarm was raised when escapee number 77 was spotted.
Only three made it back to Britain; 50 were executed by firing squad on the orders of Adolf Hitler, who was furious after learning of the breach of security.
In all, 90 boards from bunk beds, 62 tables, 34 chairs and 76 benches, as well as thousands of items including knives, spoons, forks, towels and blankets, were squirrelled away by the Allied prisoners to aid the escape plan under the noses of their captors.
Although the Hollywood movie suggested otherwise, NO Americans were involved in the operation. Most were British, and the others were from Canada (all the tunnellers were Canadian personnel with backgrounds in mining), Poland, New Zealand, Australia, and South Africa.
The latest dig, over three weeks in August, located the entrance to Harry, which was originally concealed under a stove in Hut 104.
The team also found another tunnel, called George, whose exact position had not been charted. It was never used as the 2,000 prisoners were forced to march to other camps as the Red Army approached in January 1945.
Watching the excavation was Gordie King, 91, an RAF radio operator, who was 140 th in line to use Harry and therefore missed out. This brings back such bitter-sweet memories, he said as he wiped away tears. Im amazed by what theyve found.

Almost two months ago, Sen. *Dr.+ Tom Coburn blasted this defunding effort by citing a reference that was unavailable via normal Internet-searching; thus, his office was contacted [202-224-5754] and a receptionist guided this physician to a webpage that provided hyperlinks to a site that allegedly had the full-length report *which doesnt open+ and to another site containing an executive-summary thereof. The premise of this analysis is that CRS: Government Shutdown Does Not Shut-Down ObamaCare:
On July 29, 2013 the Congressional Research Service (CRS) issued a memo to Dr. Coburn at his request for information on the potential effects of a funding lapse and related government shutdown on implementation of the Patient Protection and Affordable Care Act. The memo specifically addressed several questions he posed. The memo reveals that if government were shut down, funding for ObamaCare would still continue. In other words, shutting down the federal government does not shut down ObamaCare. This document is a summary of direct quotes from that memo.
Thus, it is necessary to determine whether any reasonable justification exists among moderates GOP-members of the House who are reluctant to sign-on with Graveswhen the specifics of this memo are confrontedwith the Graves-CR in-mind. A non-attorney physician may be an unreliable resource for such an exercise, so the reader is invited to draw independent conclusions. Yet, using the word IRS as a search-term, it would appear that the comprehensive lingo in Graves would preclude the type of cost-shifting [envisioned in this report] that could be pursued by an elusive/conniving Executive Branch.
The Administration Can Exercise Some Discretion Implementing ObamaCare In the context of a prospective or actual lapse in appropriations and government shutdown, several presidential administrations have interpreted the nature and scope of restrictions on government activities during a shutdown and any related exceptions. These interpretations.identified specific exceptions that govern federal agency decisions regarding which operations may continue during a government shutdown under certain circumstances. These exceptions arguably have been read broadly, resulting in a situation where executive agencies may exercise some discretion. It is important to note that past views and practice in the executive branch do not necessarily constrain or guide what may happen in the event of a future funding lapse and shutdown.
The Obama Administration Already Had ObamaCare Funding Plans Online The near-impasses [in FY2011 and FY2012] also resulted in executive branch agencies posting a substantial amount of information on the Internet about their plans for a potential shutdown, including information about excepted and non-excepted personnel and activities. These plans might provide insight into questions of whether government activities at specific agencies and programs, and in specific situations, would continue or cease.
A Government Shutdown Does Not Cause All Government Functions To Cease A funding gap also may occur any time that interim funding in a continuing resolution (CR) expires and another CR or regular appropriations bill is not enacted immediately 586
thereafter. When a funding gap occurs, the federal government begins a shutdown of the affected activities, including the furlough of certain personnel and curtailment of agency activities and services. There are some exceptions to this process, however, as explained further..In 1980 and 1981, *sic+, U.S. Attorney General Benjamin R. Civiletti issued two opinions that more strictly interpreted the Antideficiency Act in the context of a funding gap, along with the laws exceptions.
There Are Four Types of Funding That Do Not Cease During A Shutdown The GAO has summarized the 1981 Civiletti opinion as identifying four sub-types of authorized by law exceptions. Those include: 1. Activities funded with appropriations of budget authority that do not expire at the end of one fiscal year, such as multiple-year and no-year appropriations 2. Activities authorized by statutes that expressly permit obligations in advance of appropriations, such as contract authority. 3. Activities authorized by necessary implication from the specific terms of duties that have been imposed on, or of authorities that have been invested in, the agency. The Civiletti opinion illustrated this abstract concept by citing the situation when benefit payments under an entitlement program are funded from other-than-one-year appropriationsbut the salaries of personnel who administer the program are funded by one-year appropriations the Attorney General offered the view that continued availability of money for benefit payments would necessarily imply that continued administration of the program is authorized by law at some level and therefore excepted from the Antideficiency Act. 4. Obligations necessarily incident to presidential initiatives undertaken within his constitutional powers, such as the power to grant pardons and reprieves.
Substantial ObamaCare Implementation Would Continue In a Shutdown It appears that substantial ACA implementation might continue during a lapse in annual appropriations that resulted in a temporary government shutdown for two reasons. The first is that the federal government will be able to rely on sources of funding other than annual discretionary appropriations to support implementation activities, including multiple-year and no-year discretionary funds still available for obligation as well as mandatory funds..The HHS shutdown contingency plan that was prepared in anticipation of a possible government shutdown in FY2012 indicated that ACA implementation activities at CMS would continue because of the mandatory funding provided in the law.
