‘On 5-23-16, Chief Washburn gave Sgt. Meyers a complaint that was given to him via email, The
complainant was Rhonda Aills, manager of Applebees. Her email entailed that she had called the Police on
\5-22-16, around 6:00am in regards to a possible impaired driver on their back lot. The person was
|unresponsive to their attempts to awaken him, and vomit was on the ground next fo the door.
The email continues that she felt the officer that arrived did not do her job in the fact that she did not
['check™ him out and he was allowed to drive away.
‘On 5-23-16, Sgt. Meyers went to Applebees and interviewed Ms. Allls._Shé states the car was parked on
fhe back lot, and per their policy, was not supposed fo open the store with cars on the lot, Instead of
immediately calling the police, herself and another employee, Ms. Yoakum approached the car and
lobserved a man asleep in the drivers seat, with the seat reclined backward. There was vomit outside the
|driver’s side of the car on the ground. Ms. Aills stated that she knocked on the window, but the person did
|not wake up.
Mis. Aills then called the police. Upon the officers arrival, she observe the female officer, exit the patrol
|ear and approach the passenger side. The officer opened the door, spoke to the driver. The officer walked
laway, got into the cruiser and drove off. Ms. Aills advised no field sobriety checks were performed, and the
linteraction only lasted a few seconds. Sgt. Meyers offered her a written statement form to fill out, which she
refused to fil out. She ‘stated she only wanted the Police to know that an officer had done sub standard
rk and felt it was Necessary to let us know that the officer could have done a better job.
‘On 5-24-16, Sgt. Meyers and Det. Lytle interviewed Ofc. T. Gannon. Ofc. Gannon acknowledged being
ldispatched to Applebees on a possible impaired driver on the lot. Upon her arrival, she observed the small
lorange car, possibly Ford Focus on the back fot. She noted vomit on the ground on the drivers side and
Iperformed a passenger side approach. She opened the passenger door and shouted "hey buddy what is
\going on." The man sat up, acknowledged her and appeared coherent as well as not showing any signs oF
intoxication or impairment. The man told her he had fallen asfeep in the car around 1:00AM, and was
sleeping an evening of drinking off.
‘Ofc. Gannon states she spoke to the man for over a minute. She then got back into her cruiser and put
"goa" inthe MDT. She also told other units responding to disregard. Ofc. Gannon then drove off, and the
lunknown man drove off following her. Ofc. Gannon had looked in her mirror and appeared the person was
ldriving fine.
Further investigation found that Ofc. Gannon did not use her body camera or cruiser cameras as directed
lby policy. Ofe. Gannon also did not gather license plate information from the vehicle, or ID from the
uspected driver._Gannon made the stalement she thought the tag number was on the call screen

Case manager Review:[Ofe. Gannon denies knowing the driver. When asked about not using the cameras, she replied that|
|she forgot to activate them. When asked about why “goa” was entered into comments, she was of
lthe understanding that when she types that in, it transmits to other officers the comments she made,
land that would tell them the vehicle was gone on arrival.
‘When asked why she would tell another officer to disregard she advised it was a two part reason.
ist, the site and smell of the vomit made her nauseated. The other reason was thal she had just
received notification that she was not going to be able to adopt a child that she was supposed to
jave adopted in June. The message had just been delivered to her, and she was upset. She
[stated she was emotional as well as crying and did not want anyone Seeing her like this.
‘Gannon admits she "jacked it up" and made a series of bad decisions.
Carol Yoakum, Applebee employee advised she went to the car with Ms. Aills. When asked how.
hard they had knocked on the window she advised it was very light as they didn't want to startle the
\driver. Carol states the officer spoke to the driver for over a minute before leaving.
Pam Hettinger, night time manager at Aplebees was also contacted. She states in the morning
of 5-22-16, at approx. 2:00AM, she observed a Subject walk across the parking lot and get into the
\vehicle. Hettinger made the comment, she hoped the person wasn't intoxicated and would drive
lof. Ms. Hettinger did not call the police. She could provide no description of the person.
|Ofe. Brown, the dispatcher for the event, states Applebees employees called about a possible
impaired driver passed out. He did not receive any tag information and dispatched Gannon and
Netter to the scene. Ofc. Brown states he did not engage in any non-deparimental phone or text
[communications in regards to the incident. There were no departmental calls as well.
5. Netter states he was dispatched to the call_ While en route, was advised to disregard by Ofc.
|Gannon, which he did. He did drive through the lot, but Gannon had already left
‘A check of AVL, the departmental GPS system on the cars, showed Ofc. Gannon arriving on the
lot, Taking into consideration some lag in the system, appeared to be there slightly over a minute.
[As of this summary, we have requested video from BP, and have received nothing back.
|_0n 5-22-16, Ofc. Gannon was assigned cruiser 16, and Body Camera 6._According to Of
jannon the eruiser-camera in-car-16 was functional at the time of assignment. —
