WHEREAS,theincorporationofthisrightintheConstitutionisarecognitionofthe
fundamentalroleoffreeandopenexchangeofinformationinademocracy,meantto
enhancetransparencyandaccountabilityingovernmentofficialacts,transactions,or

allexecutivedepartments,bureausandoffices,andthedutytoensurethatthelawsbe
faithfullyexecuted
WHEREAS,theDataPrivacyActof2012(R.A.10173),includingitsimplementingRules
andRegulations,strengthensthefundamentalhumanrightofprivacy,andof

NOW,THEREFORE,I,RODRIGOROADUTERTE,PresidentofthePhilippines,by
virtueofthepowersvestedinmebytheConstitutionandexistinglaws,doherebyorder:
SECTION1.Definition.ForthepurposeofthisExecutiveOrder,thefollowingtermsshall
mean:
1.Informationshallmeananyrecords,documents,papers,reports,letters,contracts,
minutesandtranscriptsofofficialmeetings,maps,books,photographs,data,research
materials,films,soundandvideorecording,magneticorothertapes,electronicdata,
computerstoreddata,anyotherlikeorsimilardataormaterialsrecorded,storedor
archivedinwhateverformat,whetherofflineoronline,whicharemade,received,or
keptinorunderthecontrolandcustodyofanygovernmentofficepursuanttolaw,
executiveorder,andrulesandregulationsorinconnectionwiththeperformanceor
transactionofofficialbusinessbyanygovernmentoffice.
2.Officialrecord/recordsshallrefertoinformationproducedorreceivedbyapublic
officeroremployee,orbyagovernmentofficeinanofficialcapacityorpursuanttoa
publicfunctionorduty.
3.Publicrecord/recordsshallincludeinformationrequiredbylaws,executiveorders,
rules,orregulationstobeentered,keptandmadepubliclyavailablebyagovernment
office.
SECTION2.Coverage.ThisordershallcoverallgovernmentofficesundertheExecutive
Branch,includingbutnotlimitedtothenationalgovernmentandallitsoffices,departments,
bureaus,offices,andinstrumentalities,includinggovernmentownedorcontrolled
corporations,andstateuniversitiesandcolleges.Localgovernmentunits(LGUs)are
encouragedtoobserveandbeguidedbythisOrder.
SECTION3.Accesstoinformation.EveryFilipinoshallhaveaccesstoinformation,
officialrecords,publicrecordsandtodocumentsandpaperspertainingtoofficialacts,
transactionsordecisions,aswellastogovernmentresearchdatausedasbasisforpolicy
development.

SECTION4.Exception.Accesstoinformationshallbedeniedwhentheinformationfalls
underanyoftheexceptionsenshrinedintheConstitution,existinglaworjurisprudence.
TheDepartmentofJusticeandtheOfficeoftheSolicitorGeneralareherebydirectedto
prepareaninventoryofsuchexceptionsandsubmitthesametotheOfficeofthePresident
withinfifteen(15)calendardaysfromthedateofeffectivityofthisOrder.
TheOfficeofthePresidentshallthereafter,immediatelycircularizetheinventoryof
exceptionsfortheguidanceofallgovernmentofficesandinstrumentalitiescoveredbythis
Orderandthegeneralpublic.