What About ObamaCare Implementation Funding From Other Sources? The Administrations FY2014 budget requested $1.4 billion in new funds for CMS Program Management for ongoing ACA implementation activities, plus an additional $400 million for the IRS to administer ACAs tax-related provisions, including the premium tax credits. In the event that congressional appropriators do not provide any of these funds, or in the event of a temporary lapse in discretionary appropriations that results in a government shutdown, it seems likely that the Administration will continue to rely on alternative sources of funding to support ACA implementation activities.
ObamaCares Subsidies for Health Coverage Would Continue During a Shutdown 587
Like many other tax credits, the monies used to fund such provisions are permanently appropriated outside of the annual appropriations process. Therefore, the funds for such credits would continue to be available via this permanent appropriation during a government shutdown caused by a lapse in annual appropriations.it may be likely that at least some of the eligibility and processing functions associated with payment of this credit might continue during a government shutdown, even if the salaries of the federal employees who would be making those determinations are paid from annual appropriations that have lapsed. This is because the IRS could rely upon that portion of the Civiletti opinion which indicates that continued availability of money for benefit payments would necessarily imply that continued administration of the program is authorized by law despite the lapse in discretionary funding.
Even Past Shutdown Experience Suggests Subsidies Would Still Be Operational The experience of the Social Security Administration (SSA) during the two FY1996 shutdowns illustrates what might happen over a period of time in these situations..SSA had not retained staff to, among other things, respond to telephone calls from customers needing a Social Security card to work or who needed to change the address where their check should be mailed for the following month. SSA then advised OMB that the agency would need to retain 49,715 additional employees for direct service work, including the processing of new claims for Social Security benefits.. The SSA workers described above were determined to be excepted based on the necessary implication standard enunciated in the Civiletti opinion. Consequently, it may be reasonable to infer that any similar benefit programs under the ACA with a separate funding stream could also be considered excepted functions under the necessary implication doctrine in the event of a lapse in annual appropriations.
The IRS Could Still Continue To Collect ObamaCares Taxes During a Shutdown In its government shutdown Contingency Plan from November 16, 2011, the IRS cited memoranda from OMBand the General Counsel of the Treasury for the proposition that incoming tax revenue constitutes property in the context of this exception to the Antideficiency Act. As a result, that contingency plan indicated that during a lapse in appropriations, the Service may continue processing tax returns to insure the protection of those returns that contain remittances. Importantly, it should be noted that a lapse in funding does not automatically result in the suspension of filing and payment deadlines imposed by the Internal Revenue Code (IRC). While some enforcement and collection activities may be unavailable during a government shutdown, those authorities would resume if funding is subsequently provided for the IRS, and any outstanding tax liabilities accrued during that time period may be subject to enforcement and collection at that time.
A Shutdown Would Not Halt ObamaCares Medicare Cuts A short-term government shutdown would likely have little impact on Medicare claims payments based on what happened during the shutdowns in 1995-1996, nor would it affect underlying program requirements. Medicare continued to pay physicians and hospitals during those shutdowns according to the prevailing payment rates because claims are paid out of the Medicare trust funds. These outlays represent mandatory spending, which is not controlled by the appropriations committees. However, CMSs contractual payments to the vendors that process the claims on its behalf come from 588
the agencys operating budget, which is funded through annual discretionary appropriations. During the 1995-1996 shutdowns, the claims vendors continued to process and pay claims with the expectation that they would be paid for their services later.
ObamaCares Exchanges Would Not Be Dismantled in a Government Shutdown Yes, other sources of funding besides annual discretionary appropriations are available in FY2014 and beyond to support exchange operations..The HHS Secretary currently is using funding from ACA and other sources to establish the federally facilitated exchanges and related information technology (i.e., data services hub) and to engage in consumer outreach and education. ACA also provided the Secretary with an indefinite annual appropriation to award exchange planning and establishment grants to states through 2014. Each year, the Secretary determines the amount of funding that will be made available to states through this grant program. Beginning in 2015, exchanges must be self-sustaining.
The Individual Mandate Would Continue Under a Shutdown The individual mandate applies to tax years beginning after December 31, 2013 (i.e., calendar years 2014 and on), and is intended to be assessed as part of a taxpayers annual income tax return required to be filed during April of the year following the applicable tax year.. If a government shutdown were to occur during calendar year 2014, the lapse in funding would not automatically suspend the requirements of the individual mandate. In other words, during the time period that the government is shut down, taxpayers who fall within the coverage of the individual mandate would still be accruing penalties for any months in which they lacked minimum essential coverage. There is no general exception to the individual mandate that automatically applies during a lapse in government funding. Moreover, the HHS Secretary has not included a government shutdown among the various circumstances enumerated in regulation as constituting a hardship.
All I see in this report is analysis of what would transpire during a presumptive shut-down; inasmuch as the GOP plans to fund everything except ObamaCare, envisioning what might occur short-term is moot. On the other hand, it is desirable to note the detailed exploration of how ObamaCare interdigitates with governmental activities seemingly disparate from its alleged healthcare focus. These considerations may be of-interest if it is necessary to tease-out what might transpire during a house-senate conference committee meeting if, for example, the idea of a yearlong delay achieves any degree of primacy.
Tentatively, it is easy to draw two conclusions. First, it is the job of legislators to understand these issues and, thus, to be able to tackle a task of this magnitude [or scale-down the overall effort accordingly]; nothing should be too big to fail, whether in the private *banking+ sector or in the halls of government. Second, if this task is found to be excessively daunting, the members of the TEA Party Movement would undoubtedly argue for a complete defunding, lest BHO make unconstitutional [cost-shifting] moves. Overall, it is sexy to return to the concept that, were BHO to resist our wiles, he would risk shut-down of the IRS [which has been targeted by the libertarian wing of the GOP during recent years].

