(63of1986),theExecutiveCommitteeoftheBureauofIndianStandards,withthepreviousapprovalofthe
CentralGovernment,herebymakesthefollowingregulations,namely:
1.ShortTitleandCommencement(1)TheseregulationsmaybecalledtheBureauofIndianStandards
(Certification)Regulations,1988.
(2)TheyshallcomeintoforceonthedateoftheirpublicationintheOfficialGazette.
2.DefinitionsIntheseregulations,unlessthecontextotherwiserequires
1."Act"meanstheBureauofIndianStandardsAct,1986(63of1986)
2."Form"meansaformannexedtotheseregulations
3."rules"meanstheBureauofIndianStandardsRules,1987and
4.allotherwordsandexpressionsusedintheregulationsandnotdefinedbutdefinedintheActortherules
shallhavethemeaningsrespectivelyassignedtothemintheActandtherules.

3.MannerofApplyingforLicence(1)Everyapplicationforthegrantofalicenceshallbemadetothe
Bureauin##FormI.
(2)Everyapplicationforalicenceshallbeaccompaniedbyastatementfurnishingindetailanyschemeof
inspectionandtesting,whichtheapplicantmaintainsorhasbeeninuseorproposestomaintainortoputinto
useandwhichisdesignedtoregulate,duringthecourseofmanufactureorproduction,thequalityofthe
articleorprocessforwhichthelicenceisappliedfor.
(3)Everyapplicationshallbesignedinthecaseofanindividual,bytheapplicantor,inthecaseofafirm,by
theproprietor,partnerorthemanagingdirectorofthefirmorbyanyotherpersonauthorisedtosignany
declarationonbehalfofthefirm.Thenameanddesignationofthepersonsigningtheapplicationshallbe
recordedlegiblyinthespacesetapartforthepurposeintheapplicationform.
(4)Everyapplicationforalicenceshall,onreceiptbytheBureau,benumberedinorderofpriorityofthe
receiptandbeacknowledged.
(5)TheBureaumaycallforanysupplementaryinformationordocumentaryevidencefromanyapplicantin
supportofortosubstantiateanystatementmadebyhiminhisapplication,withinsuchtimeasmaybe
directedbytheBureau,andnoncompliancewithsuchdirectionmayhavetheeffectoftheapplicationbeing
summarilyrejectedbytheBureau.
(6)Onreceiptofanapplicationforalicenceandbeforegrantingalicence,theBureaumay
a)requireevidencetobeproducedthatthearticleorprocessinrespectofwhichalicencehasbeenapplied

forconformstotherelatedIndianStandard
b)requireevidencetobeproducedthattheapplicanthasinoperationaschemeofroutineinspectionand
testing,whichwilladequatelyensurethatallmarkedproductsshallconformtotheIndianStandard
c)requireallreasonablefacilitiestobeprovidedtoanInspectingOfficeroftheBureautoinspecttheoffice,
workshop,testinglaboratoriesorgodownsandanyotherpremisesoftheapplicantandtodrawandtest
sampleorsamplesforthepurposeofverifyingtheevidenceproducedbytheapplicantunderclause(a)or
clause(b)orboth
d)forthepurposeofclause(a),directtheapplicanttosubmitsamplestosuchtestingauthorityastheBureau
mayconsiderappropriate.Theexpensesfortestingshallbebornebytheapplicantand
e)onthebasisofanyreportreceivedunderclause(c)orclause(d)orboth,theBureaumay,asdeemedfit,
requiretheapplicanttocarryoutsuchalterationsin,oradditionto,theschemeoftestingandinspectionor
theprocessofmanufactureorproductioninusebytheapplicant.
