INSTRUCTIONS TO CANDIDATES
This paper consists of 2 Sections. Section A and Section B.
Section A: Question 1 is COMPULSORY and Answer Any One (1) question from the rest of
the section.
Section B: Question 4 is COMPULSORY and Answer Any One (1) question from the rest of
the section.

Answer FOUR (4) Questions in All.
All Questions carry 35 marks

SECTION A
Question 1 (Compulsory)
Tom wants to buy the book of The Magic Ring by J.R which is due to come on the 23rd
December at 11.00 am at the Latest Book Library. Tom is informed by Latest Book
Library that the price of the book will be Rs 1,500/-. Tom informs Latest Book Library
that he will buy the book but only upon the condition that should Latest Book Library
fail to deliver the book on the 23rd December, Latest Book Library will have to pay Rs
500/- per day till delivery of the book.
Latest Book Library agrees to the proposition of Tom. However, on the 24th December,
the book is still not delivered to Tom. Tom immediately sends a letter requesting the
immediate delivery of the book.
Latest Book Library indeed received the books on the 23rd December but only delivers
the book 8 days after. Tom, who wanted to give this book as a Christmas gift to his
niece of 7 years old, wants to initiate legal actions against Latest Book Library.
Advise Tom, supporting your answer with case law.

Question 4 (Compulsory)
Monsieur Brique a construit une maison tage tout prs dun fil lectrique que le CEB
avait install il y a 26 ans de cela. Cependant, ce fil lectrique nest point isol. Un jour,
Guillaume, le fils de Monsieur Brique, qui est g de 15 ans monte sur le toit de la
maison et laide dun bton en mtal, il touche le fils lectrique. Guillaume est
grivement bless et il est transport durgence lhpital. Les parents de Guillaume
veulent intenter une action au nom du mineur contre le CEB.
Conseillez le CEB, appuyant votre conseil sur un/des arrt(s).

Dezoder qui est g de 15 ans, a assn des coups de poing Mal Sance, un de ses
camarades et la bless. En rentrant la maison, Mal Sance se fait mordre par le chien
de son voisin qui stait chapp.
Conseillez Mal Sance :

sur la responsabilit des parents de Dezoder.

(ii)

sur la responsabilit du voisin.