ObamaCare has both the Tea Party and Labor Unions on the same page in repealing the Presidents healthcare law. Thats not something I have ever seen, or ever expected to see, in politics. When groups like these, who are typically in opposition to each other, can find common ground on something so important, elected officials need to take notice. Illustrative of the way Senate-Ds will feel-the-heat is the need to meet-the-two-democrats-who-voted-to-defund-ObamaCare [both of whom are under considerable re-election pressure]; illustrative of the status of this effort a fortnight ago *and now+ are points I privately wrote while lobbying *Defund ObamaCare Remarks]:
Tomorrow, the irresistible force will meet the immovable object. My goal, briefly, is to tell you what we have accomplished in suburban Philadelphia and to discuss how we can win the argument nationally, quoting Senator Ted Cruz of Texas, who has spearheaded this movement along with Senator Mike Lee.
The TEA Party Movementremember, T-E-A stands for Taxed Enough Alreadyhas matured and faces its greatest test. We have discovered what Pogo the Possumin the comic strip written by Walt Kelleylearned to his dismay during the Vietnam War era; We have met the enemy, and they is us!
Specifically, we need to apply tough love to the Republicans who were elected under the banner of repeal and replace ObamaCare less than a year ago. Thats why we wrote a Resolution that was signed-off by every TEA Party Movement group in Bucks County; the text tells the story:
We, the undersigned leaders of patriot groups in the 8 th Congressional District, have been active supporters of Congressman Mike Fitzpatrick for years, contributing time, effort, and funds to support this honest civil servant. We have asked the Congressman to protect the best interests of individuals, families, and businesses in his district by refusing to fund ObamaCare. Unfortunately, despite having cast 42 votes supporting symbolic resolutions against the detrimental provisions of this Healthcare Act, Congressman Fitzpatrick has not committed himself to taking a stand against funding ObamaCare in the Continuing Resolution.
The failure of our representatives in the House to use their power of the purse strings to delay or stall the burdensome requirements of ObamaCare undermines the people's confidence in their understanding of the harmful impact of this law and their commitment to the welfare of the people. Those of us who have worked to put the Congressman in office because of his firm stand against ObamaCare call on Congressman Fitzpatrick to back up his words with action by voting against any measure that provides funding for ObamaCare. We further ask that Congressman Fitzpatrick make public this commitment to his constituents. 604
We specifically request that Congressman Fitzpatrick promptly sign the letter composed by Rep. Mark Meadows, urging the House GOP leadership to affirmatively de-fund the implementation and enforcement of ObamaCare in any relevant appropriations bill brought to the House floor in the 113th Congress, including any continuing appropriations bill.
We would advise that others co-adopt this policy ASAP and petition their Congressmen in this fashion, for this is a pivotal moment in American history, and partisan politics must not dominate the debate; citizens must be reminded that ObamaCare has nothing to do with medicine, and everything to do with Big Government control. D.C. can snoop everywhere, but our personal lives must remain private.
Thats why, after having listened to Democrats and to wavering Republicans, we generated this strategy, with specific reference to the Continuing Resolutionthe CRand to the EXCLUSION of any effort by Speaker Boehner to link this effort with any other agenda-item [such as the Debt Ceiling or Sequester]:
HR 2009 *Keep the IRS Off Your Health Care Act of 2013+ was passed by the House and could be appended to the CR covering the Treasury Department; HR 2300 *Empowering Patients First+ could be appended to the CR covering the Health and Human Services Department; the remaining eight departments could then be amalgamated into one CR and passed [thereby envisioned to be passed by the Senate and signed by the POTUS]. In this fashion, the GOP would not be portrayed as the Party of NO! because it would have adopted *and funded+ its alternative-plan, and the GOP would not be portrayed as having shut down government because it would have upheld its duties *per the Constitution, Article I, Section 7] to originate government-funding bills.
We are upset that we had to challenge our beloved Congressman, Mike Fitzpatrick, on this issue, but channeling what has happened nationally was vital; we also note that Senator Toomeyyesterdaysuggested that the monies involved in the CR comprise only 15% of what would be expended next year, with the rest presumably having been raised via taxation. Frankly, my dears, we dont give a damn for removing this discretionary funding would starve the beast, even if it has been partially fed by mandatory funding. For example, no appropriation to implement the Individual Mandate would exist.

As more important implementation dates for Obamacare come up, I want to make it clear why I oppose Obamacare and the type of health reform I stand for. This week, I released a TOP TEN list of ways the law is failing. I also offered my support for new alternative legislation introduced by my colleague Dr. Phil Roe (R-TN). I believe its important to not just oppose Obamacare, but to offer solutions that work better. This week, I took additional steps in my continuing effort to defund, delay, and ultimately repeal the president's health care law. In the Senate, I co-sponsored two bills to delay for one year either a portion or all of the law's onerous mandates and taxes. Both bills delay the individual and employer mandates that go into effect Jan. 1, 2014. Obamacare is fundamentally wrong in its approach to improving our nation's health care system. It should be repealed in its entirety.
Since taking office in 2011, I have repeatedly advocated for repealing Obamacare. I have worked with Senate colleagues on both sides of the aisle on a broad array of strategies to dismantle it, such as repealing the medical device tax, which stands to cost Pennsylvania's economy $100 million annually. I have also co-sponsored legislation that eliminates the health insurance tax and the Independent Payment Advisory Board.
I continue to work to overturn this law. Lacking that, Congress should at least delay the implementation of its heavy-handed mandates to prevent imminent harm to Pennsylvanians' pocketbooks, jobs, and economic wellbeing.