4.GrantofLicence(1)IftheBureau,afterapreliminaryinquiry,issatisfiedthattheapplicant*having
regardtorequisiteskill,equipment,systems,resources,previousperformanceandantecedentsrelevanttothe
issuanceofthelicenceisfittousetheStandardMark,theBureaushallgrantalicenceinFormIIauthorising
theuseoftheStandardMarkinrespectofthearticleorclassofarticlesmanufacturedbytheapplicantorin
respectoftheprocessemployedinanymanufactureorwork,subjecttosuchtermsandconditionsas
specifiedintheseregulations.TheBureaushallintimatetheapplicantaboutgrantoflicence.
*(1A)Wheretheapplicationforalicenceismadebyaperson,whohasbeenconvictedundersection33of
theAct,heshallnotbeeligibletoapplyforaperiodofsixmonthsfromthedateofsuchconviction.The
periodofdisqualificationshallbedeterminedbytheBureauhavingregardtothefactsandcircumstancesof
eachcaseanditshallnotexceedaperiodofoneyear.
(2)AlicenceshallbegrantedinFormIIforaperiodofoneyearinthefirstinstance.TheBureaumay,onan
applicationmadebyalicenseeatleastonemonthbeforetheexpiryoftheperiodforwhichthelicencehas
beengranted,renewthesameforalikeperiod.Renewalofthelicenceforsubsequentperiodmayalsobe
donebytheBureauinasimilarmanner:
ProvidedthatiftheBureausodecides,depending,amongotherthings,onthelicensee'sperformance,itmay
renewthelicenceforaperiodlongerthanoneyearbutnotexceedingtwoyearsatatime.
(3)TheBureaumay,duringtheperiodofthevalidityofthelicence,alterbygivingonemonth'snoticetoa
licenseeanytermsandconditionssubjecttowhichthelicencehasbeengranted.
(4)WheretheBureau,afterapreliminaryinquiry,isoftheopinionthatalicenceshouldnotbegranted,the
Bureaushallgiveareasonableopportunitytotheapplicantofbeingheard,eitherinpersonorthrougha
representativeauthorisedbyhiminthisbehalf,andmaytakeintoconsiderationanyfactorexplanationurged
onbehalfoftheapplicantbeforerejectingtheapplication.
(5)WherealicencetouseStandardMarkhasbeengranted,itshallbenotifiedintheOfficialGazette
specifyingtheparticularsofthelicence.
(6)Alicence,unlessrenewedoritsrenewalisdeferredbytheBureaushallexpireattheendoftheperiodfor
whichitisgranted.
(7)ParticularsofalllicencesissuedbytheBureauundertheseregulationsinconnectionwiththeuseof
StandardMarkshallbeenteredinaregisterwhichtheBureaushallmaintain.
5.ConditionsofaLicence(1)TheStandardMarkshallbeappliedinsuchmannerasitmaybeeasily
visibleasadistinctmarkonthearticlesorthecoveringorontestcertificatesrelatingtoarticleswhichcannot
belabelledorcovered.TheStandardMarkshallbeappliedtoonlysuchtypes,grades,classes,varieties,sizes
ofthearticleforwhichthelicencehasbeengranted.ThelicenseeshallgetthefascimileoftheStandard

Markproposedtobeusedbyhim,approvedfromtheBureau.
(2)WhenaStandardMarkhasbeenspecifiedinrespectofanarticleorprocess,nopersonotherthanthe
licenseeinpossessionofavalid#@licenceorregistrationshallmakeanypublicclaim,throughany
advertisement,salespromotionleaflets,pricelistsorthelike,thathisproductconformstotherelevant
IndianStandardorcarriestheStandardMark.
ExplanationForthepurposeofthissubregulation,aclaimastoconformityofone'sproducttoanIndian
Standardinreplytoaspecificqueryorinatenderaddressedtoanyindividualcustomershallnotbedeemed
tobeapublicclaim.
(3)SolongasaStandardMarkisnotspecifiedforanarticleorprocess,apersonmaypublicallyclaimthat
thisproductorprocessconformstotheIndianStandardprovidedthatsuchproductorprocessactually
conformstotheIndianStandard.