Saidinventoryofexceptionsshallperiodicallybeupdatedtoproperlyreflectanychangein

existinglawandjurisprudenceandtheDepartmentofJusticeandtheOfficeoftheSolicitor
Generalaredirectedtoupdatetheinventoryofexceptionsastheneedtodosoarises,for
circularizationashereinabovestated.
SECTION5.AvailabilityofSALN.SubjecttotheprovisionscontainedinSections3and
4ofthisOrder,allpublicofficialsareremindedoftheirobligationtofileandmakeavailable
forscrutinytheirStatementsofAssets,LiabilitiesandNetWorth(SALN)inaccordancewith
existinglaws,rulesandregulations,andthespiritandletterofthisOrder.
SECTION6.ApplicationandInterpretation.Thereshallbealegalpresumptionin
favorofaccesstoinformation,publicrecordsandofficialrecords.Norequestforinformation
shallbedeniedunlessitclearlyfallsunderanyoftheexceptionslistedintheinventoryor
updatedinventoryofexceptionscircularizedbytheOfficeofthePresidentprovidedinthe
precedingsection.
Thedeterminationoftheapplicabilityofanyoftheexceptionstotherequestshallbethe
responsibilityoftheHeadoftheOfficewhichisincustodyorcontroloftheinformation,
pubicrecordorofficialrecord,ortheresponsiblecentralorfieldofficerdulydesignatedby
himinwriting.
Inmakingsuchdetermination,theHeadoftheOfficeorhisdesignatedofficershallexercise
reasonablediligencetoensurethatnoexceptionshallbeusedoravailedoftodenyany
requestforinformationoraccesstopublicrecords,orofficialrecordsifthedenialisintended
primarilyandpurposelytocoverupacrime,wrongdoing,graftorcorruption.
SECTION7.ProtectionofPrivacy.Whileprovidingaccesstoinformation,public
records,andofficialrecords,responsibleofficialsshallaffordfullprotectiontotherightto
privacyoftheindividualasfollows:
1.EachgovernmentofficeperSection2hereofshallensurethatpersonalinformationin
itscustodyorunderitscontrolisdisclosedorreleasedonlyifitismaterialorrelevantto
thesubjectmatteroftherequestanditsdisclosureispermissibleunderthisorderor
existinglaw,rulesorregulations

2.Eachgovernmentofficemustprotectpersonalinformationinitscustodyorcontrolby
makingreasonablesecurityarrangementsagainstleaksorprematuredisclosureof
personalinformationwhichundulyexposestheindividualwhosepersonalinformation
isrequested,tovilification,harassmentoranyotherwrongfulacts.
3.Anyemployee,officialordirectorofagovernmentofficeperSection2hereofwhohas
access,authorizedorunauthorized,topersonalinformationinthecustodyoftheoffice,
mustnotdisclosethatinformationexceptwhenauthorizedunderthisorderorpursuant
toexistinglaws,rulesorregulation.

2.Thepersonorofficeresponsibleforreceivingrequestsforinformation
3.Theprocedureforthefilingandprocessingoftherequestasspecifiedinthesucceeding
section8ofthisOrder.
4.Thestandardformsforthesubmissionofrequestsandfortheproperacknowledgment
ofrequests
5.Theprocessforthedispositionofrequests
6.Theprocedurefortheadministrativeappealofanydenialforaccesstoinformation
and
7.Thescheduleofapplicablefees.
SECTION9.Procedure.Thefollowingprocedureshallgovernthefilingandprocessingof
requestforaccesstoinformation:
1.Anypersonwhorequestsaccesstoinformationshallsubmitawrittenrequesttothe
governmentofficeconcerned.Therequestshallstatethenameandcontactinformation
oftherequestingparty,providevalidproofofhisidentificationorauthorization,
reasonablydescribetheinformationrequested,andthereasonfor,orpurposeof,the
requestforinformation:Provided,thatnorequestshallbedeniedorrefusedacceptance
unlessthereasonfortherequestiscontrarytolaw,existingrulesandregulationsoritis
oneoftheexceptionscontainedintheinventoryorupdatedinventoryofexceptionas
hereinaboveprovided.
2.Thepublicofficialreceivingtherequestshallprovidereasonableassistance,freeof
charge,toenable,toenableallrequestingpartiesandparticularlythosewithspecial
needs,tocomplywiththerequestrequirementsunderthisSection.
3.Therequestshallbestampedbythegovernmentoffice,indicatingthedateandtimeof

receiptandthename,rank,titleandpositionofthereceivingpublicofficeroremployee

Eachgovernmentofficeshallestablishasystemtotracethestatusofallrequestsfor
informationreceivedbyit.
4.Thegovernmentofficeshallrespondtoarequestfullycompliantwithrequirementsof
subsection(a)hereofassoonaspracticablebutnotexceedingfifteen(15)workingdays
fromthereceiptthereof.Theresponsementionedabovereferstothedecisionofthe
agencyorofficeconcernedtograntordenyaccesstotheinformationrequested.
5.Theperiodtorespondmaybeextendedwhenevertheinformationrequestedrequires

