alternatewinnerifaffidavit/releaseisnotreturnedwithin5daysafterdateitissentto
thepotentialwinner,ifprizenotificationorprizeisreturnedasundeliverable,inwhich
casetheoriginallyselectedwinnershallnolongerhaveanyrighttotheSweepstakes
prize.ThewinneragreestoSponsorsuseofher/hisname,photograph,likeness,voice,
biographicalinformation,statementsandaddress(cityandstate),andanyother
informationprovidedtoSponsorforadvertisingand/orpublicitypurposesworldwidein
allformsofmedianowknownorhereafterdeveloped,inperpetuity,withoutfurther
compensationorauthorization,totheextentpermittedbylaw.

7.ARBITRATIONPROVISION:ByparticipatinginthisSweepstakes,eachentrant
agrees:(i)thatanyandalldisputestheentrantmayhavewith,orclaimsentrantmay
haveagainst,theSponsor,itsparentcompanies,affiliates,subsidiariesandagents
relatingto,arisingoutoforconnectedinanywaywith(a)theSweepstakes,(b)the
awardingorredemptionofanyprize,and/or(c)thedeterminationofthescopeor
applicabilityofthisagreementtoarbitrate,willberesolvedexclusivelybyfinaland
bindingarbitrationadministeredbyJAMSandconductedbeforethree(3)arbitratorsin
accordancewiththerulesofJAMS (ii)thisarbitrationagreementismadepursuanttoa
transactioninvolvinginterstatecommerce,andshallbegovernedbytheFederal
ArbitrationAct(FAA),9U.S.C.116 (iii)thearbitrationshallbeheldinLosAngeles
County,California (iv)thearbitratorsdecisionshallbecontrolledbythetermsand
conditionsoftheseOfficialRulesandanyoftheotheragreementsreferencedherein

thattheapplicableentrantmayhaveenteredintoinconnectionwiththeSweepstakes
(v)thearbitratorshallapplyCalifornialawconsistentwiththeFAAandapplicable
statutesoflimitations,andshallhonorclaimsofprivilegerecognizedatlaw (vi)there
shallbenoauthorityforanyclaimstobearbitratedonaclassorrepresentativebasis,
arbitrationcandecideonlyentrantsand/orSponsorsindividualclaims thearbitrator
maynotconsolidateorjointheclaimsofotherpersonsorpartieswhomaybesimilarly
situated (vii)thearbitratorshallnothavethepowertoawardpunitivedamagesagainst
theentrantorSponsor (viii)intheeventthattheadministrativefeesanddepositsthat
mustbepaidtoinitiatearbitrationagainstSponsorexceed$125USD,andentrantis
unable(ornotrequiredundertherulesofJAMS)topayanyfeesanddepositsthat
exceedthisamount,Sponsoragreestopaythemand/orforwardthemonentrants
behalf,subjecttoultimateallocationbythearbitrator (ix)iftheentrantisableto
demonstratethatthecostsofarbitrationwillbeprohibitiveascomparedtothecostsof
litigation,Sponsorwillpayasmuchofentrantsfilingandhearingfeesinconnection
withthearbitrationasthearbitratordeemsnecessarytopreventthearbitrationfrom
beingcostprohibitive and(x)withtheexceptionofsubpart(vi)above,ifanypartofthis
arbitrationprovisionisdeemedtobeinvalid,unenforceableorillegal,orotherwise
conflictswiththerulesofJAMS,thenthebalanceofthisarbitrationprovisionshall
remainineffectandshallbeconstruedinaccordancewithitstermsasiftheinvalid,
unenforceable,illegalorconflictingprovisionwerenotcontainedherein.If,however,
subpart(vi)isfoundtobeinvalid,unenforceableorillegal,thentheentiretyofthis
arbitrationprovisionshallbenullandvoid,andneitherentrantnorSponsorshallbe