(4)(a)Everylicenseeshallinstituteandmaintain,tothesatisfactionoftheBureau,asystemofcontrolto
keepupthequalityofhisproductionorprocessbymeansofaschemeoftestingandinspectionasindicated
inthelicence,soastoensurethatthearticleorprocess,inrespectofwhichtheStandardMarkisbeingused,
complywiththerelevantIndianStandard.
(b)Thelicenseeshallmaintainacompleterecordofthetestsandinspectionandsuchotherdataasspecified
intheschemefortestingandinspection,toestablishtothesatisfactionoftheBureauthattherequiredcontrol
ofproductionorprocesshasbeenandisbeingsatisfactorilymaintained.Suchrecordsshall,ondemand,be
madeavailableforinspectiontotheInspectingOfficer.
(5)(a)AnylicencegrantedbytheBureaumaybecancelledbyit,ifitissatisfiedthatthe
(i)articlesmarkedwiththeStandardMarkunderalicencedonotcomplywiththerelatedIndianStandard
orStandardsor
(ii)licenseehadusedthemarkinrespectofaprocesswhichdoesnotcomeuptotherelatedIndianStandard
orStandardsor
(iii)licenseefailedtoprovidereasonablefacilitiestoanyInspectingOfficertoenablehimtodischargethe
dutiesimposedonhimor
(iv)licenseehasfailedtocomplywithanyofthetermsandconditionsofthelicence.
(b)AlicencemaybesuspendedbytheBureauonrequestfromthelicensee,iftheoperation(s)inhis
premisescannolongerbecarrieddueto:
(i)naturalcalamitiessuchasflood,fire,earthquakeetc
(ii)alockoutdeclaredbythelicensees,management
(iii)closureofoperationsdirectedbyacompetentcourtorstatutoryauthority.
(c)BeforetheBureaucancelsanylicence,itshallgivethelicenseenotlessthanfourteendays'noticeofits
intentiontocancelthelicence.
(d)Onthereceiptofsuchnotice,thelicenseemaysubmitanexplanationonhisbehalftotheBureauwithin
sevendaysfromthereceiptofthenotice.Ifanexplanationissubmitted,theBureaumayconsiderthe
explanationandgiveahearingtothelicenseewithinfourteendaysfromthedateofreceiptofsuch
explanationorbeforetheexpiryofthenoticewhicheverislonger.
(e)Ifnoexplanationissubmitted,theBureaumay,ontheexpiryofperiodofthenotice,cancelthe
licence.

(f)Wherealicencehasbeensuspendedorcancelled,orthetermthereofhasnotbeenrenewedontheexpiry
oftheperiodofitsvalidity,thelicenseeshalldiscontinueforthwiththeuseoftheStandardMark
notwithstandingthependencyofanyappealbeforetheCentralGovernmentundersection16oftheActand
iftherebe,withthelicenseeorhisagents,anyarticlesinstockwhichhavebeenimproperlymarked,the
licenseeorhisagentsasthecasemaybe,shalltakenecessarystepstogettheStandardMarkonsucharticles
eitherremoved,cancelled,defacedorerased.
(6)Whenalicencehasbeensuspendedorcancelled,theBureaushallpublishtheparticularsofthelicenceso
suspendedorcancelledintheOfficialGazette.
(7)(a)If,atanytime,thereissomedifficultyinmaintainingtheconformityoftheproducttothespecification
orthetestingequipmentgoesoutoforder,themarkingoftheproductshallbestoppedbythelicensee,under
intimationtotheBureau.Themarkingmayberesumedassoonasthedefectsareremovedandinformation
regardingsuchresumptionofmarkingbesenttotheBureau,immediatelythereafter.