I am pleased that the House measure defunds ObamaCare, includes my Full Faith and Credit Act to take the default option off the table if the debt ceiling is not raised, and avoids a government shutdown on Oct. 1.

I think I can relax a bit, for it seems many events are moving productively; will provide explanations in human bites *ref. Amazingly *perhaps not so surprisingly+, they incompletely cite polling data; rather than stating the vast majority of Americans still hate ObamaCare, they segue to the claim that most Americans dont want a shut-down [thereby shrouding the viewer from the complete truth].
Heres a sampling of where Americans stand on ObamaCare: 1. 68 percent are concerned about the impact on their personal health care under ObamaCare (Fox News poll, September 17) 2. 57 percent oppose ObamaCare (CNN/ORC International survey, September 11) 3. 52 percent believe ObamaCare will result in their health care costs increasing (NBC News/Wall Street Journal poll, September 15) 4. 51 percent want Congress to cut funding for ObamaCare (Rasmussen Reports, September 17) It has been claimed that the presidency-is on-the-verge-of-a-nervous-breakdown, noting 5-key-reasons- why-barack-obamas-future-looks-increasingly-bleak: 1. A new Gallup poll suggests the November mid-terms could result in the biggest victory (13%) for Republicans in the House since 1894 608
2. The Senate now hangs in the balance, per Rasmussen and RealClearPolitics. 3. The economic figures are grim, per the US-Govt. and Investors Business Daily. 4. A quarter of Democrats have turned against the president 5. George W. Bush is now as popular as President Obama It has also been noted by Investors Business Daily that the media are telling 40 little-lies-about- ObamaCare and that there is a strong resemblance between BHO and lenin, who-used-these six- principles-of-propaganda-to-consolidate-control: 1. Blame Your Predecessor During an interview with the daily caller, Ted Cruz has answered these four questions: 1. What precisely is your strategy to defund ObamaCare and whats your best argument for employing this method? 2. Explain specifically how your strategy actually has a realistic chance of being successful? 3. Your opponents argue your strategy wont work because Republicans, without control of the White House or the Senate, do not have the votes. They say its simply dishonest to lead conservatives across the country to think it would. Opponents also say that Republicans will take the blame for any shutdown, thus harming your midterm chances. Your response? 4. How are those who disagree with you on the strategy distorting your views on this? {Because this is so vital, note that the following constitutes his complete answer.} Cruz: Aside from the defeatist view that this cant be won, addressed above, there are three significant misunderstandings:
A) Some, even among our allies, describe our proposal as shutting down the government to defund ObamaCare. Such framing clearly tilts towards the Democrats. Our perspective is, we would pass a bill to fund the entire government except ObamaCare; it is the President and his allies who have threatened to shut down the government to force ObamaCare onto working families, even though its problems are manifest.
B) Another recurring line is that a recent Congressional Research Service report confirmed that a government shutdown would not, in itself, fully defund ObamaCare. Of course not; no one has ever suggested it would. The point is, passing a CR that defunds ObamaCare that explicitly prohibits discretionary and mandatory spending defunds ObamaCare. Thats what this fight is all about.
C) Some have suggested this initiative would only defund ObamaCares discretionary spending, while leaving in place the far larger mandatory spending. This is incorrect, as we can absolutely include language in the CR to defund ObamaCares mandatory spending as well. 609

