Article 14 (Equality before law):

Article 14 says that state shall not deny to any person equality before the law or the equal
protection of the laws within the territory of India.

Art. 14 is available to any person including legal persons viz. statutory corporation,
companies, etc.

Art. 14 is taken from the concept of equal protection of laws has been taken from the
constitution of USA.

The concept of rule of law is a negative concept while the concept of equal protection of
laws is a positive concept.

The concept of equality before law is equivalent to the second element of the concept of
the rule of law propounded by A.D. dicey, the British jurist. But certain exceptions to it are,
the president of India, state governors, Public servants, Judges, Foreign diplomats, etc.,
who enjoy immunities, protections and special privileges.

Legitimate expectation:-

"What is legitimate expectation? Obviously, it is not a legal right. It is an expectation of a


benefit, relief or remedy that may ordinarily flow from a promise or established practice. The
term 'established practice' refers to a regular, consistent predictable and certain conduct,
process or activity of the decision-making authority. The expectation should be legitimate,
that is, reasonable, logical and valid

Evolution in India
As already stated that the Doctrine of "Legitimate Expectation " is not a legal right in itself
embedded in some statute of Code readily available for its inference and applicability.
However it is a right to be treated fairly and the same has been fashioned by judicial
precedents of various courts over a period time and is still in its evolving stage.
