INCIDENT NARRATIVE

SPECIAL WEAPONS AND TACTICS TEAM SERVED A NARCOTICS SEARCH WARRANT AT THIS LOCATION. SUSPECT WAS ARRESTED FOR NARCOTICS RELATED OFFENSES AND FOR ENDANGERING THE WELFARE OF A CHILD.

NARRATIVE

On 02/11/2010 at 1755 hours, I responded to 1501 Kinloch Court with the Columbia Police Department Special Weapons and Tactics Team (SWAT) to serve a narcotics search warrant. SWAT arrived at the incident location at 2027 hours and approached the residence in the following order:

After the team was positioned outside the front door of the residence Sergeant Schlude announced our presence as Columbia Police Officers and soon after opened the door. As Sergeant Schlude performed this action I heard the sound of a dog barking inside the residence. As the door opened, I observed a dog that appeared to be of a breed known as a "Pit Bull" standing in the threshold of the residence. This particular breed of dog is capable of causing serious physical injury by dog bite. At this particular time the dog appeared to be

a threat to officers as it barked and refused to vacate the structures threshold. I gave the dog a moment to retreat however it remained as a threat and an obstacle to the team and its entry and as a result I fired one-round from my Heckler & Koch 9mm submachine gun at the animal. At this, the animal left the doorway and the team and I made entry into the residence. Once inside, I turned right into a hallway and immediately encountered the suspect identified as Jonathan Whitworth. I observed Whitworth's arms and hands extend over his head and I interpreted this as an act of surrender. I ordered Whitworth to the ground where he was secured in handcuffs. After the residence was secured I informed Whitworth and his wife Brittany Montgomery of the Miranda Warning.Montgomery told me she understood however Whitworth refused to acknowledge me.

After I spoke with Whitworth, I entered the kitchen area and observed the deceased Pit Bull laying in a pool of blood. Animal control was contacted to remove the animal and Officer Fox cleaned to blood using a mop and bucket I located in the garage of the residence.

During a search of the residence, Officers located less than 35 grams of Marijuana and drug paraphernalia inside the residence. The drug paraphernalia included an item known as a one hitter, a marlJuana grinder, and two devices used for smoking marijuana. As a result, Whitworth was arrested for violation of the following Missouri state statutes:

1. 195.235 for possession of drug paraphernalia.

2. 195.202 for possession of a controlled substance for possession of less than 35 grams of marijuana.

Additionally, given that Whitworth's seven-year-old son inside the residence which contained controlled substances in accessible to the child, Whitworth was arrested for violation State Statute:

was areas easily of Missouri

3. 568.045 for endangering the welfare of a child.

Whitworth was transported to the Columbia Police Department where he was booked and processed by Officer Bolinger for these offenses. Whitworth was secured in a holding cell until he was transported to the Boone County Jail.

It should be noted that I contacted the Department of Family Services in reference to Whitworth's arrest for endangering the welfare of a child.

NARRATIVE

#655732 On 02/11/2010 at approximately 1900 hours, members of the Columbia Police Department Special Weapons and Tactics Team responded to the Columbia Police Department reference to serving a search warrant 1501 Kinloch Court.

We were advised the main suspect, identified as Jonathan Whitworth, was at this address and we were doing a narcotics search warrant for controlled substance (schedule one). After receiving our brief, we responded to the address.

Upon arrival, we stacked up at the door and I was second in the stack, making entry into the house. After confirming the storm door and main door to the residence was unlocked, Sergeant Schlude knocked and announced in a loud manner multiple times. The door was then pushed open by Sergeant Schlude. Upon opening the door, I observed a pitbull come to the door barking in an aggressive manner. Officer Cavaner fired his weapon at the dog and we made entry into the residence. Upon entering the residence, I proceeded north through the residence then made a left turn into the kitchen area. Upon going into the kitchen area

I observed a red pitbull standing between the island and the wall near the access to the garage area. I observed the dog was standing sideways with its ears pinned back and postured in an aggressive manner looking directly at me. Believing the dog was about to attack me, I fired one round of my MP5 at the pitbull, hitting its intended target. The dog yelped and then ran towards the storm door area of the kitchen as I proceeded into the garage door area. Upon going into the garage I observed glass marijuana pipes sitting on a shelf in the garage. I further observed duffle bags in the attic access of the garage.

This report should be routed to the State Prosecutor's Office.