(b)If,atanytime,theBureauhassufficientevidencethattheproductcarryingtheStandardMarkmaynotbe
conformingtotheIndianStandard,thelicenseeshallbedirectedtoStopMarkingofsuchproduct.Such
evidenceisnotlimitedto,butmayincludeoneormoreofthefollowingsituations:
(i)nonconformanceofproductsestablishedafterfactoryorindependenttesting
(ii)nonimplementationoftheprovision(s)oftheSchemeofTestingandInspection
(iii)nonavailabilityoftestingpersonnelandnoalternatearrangementsmade
(iv)significantmodification(s)inthemanufacturingprocess,plant,machineryetcwithoutpriorevaluation
andapprovaloftheBureau
(v)relocationofplantandmachinery
(vi)prolongedclosureoffactory
(vii)markingnonconformingproducts
(viii)markingonproductsotherthanthoseincludedinthelicence.
TheresumptionofmarkingshallbepermittedbytheBureauaftersatisfyingitselfthatthelicenseehastaken
necessaryactionsandsufficientevidenceisavailableabouttheconformityoftheproducttotherelevant
standard.
(c)(i)TheBureaumay,afterservinganoticeofnotlessthanfourteendays,directthelicenseetoStop
Markingtheproductifatanytime,thelicenseehasnotpaidthefees,inspectionortestchargespayableby
him.Theresumptionofmarkingshallbepermittedafterthedueshavebeenpaidinfullorinpartasagreed
bytheBureau.
(ii)Whereadecisionhasbeentakentodefertherenewalofalicence,thelicenseeshallbedirectedtoStop
Markinghisproducttillsuchtimeasdecisionistakentorenewthelicence.
(8)ThedecisionoftheBureauundersubregulation(4)oftheregulation4orsubregulation(5)ofthe
regulation5togetherwiththegroundsforarrivingatsuchdecisionshallbecommunicated,inwritingby
registeredpost,totheapplicantorthelicensee,asthecasemaybe.
(9)Aninspection,speciallymadeattherequestofanapplicantoralicensee,shallbechargeabletothe
accountofapplicantorthelicensee.Chargesforsuchspecialinspectionorinspectionsshallbesuchasmay
bedecidedbytheBureau.
(10)WhenanIndianStandardiswithdrawnandnotsupersededbyanyotherIndianStandard,anylicence
issuedinrespectthereofshallbedeemedtohavebeencancelledfromthedateofwithdrawalofsuchIndian
StandardandanysuchlicenceshallbesurrenderedtotheBureaubythelicenseeforthwith.Inthecaseof

suchcancelledlicence,apartofthemarkingfee,ifpaidinadvance,proportionatetotheunexpiredperiodof
thelicence,mayberefundedtothelicensee.
(11)Thefollowingprocedureshallapplyinthecaseofinspectioninrespectofanyarticleorprocesswherea
licencefortheuseofStandardMarkinrespectofthatarticleorprocesshasbeenissued,oranapplication
hasbeenmadeforalicence
1.whenanInspectingOfficerproposestoinspectthepremisesofanapplicant,heshall,preferably,give
reasonablenoticeofhisvisittotheapplicantbutforinspectionofpremisesofalicensee,suchnoticeisnot
necessary
2.ifduringaninspection,anInspectingOfficerwishestotakeoneormoresamplesofanyarticle,material
orsubstance,heshalldosointhepresenceofthelicenseeortheapplicantoraresponsiblepersonbelonging
totheestablishmentofthelicenseeortheapplicant,asthecasemaybe
3.theInspectingOfficermayathisdiscretion,andshallifthelicenseeorapplicantortheresponsible
personbelongingtotheestablishmentdemandsit,takeduplicatesamplesandgiveonesampletothelicensee
ortheapplicantorsuchresponsibleperson
4.theInspectingOfficermayathisdiscretion,andshallifthelicenseeorapplicantortheresponsible
personbelongingtotheestablishmentdemandsit,placeeachsuchsampleinacoveringandjointlysealeach
sample.InthecaseofsamplesdrawnbytheInspectingOfficerwhichcannotbesosealed,suchsamplesshall
bemarkedwithcertainidentificationtoestablishtheiridentity
5.impressionofthesealsanddetailsofidentificationshallbegivenintheInspectingOfficer'sreport.The
samplesshallbelabelledgivingcompletedetailsand
6.theInspectingOfficershallgiveareceiptforsampleorsamplestakenandretainaduplicatecopyofthe
receiptdulysignedbythepersoninwhosepresencethesamplewastaken.
