Dear Mr. Severson:
Section 17-9-0117-B(5) of the Chicago Municipal Code (Ordinance) requires the
Commissioner of Planning and Development to issue one or more Administr
Orders setting throughput limitations and maximum daily amount limitations for
all owners and operators of coke and coal bulk material uses subject to the
Ordinance. This letter shall serve as an Administrative Order to KCBX Terminals
Company (KCBX) with regard to the property at 3259 E. 100" Street, which is
referred to as the North Site.
As you know, in February 2015 KCBX notified the Chicago Department of Public
Health (CDPH) of KCBX’s intention to cease bulk material handling at the North
Site on or before June 30, 2015."
Because of KCBX’s agreement to cease accepting and storing coke and coal
material at the North Site, the City hereby orders that the annual throughput and
maximum daily amount at this site shall both be zero as of June 30, 2015.”
In accordance with Sections 17-9-0117-B(1) and (2) of the Ordinance, future coke
and coal bulk material uses shall not be permitted at this site following suspension
of the current operation on or before June 30, 2015,