NARRATIVE

#655644 On 02/11/2010 at approximately 2030 hours, Columbia Police Department Special Weapons and Tactics (SWAT) Team conducted a search warrant at 1501 Kinloch Court, Columbia, Missouri.

My responsibility on the search warrant was to open the storm door, and then form part of the "Stack" clearing the residence.

The SWAT Team arrived at the target at approximately 2027 hours, the storm door was unlocked and I opened it for other members of the SWAT Team to enter the residence,after Sergeant Schlude had knocked and announced the search warrant. The main doors to the residence was also unlocked and was opened by Sergeant Schlude.

As the Stack crossed the threshold they were met by two aggressive pit Bull dogs. Columbia Police Officer Mike Cavener fired one round at this point, see his main report for further information.

As the Stack entered the residence, I entered into the residence and turned towards the kitchen area. As I entered the kitchen area I heard a shot, which I now believe came from Columbia Police Officer Thomas Quintana fired a round at the Pit Bull which had pursued him into the kitchen. The Pit Bull around the far side of a circular dinning table in the kitchen area. I was on the opposite side of the table at this time. The pit Bull came around towards me. I reasonably believed the Pit Bull presented a clear present and imminent threat of serious physical injury, knowing pit Bull dogs to be capable of causing physical injury by dog bite. The dog was wounded, barking, and moving directly towards my legs at this point.

Using my department-issued Heckler & Koch MP5, I fired one-two-round burst into the head of the pit Bull as it moved towards me. The shots were fired with the intention of preventing the dog from closing in on me and biting me. The shots had the desired effect of stopping the dog immediately which fell to the floor instantly. The animal did not get up or move again from that point.

Upon completion of serving the search warrant Animal Control responded to the scene, they removed the dog's caracas from inside the house. I cleaned up the pools of blood that were in the kitchen dinning area using a mop and other cleaning materials that were found in the house.

Photographs of the deceased dog and the blood were taken by Columbia Police Officer Jill Wieneke. Further photographs were taken after we had cleaned up the blood.

On 02/11/2010 at 2027 hours officers of the Columbia Police Department Special Weapons and Tactics Team served a narcotics related search warrant at 1501 Kinloch. For further information please see Officer Cavaner's original report.

Upon arrival, I was in the number eight position in the stack. I covered the front windows while other officers made entry into the residence. Upon entering the residence, I turned to the right and encountered the suspect laying on the floor with Officer Cavaner. Once we were able to secure the suspect, Officer Cavaner and I continued our preliminary search of the residence. Upon securing the residence, I assisted in the search. I searched the main bathroom and a portion of the office on the southern portion of the

On 02/11/2010 at 1900 hours, I organized and supervised the execution of a narcotics search warrant at the address of 1501 Kinloch Court. I reviewed a copy of the search warrant which was for a schedule one controlled substance listing the suspect as a Jonathan Witworth, age 25, residing at the address of 1501 Kinloch Court. The warrant was obtained by Detective Ron Hall. After reviewing the search warrant itself I then began to organize members of the Special Weapons And Tactics Team to serve the search warrant.

Columbia Police Department. It is there that I reviewed the tactical entry plan with my team members. I completed a tactical entry plan and discussed the operation with team members. I provided officers their assignments and additional duties regarding the execution of the search warrant. After the plan was discussed we then conducted several rehearsals, practicing our approach and breaching of a door, simulating that of our target address. Once our rehearsal had been completed we then responded to the address of 1501 Kinloch Court arriving there to execute the search warrant at approximately 2027 hours.

In addition to my supervisor responsibilities I was responsible for communications as well as utilizing the ram in the event that the primary point of entry was secured. Once officers were at the door I then positioned myself as planned on the right side of the door. It is there that I checked the storm door determining if it was locked or not. I found the storm door unlocked. I then pulled the door open and Officer Fox held the door open with his body.

I then tried the secondary door finding that the door itself was also

unlocked and that a forced breach was not necessary in this case. I communicated my findings to the team. I knocked a total of three times and announced twice,"Columbia Police Department Search Warrant." Ass I

began knocking I immediately detected the sound of dogs growling and barking just on the inside of the door. I communicated this to my team that dogs were present at the door. At the time officers were going to enter the residence I then pushed the door open and observed two dogs in the doorway barking and growling.

