UIDAI - IN disarray
UIDAI is the pet project of UPA
government, spending crores of rupees. It
was introduced on 28th January 2009. It
produces 12 digit numbers to those who
registered themselves and was meant as a
means to enhance delivery of welfare
benefits and services. So far, over 700 million
Aadhaar cards had been issued.
The government was making speedy
arrangements then for registering Aadhaar.
Now, the scheme is very much awry posing
a lot ofproblems. The people are distressed S. Ganapathy

pillar to post with a lot of excuses by the government agencies. The
application forms are in short supply, simply saying no stock.
The people are even asked to come for registration after a gap of 4
months which is unfair and time consuming. There are no proper
arrangements and understanding between various functionaries in
many localities. The helpline becomes useless since most of the time,
it does not work. The staff behind the biometric centre are said to be
discourteous and uncooperative. The Directorate of Census Operations
is the primary agency and there are biometric failures in the metropolitan
areas. It is learnt that only 75% coverage is done and 25% coverage
has yet to be completed. With the above challenges and deficiencies,
the Supreme Court was hearing a batch of petitions challenging the
constitutional validity of the scheme as an encroachment into the
citizens rights to privacy.
They reported that the scheme is insisted upon by various
authorities not only by the government departments. Senior advocate,
Gopal Subramaniam averred that even it is insisted for getting the
marriage registered under Special Marriage Act. Senior advocate Anil
Divan complained that Bombay High Court Registrar had received an
official communication for making Aadhaar mandatory for disbursement
of salary to staff and judges. Subramaniam further argued that collection
of personal data under Aadhaar are even done by private contractors
which is not government activity. Even though on the face of it is a
single document, it has linkages of iris scans and biometric data which
are important. If identities are either mistaken or exchanged, that will
pose serious ramifications. It will prone to identity fraud and the
sovereign state has the foremost right to protect its citizenry from the
wrath.
The three Judge bench of the Supreme Court has deplored the
efficacy of Aadhaar making mandatory for all government departments
despite its earlier restraint order issued on 23rd September 2013. The
Court has warned the central and state governments if the scheme is
misused or violated in view of its intrinsic security feature embedded
into it which has to be kept confidential.
The Court has asked the Solicitor General to take up the matter with
all seriousness and write to Chief Secretaries of state and central
governments to implement its interim order in letter and spirit without
any deviation and not to compel Aadhaar mandatory. The said case
will be taken up in the second week of July 2015 and they will review
the constitutional validity of the scheme. Even the government says
that it is not mandatory but implements otherwise indirectly. It is true
that the government is able to save hundreds of crores of rupees in
the distribution of gas by the oil companies and could stop from undue
mischief.
It seems that there is no protection of security features personal
data and biometric data if they are misused. What is the guarantee of
protection by the government? It will be a grievous injury that affect
the fundamental right of a citizen to protect his privacy. To clear all
these misgivings, the government should release a White Paper on all
these aspects with clear explanations and take the people into
confidence. The scheme should be reviewedin all totality taking into
account the courts concerns not to make it mandatory for delivery of
various public services.

the Ministry of External Affairs has waived the requirement for producing original certificates. A press released issued by regional passport
officer K.Balamurugan, said that it has come to the notice of the ministry of external affairs that some passport applicants, especially students, are unable to produce the original certificates which are deposited with educational institutions.
In order to address this problem, the ministry was decided to
waive the requirement of producing original certificates. In such cases,
the passport applicants can submit a certificate from a recognised educational institution stating that he/she is studying in that institution
and that the original certificates are retained with the institution. The
applicants should produce photocopies of such documents duly attested by the educational institution along with a copy of the identy
card issued by the institution.
In case of any doubt about the genuineness of the certificate, the
same will be referred to the issuing authority for verification.
The regional passport office has also decided to accept bank
passbooks for proof of address. In addition to that photo passbooks
of banks authorised by Reserve Bank of India will also be accepted as
proof of address and photo identity.