A deluge of updated information has been acquired, some of which requires corroboration; for example, someone reported that Reid is threatening to abrogate a commitment [made only a few months ago] that yielded confirmation of key people by invoking the nuclear option *simple-majority vote] to attain prompt Senate passage of a CR that funds ObamaCare [thereby limiting debate], behavior that explains why Congressional Leaders Get Low Marks as Fiscal Fight Looms. BHO will probably dominate the news on Monday/Tuesday due to events @ the UN-General Assembly; nevertheless, a few key-updates are provided, noting that Sen. Cruz correctly views the Vote in House to defund ObamaCare as 'historic':
Senator Ted Cruz will join Chris Wallace on Fox News Sunday to discuss what comes next in the fight to #DefundObamaCare. It is clear that hes the leader of this effort, recognized even by a politician [who wants to compete with him for the POTUS-16 nod+ and a critic [who is channeling the GOP-Establishment] to have led the House strategy; note that the former [gop-rep-peter-king claimed cruz should-keep-quiet] and the latter, [david-brooks pled for the gop-leadership-to-show-ted-cruz-whos-boss! have angst.
This is the latest encyclical from the Heritage Foundation, perhaps generated by awareness of the above concern regarding potential-tricks that Reid may be contemplating; note the absence of gloating:
NO on Striking Defund Language
Next week, the Senate is likely to consider the House-passed year-end funding bill (H.J.Res.59), which also permanently defunds ObamaCare. According to multiple media reports, Senate Majority Leader Harry Reid may use a post-cloture amendment, which would allow him to alter the bill with a 50-vote threshold, thus gutting the essential defunding language secured by the House.
Before Reid can move to eliminate the defunding language, he must first secure 60 votes to invoke cloture. That vote, which is likely to come late next week, is a procedural motion that would facilitate efforts by Reid and others to strip the defunding language from H.J.Res.59. If Reid uses this procedural trick, a vote on the motion to invoke cloture is a vote to undermine the House-passed bill.
If opponents of ObamaCare unite against Reids procedural power play by denying cloture, the language defunding ObamaCare will remain intact, proving that the Senate cannot move a CR that funds ObamaCare.
Heritage Action opposes procedural motions that facilitate efforts to strip the defunding language and reserves the right to include such vote(s) on the legislative scorecard.
As noted throughout the Internet, to quote Guzzardi *citing My Fair Lady+, We Did It! It is necessary, however, prior to drawing major conclusions, to confront key-concerns with those who have belatedly 611
seen-the-lightso that the reader can be forewarned if/when these people/groups attempt to relapse, perhaps opining in a fashion that could subtly tarnish this valiant effort. This is a focused-effort, linked neither to the debt-ceiling *regardless of A.B. Stoddards editorial-comments on FNC yesterday @ noon] nor to the sequester [regardless of the punditry emanating from MSNBC/CNN, c/o the Dsof course+.
Already addressed were comments by A.B. Stoddard on MSNBC [trashing Cruz] and on FNC [gamely suggesting a compromise would occur, despite inability to explain-away chronological contradictions], and also noted have been efforts to chew around the edges @ this late-date [such as amendments blocking Congressional carve-outs]; at this point, the goal is to starve the dragon, not feed it orts. [Yet, noted is the vicious collegial reaction to efforts by Vitter to accomplish this, a few days ago: To hold onto their illegal ObamaCare subsidy that no other American earning $174,000 could get, members of Congress are trying to silence the subsidys chief critic, Sen. David Vitters, by dredging up a 2007 unproven accusation that Vitters patronized a prostitute before being elected to the Senate.]
First, consider the local Independence Hall entity [Tea Party Association, P.A.C., Foundation] run by the Adams-siblings; it was first to endorse Romney, but is finally last to endorse defunding. It should be noted that this-physician personally extended an invitation to attend our post-Labor Day get-together; responding to having purposefully been kept in the loop was this overt-snub of unification-efforts [which inter alia reflects the psychological inability to have gotten over it regarding the 12 election+, rebuffs which were honored thereafter as everybody else quickly unified behind the Press Release [noting also the inability to ID people in Bucks County who harbored any fealty to their judgments]:

Please know that the Independence Hall Tea Party takes its direction solely from its Board of Directors and Executive Officers--and prides itself on its Independence as an organization. (It is not affiliated with any national organization. However, it does, from time to time, join issue-oriented coalitions with other conservative groups.)
No other individual or organization has the right to speak on behalf of the Independence Hall Tea Party--as was maliciously done in a 2010 letter to Mike Fitzpatrick. That letter, which called for a boycott of his campaign, was authored and signed by several Bucks County Tea Party leaders immediately after Mike won the Republican Primary. (For the record, the Independence Hall Tea Party PAC endorsed Mike Fitzpatrick in the primary and was very proud of his role in firing Nancy Pelosi as Speaker of the House.)
Regarding the current issue--as you all know, over the past four years, the Independence Hall Tea Party has worked tirelessly to defeat ObamaCare.

Its PAC was the only Tea Party PAC in the nation to endorse and support Governor Mitt Romney for President--and had he been elected, ObamaCare would be sitting on the ash heap of history.
In recent weeks, members of the Independence Hall Tea Party Board have met with several of our region's Republican Congressional Delegation and are in the process of meeting with several more.
In our frank discussions, we have come to realize that the Republican strategy to delay and defund ObamaCare has not yet been fully fleshed out and we are withholding comment and judgement [sic] until the appropriate time.
We have conveyed our hope that Congressional Republicans will be able to devise a unified strategy that focuses on delaying and defunding the implementation of ObamaCare to the greatest extent possible. We believe a unified front is the only way we can possibly defeat this disastrous piece of legislation at this very late hour.

The PAC is sending you this urgent message because the imminent vote on ObamaCare is as much a political matter as it is a matter of public policy.
But before we write another word, we refer you to five excellent articles on the topic:
As all of you know far too well, we are at war with forces that seek to entangle the federal government in every aspect of our lives. This philosophy of gover- nance, which is slowly being implemented, will eventually lead to an unprecedented loss of liberty.
Had the Republican Party, with the help of the Tea Party, not recaptured the House of Representatives and fired Nancy Pelosi in 2010, these forces would have marched us even further down the path of socialism.
In a short two years of complete Democratic rule (2008-2010), the federal government, among other devastating policies, seized control of 1/6 the nation's economy through the very partisan, so-called 'Affordable Health Care Act.'
After the disheartening June 2012 US Supreme Court ruling on ObamaCare, the only means left by which we could have repealed this disastrous law was through the ballot box.
And in that endeavor, we failed--big-time--in the following November election. Not only did we fail to win the White House, but we also failed to win the Senate--and neither goal was originally beyond our reach.

