PER CURIAM:
Appellant appeals from the district court's order denying relief on his 28 U.S.C.
Sec. 2254 (1988) petition. Our review of the record and the district court's
order adopting the recommendation of the magistrate judge discloses that this
appeal is without merit. Accordingly, we affirm on the reasoning of the district
court and the magistrate judge.* Govostis v. Smith, No. CA-93-4027-HAR (D.
Md. July 29, 1994). We dispense with oral argument because the facts and legal
contentions are adequately presented in the materials before the Court and
argument would not aid the decisional process.
AFFIRMED.
Appellant attempts to raise on appeal a claim that the conviction counts were
not merged as required by state law. Because the issue was not presented to the
district court, it is not properly before us. Singleton v. Wulff, U.S. 106, 120
(1976)
