09-08-06 USC Credit Union: False and deliberately misleading record production - December
15, 2008 Minutes of the Board of Directors.

The minutes were requested following claims by Gary Perez – President of the Credit Union, that he was
authorized to act a Custodian of Records. Under such false claims, Gary Perez produced on June 26, 2008
false and deliberately misleading banking records.

The conduct and the records pertaining to the June 26, 2008 production are alleged as financial institution
fraud, in and of themselves.

Consequently, on August 6, 2009, the December 15, 2008 Minutes were produced by USC Credit Union, as
purported evidence of the appointment of Gary Perez – President of USC Credit Union as Custodian of
Records. However, the December 15, 2008 were produced with the signatures of the Chairman and the
Secretary of the Board “redacted.”

Such records, and the conduct associated with the August 6, 2008 production of records are alleged as
financial institution fraud, in and of themselves.

Consequently, Jerry Jellison – Chairman of the Board was requested to authenticate the December 15, 2008
Minutes, purported to bear his signature. No response at all was received by Jerry Jellison.

Dr. Zernik,

Thank you for your e-mail. I apologize for my delayed response.

Per your request, a copy of the relevant portions of the Board of Directors Minutes in which Gary was
appointed as Custodian of records are attached. Due to the sensitivity of the information contained
within the document, most of the areas are blacked-out, with the exception of the information you
requested.

Please note that who is acting as or appointed to the position of Custodian of Records at any given
time is an internal Credit Union matter. Nonetheless, Gary Perez, or one of his delegates, has acted
as our Credit Unions Custodian of Records for many years and as indicated in the attached minutes,
Gary was formally appointed to that position by the Board of Directors in December 2008.

To my understanding, an organizations Custodian of Records should be an individual who is qualified

to certify business records, if certification is required under the Evidence Code, and to whom
subpoenas and other legal processes may be directed by those entitled to do so under the Code of
Civil Procedure. Currently, Gary is acting Custodian of Records for our Credit Union, but this may
change at any time without notice.

With this in mind, I believe your statement that Gary may not act as our Custodian of Records is
incorrect. Please let me know if you have information to the contrary. Otherwise, I will have to consider
your inquiries regarding this matter as closed.

For future reference, I will be happy to provide responses in connection with our Custodian of
Records, only if we believe we have a legal obligation to do so.

Mr Ramirez:

To the best of my understanding of the law, Gary Perez cannot be the Custodian of Records of
USCCU.

Could you please refer to a specific date on which the Board of Director made a decision to appoint
him as Custodian of Records?

I would also request to get a copy of the decision on that date of the Board of Directors, stating that the
board was appointing Mr Perez Custodian of Records.
