NOTICE OF VIOLATION
Edward C. and Kathy L. Regel:
On or about May 20, 2015, seven trees situated on City of Longmont property located on
the cast side of Terry Street, north of 9th Avenue, were destroyed and removed. As the property
manager who caused this destruction and removal to take place, Regel & Associates, LLC is
jointly and severally responsible for the destruction and removal of these trees.
The Longmont Municipal Code provides:
It shall be unlawful to injure damage, destroy, or remove any tree situated upon
city property,
A. Any person who injures, damages (including by excessive pruning or topping),
or destroys any tree situated upon city property shall repair said damage to the
satisfaction of the director of public works and natural resources or a designee.
B. If the director of public works and natural resources or a designee deems a tree
to be damaged beyond repair, the responsible party shall compensate the city
either the lost monetary value of the tree, as determined by "The Guide for Plant
Appraisal”, published by the Council of Landscape Appraisers, or the cost of
replacing the tree, as determined by the director of public works and natural
resources or a designee.

‘The total value of the trees was therefore $35,630. Regel & Associates, LLC, in
conjunction with any other responsible parties, must compensate the City this amount. Such
compensation may be made by check to the City within ten (10) days of the date of this notice.
This notice may be appealed within ten (10) days of the date of this notice, as described
in section 13.24.170 of the Longmont Municipal Code, by written notice to the City Clerk
objecting to the amount of the assessment and setting forth the reasons why the appeal should be
granted,
The destruction and removal of the trees may also violate other civil or criminal statutes
or ordinances. This notice is unrelated to any action by the City to enforce such other provisions.

Partnership, LLLP is jointly and severally responsible for the destruction and removal of these
trees.