I communicated to Officer Cavener to enter the residence. discharged his firearm at the dogs which presented an obstacle or team. I also communicated that one of those dogs was a pitbull. entered the residence in order to locate suspects at this point.

I entered into the residence itself and began to move towards the kitchen area. It is there that I observed still in a mobile state and acting aggressive was a brown/red in color pitbull. That animal circled a kitchen table and began to once again move towards officers in the residence rather than retreating away. Officer Fox was to my right. Officer Fox and I

were in a position to prevent the dog from circling around to the other team members. Once I observed a clear and safe shot at the dog I then discharged my department issued handgun firing three times hitting the dog in the side and chest area. After my shots were fired the dog stopped any further aggression or advancement and was dead. I then began to contact officers throughout the residence who were still in the process of taking a suspect into custody. I observed a child and a female who were led from the residence by officers to the front of the residence. The primary suspect Jonathan witworth was present who was taken into custody.

I arranged that the female and the juvenile were provided shoes and a blanket in order to stay warm. They were brought to a patrol vehicle where they were constantly monitored by officers. No citizens or officers were injured in this incident.

I contacted Joint Communications and requested that an on-duty Lieutenant respond to our location. Lieutenants Richenberger and Young responded to our scene. I debriefed Lieutenant Richenberger and Lieutenant Young on what had occurred inside of the residence. I continued to monitor and supervise the activities that took place at the residence. I approved that officers may attempt to clean the blood from the kitchen floor which came from the pitbull. Officers were able to adequately clean the remains of the dead dog from the kitchen floor. Once the residence had been completely searched, evidence seized and officers had completed their duties I recontacted the female and juvenile child, led them back into the residence, provided them with a copy of the search warrant and an inventory of what was seized from the residence. I communicated to them that we had cleaned a significant amount of the blood from the kitchen floor area.

No citizens or officers were injured in this incident. The purpose of the firearm use of force was to protect officers and end the officer threat. I am aware that pitbulls have a potential to cause serious physical injury and in some extreme cases death. The use of force was effective with the desired outcome.

This had been referred to the Boone County Prosecuting Attorney's

Office.

On 02/11/10 I assisted the Columbia Police Department S.W.A.T. team with the service of a narcotics related search warrant at 1501 Kinloch Ct. My assignment was to video tape the team's entry with a hand held digital camera.

I activated the camera as officers approached the residence, made entry and continued taping until the listed suspect, Jonathan Whitworth, was advised of his rights pertaining to Miranda.

I also assisted in the search of the residence. In the master bedroom closet I saw a personal safe. Off. Hedrick had obtained the combination to the safe from Mr. Whitworth. Immediately upon opening the safe I detected the overwhelming odor of fresh high grade marijuana, however no marijuana was found inside the safe.

The recording of S.W.A.T's entry was downloaded to DVD format and placed into evidence. A second copy was made and handed to Sgt. Schlude, the team leader for this warrant service.

On 02/11/2010 at approximately 2030 hours I assisted the Columbia Police Department Special Weapons and Tactics Team with the service of a search warrant at 1501 Kinloch Court Columbia, Missouri. I had been advised during briefing we would be searching for evidence of the crime of drug trafficking, specifically marlJuana. After being notified by SWAT officers on scene that it was safe for me to respond into the residence I arrived and began photographing the scene. I was advised that officers had shot and killed a dog at the residence and that another dog had been injured. I located a 9mm shell casing on the front porch of the residence and six more 9mm shell casi~gs in the kitchen of the residence. These casings were all photographed and collected as evidence. The following evidence was located and seized from the residence:

1) Marijuana grinder located in the living room

2) One hitter marijuana pipe located in the living room

3) Plastic baggie containing marijuana in the living room

4) Glass marijuana pipe located in the garage

5) 7 shell casings located on the front porch and kitchen of the residence

6) A box containing three marijuana pipes in the master bedroom

7) Plastic baggies located in the master bedroom closet

8) An iPhone located in the living room

9) Marijuana seeds located in the living room

I photographed, identified, labeled, and packaged these items and placed them into evidence at the Columbia Police Department. While searching the master bedroom closet I did locate a safe in the back. The interior of the

safe had a strong odor of marijuana. Prior to leaving the residence I left a copy of the search inventory list with a copy of the search warrant.

On February 17, 2010 I returned the original search warrant and inventory to the Boone County Circuit Clerk's Office and received stamped copies of each. These copies are attached to this report. Nothing further at this time.
