WOOD, did unlawfully attempt to cause the death of Officer Michael Talley with intent to effect the death of Officer Michael Talley. Said acts constituting the offense of Attempted Murder in the Second Degree in violation of MN Statute: §609.19.1(1); 609.17.1 Maximum Sentence: 20 years. COUNT 2 On or about the 2nd day of January, 2015, in Ramsey County, Minnesota, the defendant, ROBERT SCOTT WOOD, did unlawfully assault a peace officer by using or attempting to use deadly force against the officer while the officer was engaged in the performance of a duty imposed by law, policy or rule. Said acts constituting the offense of Assault in the First Degree in violation of MN Statute: §609.221.2(a) Maximum Sentence: 20 years or $30,000 fine, or both. V.8107 Robert Scott Wood | Co. ii i" 2135430-1 Court File No, Page: 2 of & oT ‘The Complainant states that the following facts establish probable cause: STATEMENT OF PROBABLE CAUSE On January 2, 2015, Saint Paul Police Officers responded to 43 Lyton Place, Saint Paul, Ramsey County on a welfare check. Earlier that moming, ROBERT SCOTT WOODS (DOB: 2-10-1961) had become upset and made threatening comments to his girlfriend, DB, about committing suicide, Woods told her, “You better not call those cops.” DB was concemed because Woods has a history of previous suicide attempts, DB knew Woods was supposed to see his psychiatrist later that day and he left the house a short time after he made the threatening comments. DB called Woods’ psychiatrist to voice her concerns about his behavior. While DB was on the phone with the psychiatrist, Woods returned home. Woods became very upset to find DB talking to his psychiatrist and he forced DB out of the house. The psychiatrist called police and indicated that Woods may be attempting “suicide by cop.” Officers arrived and saw DB holding open a storm door. Woods then pushed DB out of the home and shut the door. DB made contact with police and told them that Woods behavior was erratic. She said Woods had a big knife behind his back and wanted police to kill him. She said Woods had attached a knife to the end of his cane to create a spear. Woods had numerous knives in his pocket and had a BB gun. Police took cover behind vehicles directly across the street from 43 Lyton Place. Officers saw Woods at the window of the second floor. Woods opened the window, removed the screen, and then backed away. Woods came out of the home several times holding a hunting knife while telling police to “fuck off.” Woods went back inside. Officer Pira, who had taken cover behind a truck, then heard a whizzing, snapping sound near him, and he realized Woods was firing at him with an unknown weapon. Officer Pira told Officer Talley who was approaching to relieve another officer that he had to stay low because Woods was shooting at them. Woods came out of the house, pointed at Officer Talley, and said, “I see you and I’m going to shoot you!” Woods went back inside and Officer Pira heard another snapping sound and saw Officer Talley grab his right cheek before yelling, “I'm hit!” Officer Talley was bleeding and communicated that he may need medical attention, Other officers were able to safely remove Officer Talley to safety where he received medical attention for a ‘wound that had struck his right cheek approximately 3 inches below his right eye. Woods then came out of the home again and stuck a large 8” fixed blade knife in a wooden railing. Woods yelled, “Send your dog, I will stab him.” Woods continued to antagonize police and tried to lure police to approaching him. Woods yelled things like “Just shoot me and get this over with.” Woods pointed to a canine officer and said, “The next bullet is going to be in your fucking head, you fucking asshole. I'm going to put a round in your fucking head.” Officers saw Woods with a rifle that had a sling and scope attached to it. Woods told officers, “All I need is an inch,” describing how much of an exposed officer he needed to shoot with the scoped rifle. Woods took aim with the rifle through the scope and fired at police several times before crisis negotiators and the SWAT team arrived. ‘When Woods came out of the front door of the residence without the rifle, police deployed a canine, Vito, to make contact with him, Vito engaged Woods, but Woods produced the knife from behind his back and stabbed Vito several times, Fortunately, Woods had not separated the knife from its sheath before stabbing Vito and the dog was unharmed during the incident and withdrawn. V. 8107 ii Crisis negotiators eventually coaxed Woods into coming out of the residence, and he was taken into custody without further incident. iii 2435430-1 Court File Nos Page: 3 of 8 Officers later recovered a .25 caliber Benjamin Trail XL air rifle with a scope from the residence. The rifle contained a tin of .25 caliber pellets. ‘Woods was advised of his constitutional rights and agreed to speak to Sergeant Jensen. Woods said he wanted to die. Woods said Christmastime is really hard and he isn’t happy. Woods said he was trying to provoke police into shooting him, Woods said he shot at police about 4 times with the air rifle he had purchased online. ‘Woods said that his intention in firing upon police was to get police to shoot him. He admitted what he did was wrong. Woods said he has tried to commit suicide too many times in the past to count, NOTICE: Pursuant to Minnesota Statute 609.49, subd. 1 (a) A person charged with or convicted of a felony and released from custody, with or without bail or recognizance, who intentionally fails to appear when required afier having been notified that a failure to appear for a court appearance is @ criminal offense, or after having been released on an order or condition thatthe releasee personally appear when required with respect to the charge or conviction, is guilty of a crime for failure to appear and may be sentenced to not more than one-half of the maximum term of imprisonment or fine, or both, provided for the underlying erime for which the person failed to appear, but this maximum sentence shall, in no case, be fess than a term of imprisonment of one year and one day or a fine of $1,500, or both.
