awarded a public contract, concluding a framework contract or being included in the
dynamic purchasing system or a system of establishing capability, and who suffer or could
suffer damages due to the alleged infringement. It is deemed that interest in being awarded
a public contract is demonstrated by a person who submitted their tender in due time, and if
the time limit for submitting tenders has not expired yet, any person capable of performing
the activity necessary to carry out the object of public procurement.

An application may be submitted by the contracting authority, the tenderer, in the case of a
joint tender any of the tenderers, the candidate, in the case of a joint request to participate
any of the candidates, or any other interested person whose right or legitimate interest is
being harmed or risks being harmed by an activity or default which is in conflict with this Act.
Undertakings have a right to the provisions concerning the award procedure being complied
with by the contracting entity.
Every undertaking which has an interest in the contract and claims that its rights under
97 (7) were violated by non-compliance with the provisions governing the awarding of
public contracts has the right to file an application. In doing so, it must be shown that the
undertaking has suffered a loss, or may be about to suffer a loss, in consequence of the
alleged violation of provisions governing the awarding of public contracts.

Regardless of the submitted review claim, the contracting authority may continue the public
contract award procedure, but it may not conclude the contract, stop the public procurement
procedure, reject all tenders or start a new public procurement procedure for the same
procurement object When receiving a review claim, the contracting authority may adopt
a decision that the public contract award procedure is withheld until the decision of the
National Review Commission. When submitting a review claim, the claimant may forward
its proposal to suspend the public contract award procedure to the contracting authority
After receipt of a review claim or any time during the pre-review or review procedure the
contracting authority shall address, to the National Review Commission, a proposal to
adopt a decision to allow, despite the submitted review claim: Conclusion of the contract, or

When a proceeding is launched by the Public Procurement Arbitration Board, the contracting
authority may suspend the ongoing contract award procedure and it shall notify the Public
Procurement Arbitration Board to this effect. The suspension shall extend any time limits
running by the duration of the suspension period In an ongoing review procedure the Public
Procurement Arbitration Board may, on request or ex officio, order interim measures until
the conclusion of the contract in the contract award procedure (or purchase) involved in
the review procedure, if, taking into account all circumstances in the case in question, it is
probable that an infringement of the rules of this Act or principles has been committed or
a risk thereof exists. As an interim measure, the Public Procurement Arbitration Board shall
(a) order the suspension of the contract award procedure or (b) call upon the contracting
authority involved in the contract award procedure to invite the applicant seeking a remedy
to take part in the contract award procedure. Due to an extremely important interest
allowing no delay or to the protection of public interest (including the reason of national
economy) the Public Procurement Arbitration Board may allow the conclusion of the
contract in its decree upon the request of the contracting authority if the benefits exceed
the drawbacks of the conclusion of the contract. The extremely important interest allowing
no delay or the public interest (reason of national economy) shall be stated in the application
and the documents proving the grounds for the application shall be submitted together with
the application. For the purposes of this paragraph, public interest means in particular the
maintenance of the uninterrupted security of conduct of the public utilities activity. For the
purposes of qualified contract award procedures and contract award procedures in the field
of defence, the public interest is in particular interest related to defence or security/.

If the public procurement tribunal informs the contracting entity in writing about the
application for review, the latter must not make the award prior to the decision of the public
procurement tribunal and before the expiry of the period for a complaint An immediate
complaint shall be filed in writing with the appellate court within a non-extendable time limit
of two weeks beginning upon service of the decision The immediate complaint shall have
a suspensive effect upon the decision of the public procurement tribunal. The suspensive
effect shall lapse two weeks after the expiry of the time limit for the complaint. If the public
procurement tribunal refuses, upon application, to review the award, the appellate court may,
upon application by the complainant, extend the suspensive effect up to the time of the
decision on the complaint... The public procurement tribunal may allow the contracting entity
to award the contract after the expiry of two weeks after the announcement of this decision
if, taking into account all interests which may be impaired as well as the interests of the
general public in the quick conclusion of the award procedure, the negative consequences
of delaying the award until the end of the review outweigh the advantages involved. In
its assessment, the public procurement tribunal shall take account of the interests of
the general public that the contracting entity carries out its tasks efficiently. The public
procurement tribunal shall also consider the overall prospects of the applicant to win the
award in the award procedure. The prospects of success of the application for review need
not be taken into account in every case. The appellate court may, upon application, reinstate

