COUNTY OF ELMORE Before me, Judge Glenn Goggans, District Judge of Elmore County Alabama, the undersigned duly sworn, deposed and states: “My name is Mike Hafley. | am a Detective with the Wetumpka Police Department where | have been employed for 3 years and 3 months.” ; Affiant further states that he has reason to believe, probable cause to believe and does believe Lynwood Keith Golden used email, phone and other electronic communication equipment to solicit other internet | users to flood the Wetumpka Police Department Communications Center with phone calls forcing the system to be incapacitated for dally duties to include responding to emergency alarm, fire, medical and police services. Directions are as follows: | Begin at the intersection of Coosada Parkway and Coosada Rd in Coosada, Turn right on Coosada Rd, ! heading towards Millbrook. Take a right on Kennedy Ave and travel to the first right, Pontiac Ln. Turn ' right on Pontiac tn then turn left on Choctaw. After turning left on Choctaw, take the first right on | Tacoma, then turn left on Coosada Ln. The house is the third on the right, facing Coosada La, inside of a | silver chain link fence. The house address is 260 Coosada Ln, Coosada, AL, located in Elmore County. ‘The house is red brick with blue shutters and a white door. | The facts tending to establish the foregoing grounds for the issuance of a search warrant are as follows: ‘On 06/03/2016, the above listed individual posted a video on the Internet about the Wetumpka Police Department along with phone numbers and email addresses of the Wetumpka City Hall, the Wetumpka | ity Attorney, and the District Attorney's Office. The individual also shared the video with an affiliate, |, News Now Houston/ David Warden, who instructed others to make phone calls and send emails in an «effort to “flood” the communications system of the Wetumpka Police Department. In the days | following, the Wetumpka Police Department answered several hundred phone calls from people as far ! away as Canada that have no relevance to the day to day activities of the police department. Most of | these calls were computer generated, spam calls. These calls kept every line at Wetumpka Police {Department occupied throughout the day. ll ofthese calls had to be answered by 911 dispatchers, which limited the dispatcher’s abilities to answer calls from the general public which rely on this service for emergencies, These intentional actions forced the police department to shut down its primary contact lines to allow dispatchers to field emergency calls. Numerous types of general cals for service | were affected by this shut down which include: alarm calls for residents and business owners, general calls for service for the City of Wetumpka and non-emergency calls for the Wetumpka Fire Department wast yh aes sania Meat Sore “Tre and Haynes Ambulance. This also forced the shutdown of the domestic violence shelter of the police department. Based on the great number of calls resulting from the Internet posts by Lynwood Keith Golden and the affiliate, News Now Houston/ David Warden, | believe that evidence of a conspiracy to interfere with faw enforcement communication will be found in electronic communications in Lynwood Keith Golden's possession including email, phones, and other electronic communications. {In my experience as a law enforcement officer, | know tablets, phones and other electronic communication equipment to be hidden and/or stored in vehicles, small compartments, outbuildings and other structures to be concealed from law enforcement. | have personally observed the listed property and observed numerous locations where this evidence can be hidden and/or stored on the premises. (a) For the purposes of this section, “public safety communication” means any radio signal, electronic transmission, telephone communication, or broadcast, intended for law enforcement, fire service, 911 personnel, or emergency personnel acting in an official capacity under color of law, which is transmitted or received by any equipment or system capable of either receiving or transmitting telephone ‘communication, radio signals or other electronic transmissions on a wavelength, frequency, or channel allocated by the Federal Communications Commission or otherwise for use by law enforcement, fire service, 911 personnel, or emergency personnel. (b) Except as provided in subsection (c), a person commits the offense of intérference with public safety communication if the person does any of the following: (1) Knowingly and intentionally displaces, damages, removes, injures, tampers with, destroys, or renders inoperable any transmitter, receiver, transceiver, tower or antenna, or any cable, telegraph of telephone line, or equipment, wire, fiber, pole, computer equipment, telecommunication switch, dispatching equipment, or conduit belonging to, required, used, or intended to be used for public safety communication, or material or property appurtenant thereto. (2) Knowingly and intestionlly displaces, damages, remove, injures, tapers with, destroys, or renders inoperable ‘any abl or visual devie or outdoor speaker or siren which i iatended to indiscriminately provide or generate ‘mass noifieaton alert, or warning of persons in the evet ofan emergency, o the mattal or property sppurtenan thereto, (3) Knowingly and intentionally interferes with the transmission or reception pf any data, conumunication, message, or public safety service, 911 personnel, or emergency service. fulfillment of its duties. (4) Knowingly and intentionally operates, or permits to be operated, any apparatus in his or her possession, or under his or Ber direct or indlret contr, which is capable of transiting radio signals or telephone communications that interfere with or cause disruption of a public safety communication. (8) Knowingly sod intentionally intercept any transsssion safety communication which is encrypted for the purpose of preventing the unauthorized access to sensitive formation. (©) Subsection (b) does not apply to any of the following: (1)A certified law enforcement officer acting under colo of law in performance of is or her duties. 2) Any officer, operator, employee, o agent acting in an oficial capacity on behalf of un agency, authority, or ‘organization which maintains or oversees public safety communicaton activities or equipment ()A person who has permission in writing from the head of a lw enforcement, fire service, public safety, or ‘emergency service agency or organization to possess and use any radio transceiver or apparatus capable of ‘uansniting or receiving messages or signals within a wavelength, channel, o talkgroup assigned tothe agency ‘granting the permission. (4) Any utlty personnel acting within the scope of his or her duties, (3) Any wireless telecommunications cartier employee acting within the scope of his ar her duties or in good faith reliance on anintereept court order. ‘Possessed or used in violation of this section, and upon cohviction of the person ing or using the ‘equipment, the court shall order such equipment destroyed or forfeited to the:State of Alabama or t0 the ‘authorized jurisdiction making the arrest and prosecution of the offense.