6.Onceadecisionismadetogranttherequest,thepersonmakingtherequestshallbe
notifiedofsuchdecisionanddirectedtopayanyapplicablefees.
SECTION10.Fees.Governmentofficesshallnotchargeanyfeeforacceptingrequestsfor
accesstoinformation.Theymay,however,chargeareasonablefeetoreimbursenecessary
costs,includingactualcostsofreproductionandcopyingoftheinformationrequired,subject
toexistingrulesandregulations.Innocaseshalltheapplicablefeesbesoonerousasto
defeatthepurposeofthisOrder.
SECTION11.IdenticalorSubstantiallySimilarRequests.Thegovernmentoffice
shallnotberequiredtoactuponanunreasonablesubsequentidenticalorsubstantially
similarrequestfromthesamerequestingpartywhoserequestfromthesamerequesting
partywhoserequesthasalreadybeenpreviouslygrantedordeniedbythesamegovernment
office.
SECTION12.NoticeofDenial.Ifthegovernmentofficedecidestodenytherequest,in
wholeorinpart,itshallassoonaspracticable,inanycasewithinfifteen(15)workingdays
fromthereceiptoftherequest,notifytherequestingpartythedenialinwriting.Thenotice
shallclearlysetforththegroundorgroundsfordenialandthecircumstancesonwhichthe
denialisbased.Failuretonotifytherequestingpartyoftheactiontakenontherequest
withintheperiodhereinstipulatedshallbedeemedadenialoftherequestforaccessto
information.
SECTION13.RemediesinCasesofDenialofRequestforAccesstoInformation.
Denialofanyrequestforaccesstoinformationmaybeappealedtothepersonorofficenext
higherintheauthority,followingtheprocedurementionedinSection7(f)ofthisOrder:
Provided,thatthewrittenappealmustbefiledbythesamepersonmakingtherequestwithin
fifteen(15)calendardaysfromthenoticeofdenialorfromthelapseoftherelevantperiodto
respondtotherequest.

Theappealbedecidedbythepersonorofficenexthigherinauthoritywithinthirty(30)
workingdaysfromthefilingofsaidwrittenappeal.Failureofsuchpersonorofficetodecide

Uponexhaustionofadministrativeappealremedies,therequestingpartmayfilethe
appropriatecaseinthepropercourtsinaccordancewiththeRulesofCourt.
SECTION14.KeepingofRecords.Subjecttoexistinglaws,rules,andregulations,
governmentofficesshallcreateand/ormaintainaccurateandreasonablycompleterecordsof
importantinformationinappropriateformats,andimplementarecordsmanagementsystem

SECTION15.AdministrativeLiability.Failuretocomplywiththeprovisionsofthis
Ordermaybeagroundforadministrativeanddisciplinarysanctionsagainstanyerring
publicofficeroremployeeasprovidedunderexistinglawsorregulations.
SECTION16.ImplementingDetails.AllgovernmentofficesintheExecutiveBranchare
directedtoformulatetheirrespectiveimplementingdetailstakingintoconsiderationtheir
mandatesandthenatureofinformationintheircustodyorcontrol,withinonehundred
twenty(120)daysfromtheeffectivityofthisOrder.
SECTION17.SeparabilityClause.IfanysectionorpartofthisOrderisheld
unconstitutionalorinvalid,theothersectionsorprovisionsnototherwiseaffectedshall
remaininfullforceoreffect.
SECTION18.RepealingClause.Allorders,rulesandregulations,issuancesoranypart
thereofinconsistentwiththeprovisionsofthisExecutiveOrderareherebyrepealed,
amendedormodifiedaccordingly:Provided,thattheprovisionsofMemorandumCircular
No.78(s.1964),asamended,shallnotbedeemedrepealedpendingfurtherreview.
SECTION19.Effectivity.ThisOrdershalltakeeffectimmediatelyuponpublicationina
newspaperofgeneralcirculation.