Many in the Tea Party, for various reasons (including self-interest) sat on the sidelines and refused to help Mitt Romney win the Presidency. Two of the wealthiest Tea Party affiliated PACS--FreedomWorks PAC and Tea Party Express--never even endorsed the former Governor. (FreedomWorks actually waged a stop Romney campaign during primary season.)
Tea Party Patriots leader, Jenny Beth Martin, was nothing but critical of the Repu- blican nominee. Ms. Martin was finally--and appropriately--rebuked by Ann Coulter.
(Note: Sadly, the Independence Hall Tea Party PAC was the first and only Tea Party PAC in the nation to endorse Governor Romney.)
Now that we are facing the consequences of electoral defeat, FreedomWorks, Tea Party Express, and Tea Party Patriots, along with Heritage Action, are screaming the loudest for a federal government shutdown--as if shutting down the government were the goal of our movement as opposed to stopping the pending implementation of ObamaCare.
As you know, a forced government shutdown could very well lead to a conservative political defeat in the 2014 elections--as President Obama and the media will surely lay blame for the shutdown at the feet of House Republicans.
Minus a controversial shutdown, we are on the verge of reclaiming the Senate and expanding control of the House.
As much as we might deplore John Boehner's leadership, are we really prepared for the return of Nancy Pelosi as House Speaker?
What roadblocks would then remain in place to stop the Democrats from passing an open borders bill or creating a single-payer healthcare system or bombing Syria?
Having said all of this, we do concede that if there were ever an issue worthy of a government shutdown, it is ObamaCare.
We most certainly respect those who have thoughtfully backed this strategy. The idea is not unreasonable given the urgency of our nation's predicament.
However, there is one fatal flaw with its rationale. In the end, a government shutdown would not defeat ObamaCare. Even if the Senate were to go along, President Obama would never, ever agree to the dismantling of the centerpiece of his two-term presidency. It is, he hopes, his lasting legacy.
And when the President refuses to go along, what recourse will be left to Republicans?
Their leadership would eventually have to surrender and admit defeat.

Fortunately for us, over 200 House Republicans are uniting behind a defund and delay strategy that would, in all likelihood, avoid a government shutdown.
And this unified approach by House Republicans is a much better plan. (Division among Republicans would only weaken their bargaining position with Harry Reid and the President--enabling Democrats to maintain the status quo.)
As part of the Continuing Resolution, they will defund ObamaCare and force the Senate to vote on it on the issue for the first time since its passage. If, as expected, the Senate does not go along with defunding (thank you, very much, John McCain), the House will offer legislation to keep the government operating.
A few weeks later, however, the Debt Ceiling crisis will emerge. At that point, Republicans will be in a much better position to negotiate with the President and Senator Reid.
Expect Republicans to offer, and possibly get, a one year delay in the implementation of the individual mandate; the rescinding of the medical device tax; and other smaller concessions.
These components of the law are crucial for ObamaCare's implementation. Without them, ObamaCare will lack sufficient funding and have difficulty surviving.
While we wish the legislation could be speedily repealed, we would be almost as pleased if it were to die a slow death.
And our area Congressmen seem to think that is a strong possibility.
After meeting with several of them over the past three weeks, we have come to the conclusion that they are sincerely committed to doing everything possible, short of mass political suicide, to hasten the demise of ObamaCare.
We especially thank Congressmen Mike Fitzpatrick, Pat Meehan, Joe Pitts, Chris Smith, Jim Gerlach, and Scott Perry for lending us their ears and providing solid, rationale arguments for their points of view. We also thank Senator Pat Toomey's office for giving us a clearer understanding of the Debt Ceiling strategy.
All seven of these Representatives are men of substance and of character, and even when we disagree with them, we should remember that they are thoughtful public servants.
And all seven of them hold out the prospect that ObamaCare will eventually die of its own bureaucratic weight--especially after the House begins dismantling it bit by bit.

Philadelphia (September 20, 2013) -- The Independence Hall Tea Party, today, commended the US House of Representatives--in particular, regional House Republicans--for their vote, this morning, to defund ObamaCare.
The measure to fund the government, except for ObamaCare, passed the House by a 230-189 vote.
"We congratulate House Speaker John Boehner for uniting House Republicans," said Association President Teri Adams. "The vote was a victory for all of us who have been fighting to stop socialized medicine.
"Republican unity is critical before negotiation with the Democrats begin.