The following entities may initiate a preliminary dispute settlement:
the tenderer or the candidate, within 3 business days after having knowledge of the illegal
event, if it considers that the written summary or any procedural act of the contracting
authority or any other document made during the contract award procedure, except for
those listed in point (b), is partly or completely illegal;
any interested economic operator or the chamber or the interest representation body with
an activity related to the subject-matter of procurement (for the purposes of this Article,
hereinafter jointly referred to as applicant) not later than ten days before the expiry of
the time limit to submit tenders or to participate, in accelerated procedures or negotiated
procedures without prior publication of a contract notice launched for extreme urgency until
the expiry of these time limits, if he considers that the contract notice, the invitation to
tender, the invitation to participate, the documentation or the modification thereof is partly
or completely illegal.
The applicant shall state in his application to the contracting authority (hereinafter referred to
as preliminary dispute settlement application) the points of the written summary deemed
unlawful, or other document, or procedural action, furthermore his recommendations,
remarks, and the data and facts and supporting his opinion and he shall also refer to the
documents if any supporting such data and facts.
The preliminary dispute settlement application shall be dispatched to the contracting
authority by fax or electronic means, and the contracting authority shall inform the applicant
for settlement about its standpoint regarding the application not later than three days
after the reception of the application by the means identical to that of the submission,
furthermore the contracting authority shall inform all tenderers or candidates known by it
participating in the procedure about the submission of the preliminary dispute settlement
application and his answer to it.
Where the infringement of law committed in the procedure is remediable through these
procedural acts, the contracting authority may require on not more than one occasion,
not later than three business days after the reception of the preliminary dispute settlement
application the tenderers (candidates) to supply missing information (Article 67), to
provide information (Article 67) or an explanation (Articles 69-70), setting a time limit of
three business days, even if the procedural rules would not allow to do so. In this case
the contracting authority shall inform the applicant for settlement and the tenderers
(candidates) about the submission of the application for preliminary dispute settlement on
the date of dispatch of the request for the supply of missing information or for the provision
of information or for explanation, and he shall inform these entities about his answer to the
application not later than seven business days after reception of the application.
If a tenderer has submitted a preliminary dispute settlement application in connection with
a procedural act done, document made following the opening of tenders within the time
limit pursuant to paragraph 1 and in compliance with paragraph 2, the contracting authority
may not conclude the contract if division into lots was possible, he shall not conclude the
contract on the part of procurement concerned before the end of a period of ten days
from the date of submission of the application, following the date of dispatch of its reply,
even if the standstill period would otherwise expire until that date.

Section 28/a:
The authority shall maintain communication with clients:
a) in writing;
aa) via the postal service,
ab) by way of electronic means construed as provided in writing, including fax,
ac) through documents delivered in person,
ad) via an agent for service of process,
ae) through the authoritys process server,
af) through the administrator for service of process,
ag) by way of public notice; or
b) orally:
ba) in person,
bb) electronically, via an audio link, including telephone connection; or
c) by way of electronic communication by means other than writing.
Section 28/d:
a) Where so authorized by an act or government decree, the authority shall be entitled to
communicate with clients - in cases that concern a significant number of clients - by way
of public notice, excluding the notice for the opening of proceedings and rulings addressed
personally to individual clients.
b) At the clients request, the authority shall use other means of written communication to
deliver its decisions to the client.
c) Significant number of clients shall mean where at least fifty clients are involved at the
time of the opening of the proceedings. The number of clients involved may be increased
by an act or government decree as a precondition for communication by way of public
notice.
Decisions of the cartel authority shall contain a statement of reasons and be served together
with advice as to the available legal remedies upon the parties pursuant to the provisions of
the Act on Service in Administrative Procedure.

Administrative acts which conclude the formal proceedings must be in written form, must
contain a statement of grounds and be sent to the participants; in cases referred to in
section 39, paragraph 2, nos. 1 and 3, no statement of grounds is required. An electronic
administrative act as described in sentence 1 shall be provided with a permanently verifiable
qualified electronic signature. Where more than 50 notifications have to be sent, this may be
replaced by public announcement. Public announcement shall be effected by publishing the
operative part of the decision in the official bulletin of the authority, and also in the local daily
newspapers with circulation in the district in which the decision may be expected to have its
effect. The administrative act shall be deemed to have been delivered two weeks from the
day of publication in the official bulletin, which fact shall be included in the announcement.
After public announcement has been made and until the period for appeal has expired, the
administrative act may be requested in writing or electronically by the participants, which
fact shall also be included in the announcement.
