608WELLSTIMULATIONACTIVITIESCOVEREDBYDRILLINGPERMIT
(1)Wellcompletionswhichincludehydraulicfracturing,acidizing,orotherchemicalstimulation
donetocompleteawellareconsideredpermittedactivitiesunderthedrillingpermitforthatwellonlyif
theprocesses,anticipatedvolumes,andtypesofmaterialsplannedforuseareexpresslydescribedin
thepermitapplicationforthatwell.
(2)Forwildcatorexploratorywellsorwhentheoperatorisunabletodeterminethathydraulic
fracturing,acidizing,orotherchemicaltreatmentwillbedonetocompletethewell,theoperatormust
submitanoticeofintenttostimulateorchemicallytreatawellonFormNo.2priortocommencingsuch
activitiesprovidedthat:
(a)thewritteninformationdescribingthefracturing,acidizing,orotherchemicaltreatment
mustbeprovidedtotheboard'sstaffatleast48hoursbeforecommencementofwellstimulation
activities.
(3)Forthepurposeofthissection,anadequatedescriptionoftheproposedwellstimulation
includes:
(a)theestimatedtotalvolumeoftreatmenttobeused;
(b)thetradenameorgenericnameoftheprinciplecomponentsorchemicals;
(c)theestimatedamountorvolumeoftheprinciplecomponentssuchasviscosifiers,acids,or
gellingagents;
(d)theestimatedweightorvolumeofinertsubstancessuchasproppantsandothersubstances
injectedtoaidinwellcleanup,eitherforeachstageofamultistagejoborforthetotaljob;and
(e)themaximumanticipatedtreatingpressureorawrittendescriptionofthewellconstruction
specificationswhichdemonstratethatthewellisappropriatelyconstructedfortheproposedfracture
stimulation.
(4)Inlieuofawellspecificdesign,theowner,operator,orservicecompanymayprovide:
(i)acopyofafinaldesignofwelltreatmentactuallyusedforsimilarwellsandwhichreflects
thelikelydesignforthewelltobepermitted;or
(ii)aprefiledgenericdesignsubmittedforspecificgeologicformations,geographicareas,or
welltypeslikelytobeusedinaparticularwell.

36.22.1015DISCLOSUREOFWELLSTIMULATIONFLUIDS
(1)Theowneroroperatorofawellshall,uponcompletionofthewell,providetheboard,onits
FormNo.4foranewwellorFormNo.2foranexistingwell:
(a)adescriptionoftheinterval(s)orformationtreated;
(b)thetypeoftreatmentpumped(acid,chemical,fracturestimulation);and
(c)theamountandtype(s)ofmaterialpumpedandtheratesandmaximumpressureduring
treatment.
(2)Forhydraulicfracturingtreatmentsthedescriptionoftheamountandtypeofmaterialused
mustinclude:
(a)adescriptionofthestimulationfluididentifiedbyadditivetype(e.g.acid,biocide,breaker,
brine,corrosioninhibitor,crosslinker,demulsifier,frictionreducer,gel,ironcontrol,oxygenscavenger,
pHadjustingagent,proppant,scaleinhibitor,surfactant);and
(b)thechemicalingredientnameandtheChemicalAbstractsService(CAS)Registrynumber,as
publishedbytheChemicalAbstractsService,adivisionoftheAmericanChemicalSociety(www.cas.org),
foreachingredientoftheadditiveused.Therateorconcentrationforeachadditiveshallbeprovidedin
appropriatemeasurementunits(poundspergallon,gallonsperthousandgallons,percentbyweightor
percentbyvolume,orpartspermillion).
(3)Tocomplywiththerequirementsofthissection,theowneroroperatormaysubmit:
(a)theservicecontractor'sjoblog;
(b)theservicecompanysfinaltreatmentreport(withoutanycost/pricingdata);
(c)anowneroroperatorswelltreatmentjoblog;or
(d)otherreportprovidingtheaboverequiredinformation.
(4)Theadministratormaywaivealloraportionoftherequirementsinsubsections(2)or(3)of
thisruleif:
(a)theowneroroperatordemonstratesthatithaspostedtherequiredinformationtothe
InterstateOilandGasCompactCommission/GroundwaterProtectionCouncilhydraulicfracturingweb
site(FracFocus.org);or
(b)asuccessorwebsitetoFracFocus.orgorotherpubliclyaccessibleInternetinformation
repositoriesthattheBoardmaychoosetoaccept.