Similarly, home-depot-sent-20,000-employees-into-ObamaCare simply by shifting medical coverage for 20K part-time workers to new public marketplace exchanges ahead of new benefits requirements under the U.S. Affordable Care Act; the worlds largest home improvement retail chain announced its move shortly after a similar announcement from Trader Joes Co, a popular privately-held grocery chain.
Meanwhile, non-partisan actuaries at the Centers for Medicare and Medicaid Services (CMS) issued a report that concluded ObamaCare would increase national health spending over the next 10 years by $621 billion, undermining its being the Affordable Care Act. Building on this concern is the claim that the USA must cut $2 trillion over 10 yrs to stabilize debt, as per the CBO, essentially predicting-unsustainable-debt. Anyone wondering about the one R who voted for ObamaCare funding should know that it was Rep. Scott Rigell (Va.), who voted against the bill out of frustration with the continuous stream of temporary fixes passed on Capitol Hill; he claimed ObamaCare was a tangential concern, and his electoral history suggests he could be primaried.
The purpose, here, is to cite briefly what was uttered/written today, and then to provide an extended essay written by a D; through it all, the stark reality is that the Rs talk about the issue while the Ds talk about the politics. Thus, the key-concern must be whether the issue is sufficiently vital to prompt the GOP to man the ramparts. Although the customary bombast emerged from the Ds [PELOSI claimed OBAMACARE MEANS FREEDOM TO 'FOLLOW YOUR PASSION' and MCCASKILL claimed the GOP was THROWING 'TANTRUMS'], the true intrigue played-out among the Rs. GOP Sen. Ted Cruz, who had pledged a possible filibuster if the senate bill funds ObamaCare, explained why he wants to Defunding ObamaCare during intense questioning by Chris Wallace on Fox News Sunday; Wallace revealed that top-dc-republicans-sent- opposition-research-to help him hammer-cruz [alas, to no avail], and Sarah palin-fired-at-fox-news-that, to keep-it-truly-fair-balanced, the-names of the-cruz-critics should be divulged. Meanwhile, as Senator Lee-claimed to-Have-46-Votes-In-The-Senate-To-Defund-ObamaCare, Senator Coburn was claiming that the GOP should attempt to amend ObamaCare because We Can't Defund ObamaCare; the tentative plan has been detailed [Why-Would-the-Senate-GOP-Block-a-Vote-on-the-Continuing-Resolution].
A friend wrote a comment earlier today that recalls this physicians previously- articulated view that ObamaCare has nothing to do with medical care, for its all about governmental control: The real message of ObamaCare is not the program itself, but the controlling aspects of it! ObamaCare is not about "health care"; it's about providing EVERY American, inferior, inept and more-than-likely, deadly services that, once installed and operating, will solidify the Progressive Liberals 110 year "dream" of controlling just about every aspect of American life. Lest we forget, Barrack Obama is a disciple of Saul Alinsky, and he follows this Alinsky principle: "The issue is never the issue; the issue is the REVOLUTION" (Barack Obama's Rules for Revolution, pg. 6); this "revolution" amongst the Progressive Liberals/Socialists/Communists in this country has been on-going for the past 110 years! ObamaCare is not about "Health Care" for the masses; it's all about controlling the masses!

Today, a bipartisan majority in the House of Representatives voted to stop ObamaCare while funding the government to prevent a shutdown. This is a powerful development for the cause of freedom, showing that our representatives are listening to the concerns of the American people about this unworkable, unfair, and unpopular health care law.

When this partisan law was rammed through more than three years ago, its backers publicly stated they could not bother to read the legislationor give the American people time to read the bill. We have to pass the bill so that you can find out whats in it, as the former Speaker of the House famously remarked.
The people who passed ObamaCare didnt listen to the American peoplebecause, as polling since ObamaCare passed has demonstrated, the American people dont like the law one bit. All the reasons people dont like ObamaCare are the same reasons we need to stop its implementationto prevent premiums from going up; to prevent massive new tax hikes; and to prevent people from losing their health coverage, or losing their jobs altogether.
Listening to the American people about stopping ObamaCare should not be a partisan exercise. Real people have already been harmed by this misguided law. Every day brings new facts to light on how ObamaCare will raise costs on struggling families, restrict access to doctors and plans they like, increase our debt, and damage our fragile economy. Congress should work together to protect American families from being hurt and instead work on commonsense reforms that expand health care choices and lower costs.
Today, the House of Representatives voted to stop ObamaCare because it listened to people across the country. Heres hoping the Senate listens to the American people as well.

Last night, after a worthwhile day of hanging around the House of Representatives, I published this story on the GOP leadership's acquiescence to the "defund ObamaCare" scheme. None of them can say how or why Democrats would go along with this, instead of saying "you've got to be kidding me" and stripping the ObamaCare portion of the continuing resolution in the Senate. Actually, and sort of hilariously, Ted Cruz irritated House Republicans last night by warning that Democrats already had the votes to do so.
But a rump of Republicans were adamant about voting down any CR that didn't defund ObamaCare, and the GOP leadership didn't want to irritate them by relying on Democratic votes. No, that will come later. In doing this, the party was unresponsive to most public polling, and betting (or at least saying out loud) that it could convince voters any shutdown was actually Barack Obama's fault. Because that's how it worksif you make a demand, and some guy doesn't meet your demand, and you refuse to pay a bill, it's that guy's fault.
There is a logic here, explained by Greg Sargent and his bag of data from the Washington Post poll.

Republicans are far more likely to oppose raising the debt limit than anyone else; they say dont raise it by 61-25. By contrast, Dems say raise it by 62-31, and independents split by 48-46 on raising versus not raising it.
Republicans, however, also believe overwhelmingly that not raising it would cause serious economic harm by 66-27. (Dems and indys tilt the same way.)
Again, it's logical, because they know failing to raise the debt limit will be harmful but view that as a casualty in the war on ObamaCare, which would literally ruin the American economy for all knowable time. The GOP's problem is twofold. One: Some of its quieter, safer members, like Oklahoma Rep. Tom Cole, don't want to go along with this. (He told me and a few other reporters yesterday that, in the end, he didn't want to risk a shutdown or default.) Two: The GOP is supposed to be convincing voters that any shutdown or default would be Obama's fault!
If youre in a hurry, and you can only memorize one fact about the coming congressional debt and budget war, try this: There will be no defunding of ObamaCare. Its impossible for Republicans to admit it, great energy is being spent to prevent them from admitting it, and large sums of money are being raised and spent to stop conservatives from realizing it. If you want to skip to the end of this drama, past Fridays likely vote on the resolution that defunds ObamaCare, the final page reads and ObamaCare survived.
To get to that ending, House Republicanswho really do want to shred the lawhave to construct a series of hallucinations for their holdouts. Theyre very convincing hallucinations. The current plan, which Republican leaders were confident enough to endorse on camera today, is to pass a continuing resolution that funds the government at a shrunken, post-sequestration level, but ends funding for ObamaCare implementation, subsidies, etc.permanently. And if that fails, Republicans are going to try to demand a one-year delay of ObamaCare in a deal to raise the debt limit.
Its a brilliant ruse. Until last week, Eric Cantor and other House GOP leaders had wanted to pass a funding bill that carved out ObamaCare. This would have allowed members to say theyd voted against the funding, then blame the Senate for betraying them. The plan was condemned by conservative groups like Heritage Action, and by Sen. Ted Cruz, whod just spent August stumping for the death of ObamaCare, often at events sponsored by Heritage Action. Another symbolic vote against ObamaCare is meaningless, said Cruz. Tell Pete Sessions and Eric Cantor to stop playing games with the lives of Americans, said RedState.coms Erick Erickson. Cantor relented right before Congress recessed for a long weekend instead of resolving the dispute.
The new defunding plan was built from the blueprints of Cruz and Georgia Rep. Tom Graves, both Republicans whod criticized the Cantor sellout. It was sold, successfully, at the conferences Wednesday meeting.
The key to any leadership job is to listen, said House Speaker John Boehner after the doors opened.