(12)TheInspectingOfficermaytakesamplesofarticlesmarkedwiththeStandardMarkfromthegodowns
oranysuchpremisesofanyagentofthelicenseeorfromthearticlesputupforsaleintheopenmarketby
thelicenseeorhisagent.
(13)TheBureaushallarrangeatleasttwoinspectionsayearinrespectofeachlicence.
(14)AnInspectingOfficershallmaketotheBureauadetailedreportofeveryinspectionmadebyhim.
@@(15)Thelicenseeshall,ifsorequiredbytheBureau,usetheBureau'sprescribedhologramsonthe
specifiedproductsinadditiontotheStandardMark.Thehologramsshallbesuppliedattheprescribedrates
bytheBureauoritsauthorizedrepresentativesinthisregard.Thecopyrightofthehologramshallvestinthe
Bureauandthelicenseeshallnotimitatethesamenorusethespurioushologramontheproductscoveredby
thelicence.
6.Fees(1)Everyapplicationforthegrantofalicenceshallbeaccompaniedbyafeeof**rupeesone
thousandandeveryapplicationforrenewalofalicenceshallbeaccompaniedbyafeeof**rupeesfive
hundred.Nosuchfeeorpartthereofshall,inanycircumstance,berefunded.
(2)Inadditiontotheapplicationfeepaidbytheapplicantwithhisapplicationundersubregulation(1),there
shallbepaidbyeverylicensee
1.anannuallicencefeeof**rupeesonethousand
2.amarkingfeeattherateasmaybedeterminedbytheBureauandCorrespondingtototalannual
productionofthearticleorprocesscoveredbytheStandardMarkoraminimumfee,whicheverishigher.
(3)ThemarkingfeeshallfromtimetotimebedeterminedbytheBureauandshallbepublishedinthe
OfficialGazetteintheformofascheduleshowingthemarkingfeesperunitforeachclassofproductor
process.

(4)Theannuallicencefeeandtheminimummarkingfeeforthefirstyearshallbepaidbytheapplicantat
thetimeofgrantofthelicence.Thereafter,atthetimeofapplicationforrenewalofthelicencethelicensee
shallpaytheannuallicencefee,alongwithmarkingfeeduefortheperiodimmediatelyprecedingthe
renewal,solongasthelicenceremainseffective.
(5)ThelicenseeshallpaythemarkingfeeinthemannerstipulatedintheSecondScheduletoFormII.

7.OtherServicesAssociatedtoCertification
(1)ManagementSystems
A.ApplicationforLicence
(a)EveryapplicationforthegrantoflicenceforManagementSystemscertificationshallbemadetothe
BureauintheFormspecifiedbytheBureau,whichshallbesignedbytheproprietor,partnerortheManaging
Directoroftheapplicantfirmorbyanypersonauthorizedtosigndeclarationonbehalfofthefirm.The
nameanddesignationofthepersonsigningtheapplicationshallberecordedlegiblyinthespacesetapartfor
thepurposeintheapplicationform.
(b)Everyapplicationforcertificationshallbeaccompaniedbysupplementaryquestionnairedulyfilledinthe
FormspecifiedbytheBureau.TheapplicationshallalsobeaccompaniedbyaManualandPlanasprepared
bytheapplicantfirmandthepolicydeclaredbytheapplicantfirmforthesystemforwhichcertificationis
sought.
(c)TheapplicationformalongwithfeedecidedbytheBureauandothernecessarydocumentssubmittedby
theapplicantshallbeacknowledgedandnumberedbytheBureauintheorderofpriorityaccordingtothe
dateofthereceipt.Thefeeshallbenonrefundable.
