INTERNATIONAL SEMINAR

ON THE TRANSFORMATION OF ISLAMIC LAW

IN RESPONDING GLOBAL VALUES
Syarif Hidayatullah State Islamic University Jakarta, Indonesia
November, 11th 12th, 2014
BACKGROUND
Many approaches have been used by fuqaha to prove and
show the flexibility of Islamic law to cope with global
challenge reinterpretation of sacred texts, revitalization of the
established legal theories, integrating and combining Islamic
legal theories and civil liberties principles, deconstructing and
purifying the legal texts from the local culture, capturing the
essence and spirit of Islamic message etc.
In such case, the whole structure of Islamic legal
doctrine denotes that Islam is one but Muslims are many.
Hence, the practice of Islamic law in the modern world
cannot be interpreted by single perspective. The basis,
genesis, development, theoretical assumption as well as
practical translation in the real application are fascinating;
its flexibility and elasticity in one side and its rigidity and
hardness in another side, indicate the hope for more growing
process of answering the challenge and searching an ideal
combination of protecting Islamic identity and adjusting the
sacred to the profane.
In todays discourse, not all aspects of Islamic law can
be transformed into state regulation. The basic values of
modern law to some extend must be desacralized relevant
to people needs. The interplay and relation between sharia
and law may be in opposition one to another: sharia remains
as a communal law, whereas modern law grows rapidly as
state regulation.
The emerging issues in Muslim societies, however, are
remain existed since long time. Islam has been encountered
with local and global challenges. This means that Islamic
teachings (especially sharia) are steadly demanded to respond
the challenges existed in regional and international issues.
This historical fact throughout Islamic development has
reconfirmed Muslim position in using their Islamic teaching
with different times and places.
This international seminar is designed to reactualize
the dynamic of todays transformation of sharia and law.
The seminar will enrich the mosaic, horizon and Islamic
perspectives. In addition, it will contribute to improving the
spirit of dialog among legal systems in the commitment of
respecting universal human values.