The conference was unifying around the proposal because we focused on keeping the government open and protecting the American people from ObamaCare, said Graves after the meeting. From there, he logged on to a Heritage webcast to sell the plan to his base. People say its a victory for conservatives or the right. Its actually a victory for America.
Whats remarkable about this illusion is just how often it works. Defunding ObamaCare through the continuing resolution isnt a new idea. It came up in the winter of 2011, when the new House Republican majority faced its first continuing resolution. Cantor said it would likely preclude any funding for ObamaCare. Rep. Steve King pledged to block funding for its implementation and enforcement onto every appropriations bill or continuing resolution from this point forward. The House ended up defunding ObamaCare, and watching the Senate strike that part of the billbut it was OK, because it would get another chance.
Heres another old idea: getting conservative holdouts to back their preferred version of a bill, just in order to say that the House has passed something. That happened in June 2011, when Republican whips failed to line up votes for a compromise debt limit package because it didnt require spending caps or a balanced-budget amendment. Conservatives had demanded, and pledged to support, a debt limit hike that hinged on passing a strict balanced-budget amendment, one that would make tax hikes impossible. Leadership caved and let the party pass the hardline billwhich was, of course, ignored in the final debt deal, as the amendment went down like a soggy paper plane.
The hard times continued into 2013. Up to now, the House Republicans most embarrassing stumble seemed to be the failure of the farm bill, way back in June. Conservatives refused to back a compromise that would have funded food stamps; Democrats refused to provide enough votes for Republican leaders to pass the bill with defections. So the bill failed, and Republicans passed, with amusing fanfare, a farm bill that didnt fund food stamps at all, one that would be doomed in the Senate.
Why does this keep happening? A large number of Republicans, who know that funding bills have to originate in the House, take this issue very seriously. Their constituents, and the pressure groups, promise to punish them if they dont defund what needs defunding.
So they run up to the edge, and they pretend that Democrats may go along with their plansmaybe, if they try this a few more times. Well see what the Senate does, said Oklahoma Rep. Tom Cole, a loyal and talkative Boehner ally. Nobody can predict that. If the president and Democrats in the Senate have a road-to-Damascus moment, maybe we will.
This was a little risible, because we can predict with 100 percent certainty that President Obama will not accept the demolition of ObamaCare. And we know that even vulnerable Senate Democrats have no interest in destroying the law. Most of them either voted for the law in 2009 or defended it on the campaign trailwhat, like Republicans would go easy on them if they flip-flopped? 632
The endorsement from Cole, who was perfectly ready to cave in and vote for the old Cantor plan, proves how illusory the whole plan is. The hardliners were making it impossible to proceed without another showdown, so voil heres the showdown, which theyll lose. Maybe they can convince Americans that a government shutdown over a refusal to fund current law was really President Obamas fault. When it comes to a government shutdown, said the optimistic Florida Rep. Steve Southerland, it may depend on who is holding the ball at the end.
What if that football analogy turns out to be wrong? Well, the leadership can say it did all it could. Enough moderate Republicans will be willing to vote with a majority of Democrats for some ugly compromise.
Ted Cruz and *Utah Sen.+ Mike Lee have been asking for this fight, said Louisiana Rep. John Fleming, a reliable conservative. The conservative base has been asking for this fight. So were gonna give em the fight.
Theyll give it to them knowing that the fight is almost certainly impossible to win. Thats not as humiliating as it sounds. As illusory as the defund campaign is, its flashy enough to obscure the gains won by hardliners. Every Republican leaving the meeting today suggested that a compromise funding bill or a compromise debt limit hike would set spending at the levels set by sequestration. At his short press conference, Boehner agreed with that. Nebraska Rep. Lee Terry sounded as cynical as Cole about ObamaCare, saying it was worth falling on your sword to stop it, not saying that doing so would work. He was much more confident, and more insistent, that the eventual deals would force Obama to approve the Keystone XL pipeline.
These would be solid Republican wins, enabledas far as the conservatives can tellby the most hard-core members willingness to humiliate their leadership. Republicans can see exactly how this plan will make that happen. Theyre not able to say how the plan will actually defund ObamaCare.
Our responsibility is to focus on the House, said Graves. The Senates the Senate.
Fleming agreed with that, happily punting to his colleagues in the upper house. If they can deliver on the CR to defund, he said, hey, more power to em!