(d)Afteracknowledgement,theapplicationshallbeverifiedbytheBureau,andifitisinorder,theapplicant
shallbeinformedoftheintentionoftheBureautoproceedwiththeapplication.
(e)Ifrequired,theBureaushallprovidetotheapplicanttheinformationabouttheschemeandalsoobtain
suchfurtherinformationfromhim,ifnecessary.
(f)Anapplicationmayberejectediftheapplicantdoesnotcomplywithoneormoreofthefollowing
requirements
(i)applicationfeenotaccompanyingtheapplication
(ii)applicationformisincomplete
(iii)annexurestotheapplicationarenotclear.
Inaddition,theBureaumaycallforanysupplementaryinformationordocumentaryevidencefromany
applicantinsupportofortosubstantiateanystatementmadebyhiminhisapplication,withinsuchtimeas
maybedirectedbytheBureau.
(g)ThereasonforrejectionoftheapplicationshallbecommunicatedtotheapplicantbytheBureau.
(h)Theapplicationforalicencebyafirmwhichhasbeenconvictedundersection33oftheBureauofIndian
StandardsAct,1986shallnotbeentertainedforaminimumperiodofsixmonthsfromthedateofsuch
conviction.TheextentoftheperiodofdisqualificationshallbedeterminedbytheBureauhavingregardto
thefactsandcircumstancesofeachcaseanditshallnotexceedamaximumperiodofoneyear.

B.AssessmentProcedure(a)Iftheapplicationisinorder,thentheBureaushallproceedasper
clauses(b)to(f).
(b)TheBureaumay,ifnecessary,arrangeavisittothepremisesoftheapplicanttoacquaintitselfaboutsize,
natureofoperationandreadinessfortheassessmentandthetypeofexpertiserequiredbytheassessment
team.
(c)Theapplicantisrequiredtohaveadocumentedmanagementsystem,whichconformstotherelevant
IndianStandard(s)onmanagementsystems.Beforeanassessmentvisitismade,adetailedappraisalofthe
applicantfirm'smanagementsystemdocumentationforconformancewiththerelevantIndianStandardon
themanagementsystemsshallbeundertakenbytheBureau.Theapplicantshallthenbenotifiedaboutany
significantomissionsordeviationsfromtherequirementstomakesuitableamendmentspriortothe
assessmentvisit.
(d)Theapplicantshallensurethat
(i)alldocumentationrelatingtothemanagementsystem(s)forwhichthelicenceissought,includingthe
ManualandPlanoritsequivalentismadeavailabletotheBureau
(ii)allrelevantrecordsrelatingtoimplementationofthemanagementsystem(s)aremadeavailabletothe
Bureau
(iii)theassessmentteamispermittedandassistedtoundertakeassessmentofthemanagementsystemand
(iv)responsibilitytotheBureauforthemanagementsystem(s)isclearlydefinedbyappointingadesignated
persontoensurethattherequiredmanagementsystemproceduresareobserved.
(e)Theassessmentteamshallcompriseleadauditorandoneormoreauditorsasdeemednecessary.The
assessmentteammayalsoincludetechnicalexpert(s)orexperiencedassessorsintheconcernedtechnology
areaasmember.
(f)Theassessmentshallinvolveanindepthappraisaloftheapplicantfirm'sproceduresfortheconformance
totherequirementsdecidedbytheBureau.Theapplicantshallberequiredtodemonstratethepractical
applicationofthedocumentedprocedures.Theassessmentteamshallidentifythenonconformanceand
bringthemtothenoticeoftheapplicantforrectification.
(g)Date(s)andtimeoftheassessmentvisitshallbedecidedonmutualagreementbetweentheparties
(assessmentteamandtheapplicant).
C.Assessmentfees(a)Assessmentfeedependsuponthenatureoftheactivitiesofthefirm.Thefee
determinedshallbeintimatedtotheapplicantpriortothevisit.
(b)AllassessmentandreassessmentfeedeterminedbytheBureauandcostoftravelandstayshallbepaid
bytheapplicantfirmpriortothevisit.
