The default of defendant Matt McLaughlin having been duly entered, and the Court having

determined that plaintiff Kamala D. Harris, in her official capacity as Attorney General of the

State of California, is entitled to the relief requested in her complaint for declaratory relief based

upon the request for entry of default judgment (form CIV-100) and the memorandum of points

and authorities in support of request for entry of default judgment and evidence submitted in

support of that request, IT IS HEREBY ORDERED, ADJUDGED AND DECREED that:

1. The proposed initiative titled the "Sodomite Suppression Act" (the "Act") is patently
unconstitutional on its face;

2. Any preparation and official issuance of a circulating title and summary for the Act by

the Attorney General would be inappropriate, waste public resources, generate unnecessary

divisions among the public, and tend to mislead the electorate; and

3. The Attorney General is relieved of any obligation to issue a title and summary for the
Act.
IT IS SO ORDERED.