(1)Asprovidedin3014402,MCA,wheretheformula,pattern,compilation,program,device,
method,technique,process,orcompositionofachemicalproductisuniquetotheowneroroperatoror
servicecontractorandwould,ifdisclosed,revealmethodsorprocessesentitledtoprotectionastrade
secretssuchachemicalneednotbedisclosedtotheboardorstaff.Theowner,operator,orservice
contractormayidentifythetradesecretchemicalorproductbytradename,inventoryname,chemical
familyname,orotheruniquenameandthequantityofsuchconstituent(s)used.
(2)Ifnecessarytorespondtoaspillorreleaseofatradesecretproducttheowner,operator,or
servicecontractormustprovidetotheboardorstaff,uponrequest,alistofthechemicalconstituents
containedinatradesecretproduct.Theadministratormayrequestinformationbeprovidedorallyorbe
provideddirectlytoalaboratoryorotherthirdpartyperforminganalysisfortheboard.Boardmembers,
boardstaffandanythirdpartiesreceivingtradesecretinformationonbehalfoftheboardmaybe
requiredtoexecuteanondisclosureagreement.
(3)Theowner,operator,orservicecontractormustalsoprovidethechemicalconstituentsofa
tradesecretproducttoahealthprofessionalwhoprovidesawrittenstatementthatknowledgeofthe
chemicalconstituentsofsuchproductisneededforpurposesofdiagnosisortreatmentofanindividual
andtheindividualbeingdiagnosedortreatedmayhavebeenexposedtothechemicalconcerned.The
healthprofessionalmaynotusetheinformationforpurposesotherthanthehealthneedsassertedin
thestatementofneed,andmayberequiredtoexecuteanondisclosureagreement.
(4)Whereahealthprofessionaldeterminesthatamedicalemergencyexistsandthechemical
constituentsofatradesecretproductarenecessaryforemergencytreatment,theowner,operator,or
servicecontractorshallimmediatelydisclosethechemicalconstituentsofaproducttothathealth
professionaluponaverbalacknowledgementbythehealthprofessionalthatsuchinformationshallnot
beusedforpurposesotherthanthehealthneedsassertedandthatthehealthprofessionalshall
otherwisemaintaintheinformationasconfidential.Theowneroroperatororservicecontractormay
requestawrittenstatementofneed,andaconfidentialityagreementfromahealthprofessionalassoon
ascircumstancespermit.

36.22.1106HYDRAULICFRACTURING
(1)Newandexistingwellswhichwillbestimulatedbyhydraulicfracturingmustdemonstrate
suitableandsafemechanicalconfigurationforthestimulationtreatmentproposed.
(2)Priortoinitiationoffracturestimulationtheoperatormustevaluatethewell.Ifthe
operatorproposeshydraulicfracturingthroughproductioncasingorthroughintermediatecasing,the
casingmustbetestedtothemaximumanticipatedtreatingpressure.Ifthecasingfailsthepressure
testitmustberepairedortheoperatormustuseatemporarycasingstring(fracturingstring).
(a)Iftheoperatorproposeshydraulicfracturingthoughafracturingstring,itmustbestunginto
alinerorrunonapackersetnotlessthan100feetbelowthecementtopoftheproductionor
intermediatecasingandmustbetestedtonotlessthanmaximumanticipatedtreatingpressureminus
theannuluspressureappliedbetweenthefracturingstringandtheproductionorimmediatecasing.
(3)Acasingpressuretestwillbeconsideredsuccessfulifthepressureappliedhasbeenheldfor
30minuteswithnomorethantenpercentpressureloss.
(4)Apressurereliefvalve(s)mustbeinstalledonthetreatinglinesbetweenpumpsand
wellheadtolimitthelinepressuretothetestpressuredeterminedabove;thewellmustbeequipped
witharemotelycontrolledshutindeviceunlesswaivedbytheboardadministratorshouldthefactual
situationwarrant.
(5)Thesurfacecasingvalvemustremainopenwhilehydraulicfracturingoperationsarein
progress;theannularspacebetweenthefracturingstringandtheintermediateorproductioncasing
mustbemonitoredandmaybepressurizedtoapressurenottoexceedthepressureratingofthe
lowestratedcomponentthatwouldbeexposedtopressureshouldthefracturingstringfail.

36.22.1010WORKOVER,RECOMPLETION,WELLSTIMULATIONNOTICEANDAPPROVAL
(1)Nowellmaybereperforated,recompleted,reworked,chemicallystimulated,or
hydraulicallyfracturedwithoutfirstnotifyingtheboardonFormNo.2andreceivingapprovalfromthe
administratororotherauthorizedrepresentativeoftheboard.Within30daysfollowingcompletionof
thewellwork,asubsequentreportoftheactualworkperformedmustbesubmittedonFormNo.2.
(2)Wellrepairs,includingtubing,pump,suckerrodreplacementorrepair,repairsand
reconfigurationofwellequipmentwhichdonotsubstantiallychangethemechanicalconfigurationof
thewellboreorcasingandhotoiltreatments,donotrequirepriorapprovalorasubsequentreport.
Acidandchemicaltreatmentsoflessthan10,000gallons,andsimilartreatmentsintendedtoclean
perforations,removescaleorparaffin,orremedynearwellboredamagedonotrequirepriorapproval
butdorequireasubsequentreportoftheactualworkperformedsubmittedonFormNo.2within30
daysfollowingcompletionofthework.