(c)Iftheapplication,isinrespectofmorethanoneareaoftechnologyorformorethanonestandard,the
assessmentvisitnormallycoversallaspects.
D.Factorsforthegrantoflicence(a)Theassessmentteamaftertheassessmentshallanalysethe
capabilityoftheapplicanttooperatetheManagementSystemsCertificationScheme.
(b)Theassessmentteamshallprepareareportagainsteachoftheitemsorclausesgivenintherelevant
IndianStandard(s)onManagementSystemsagainstwhichtheassessmenthasbeencarriedout.The
applicantshallbenotifiedinwritingthenonconformities,ifany,observedduringtheassessment.
(c)Theapplicantshallproduceevidencethatcorrectiveactionshavebeentakentomeetalltherelevant
requirementswithinthetimelimitsspecifiedbytheBureau.TheBureaumayundertakeafullorpartial
reassessmentoracceptwrittendeclarationthatcorrectiveactionhasbeentaken,tobeconfirmedbythe
Bureauduringasurveillancevisit.

(d)WhentheBureauissatisfiedwiththerecommendationsoftheassessmentteamforgrantoflicence,the
sameshallbegranted,asper*@FormIII.Whilemakingtherecommendations,theteamshalltakeinto
accounttheassessmentmadeundersubclause(a)to(c)ofitemDandalsotherequisiteskill,equipment,
systemsresources,previousperformanceandantecedentsrelevanttotheissuanceofthelicence.
(e)Iftheapplicantisnotabletoproduceevidencethatcorrectiveactionshavebeentakentomeetallthe
relevantrequirementswithinthetimelimitsspecifiedbytheBureau,theBureaumayrefusetograntthe
licence.However,beforerefusingtograntthelicence,theBureaushallgiveareasonableopportunitytothe
applicantofbeingheardeitherinpersonorthrougharepresentativeauthorizedbyhiminthisbehalfandmay
takeintoconsiderationanyfactorexplanationurgedonbehalfoftheapplicantbeforerefusingtograntthe
licence.
E.UndertakingPriortograntoflicence,theapplicantshallsignanundertakingtotheeffectthathe
willmakenoclaimdirectorimpliedthatthelicencetobegrantedrelatestoanyproducts,processesor
systemsotherthanthosethatwillbesetoutinthelicenceandtheSchedule.
F.Grantoflicence
(a)Thelicenceshallbegrantedforaperiodofthreeyearsinthefirstinstance.TheBureaushallinformthe
applicantaboutthegrantoflicence.
(b)TheBureaushallprovideacertificateforgrantoflicenceinFormIIIwhichshallbeusedbythelicensee
subjecttotheprovisionofitemLofsubregulation(1)ofRegulation7.Additionalcopiesofcertificatemay
beprovidedonpaymentasdeterminedbytheBureaufromtimetotime.
(c)ThelicenceshallbereturnedtotheBureauintheeventofitsbeingsurrendered,notrenewed,suspended
orcancelled.
(d)TheBureaushallregisterthelicenseeashavingamanagementsysteminaccordancewiththescheme's
assessmentrequirementsfortheproductsorprocessesinvolvedinmanufacturingtheproductorprovidinga
service.
(e)TheBureaushallauthorisethelicenseetouse,subjecttotheprovisionsofitemK,theStandardMarkas
decidedbytheBureau.
G.Licencefee(a)ThelicencefeeshallbedeterminedbytheBureaufromtimetotime.
(b)Thelicencefeeshallbepaidbytheapplicantatthetimeofgrantandrenewaloflicence.Nosuchfeeor
partthereofshallberefunded.
H.RenewaloflicenceThelicencemayberenewedforaperiodofthreeyears.Therenewalwillbe
donebyreassessingthecapabilitiesofthelicensee,thefeeofwhichshallbebornebythelicensee.The
licenceshallexpireaftertheperiodforwhichitisgranted,ifnotrenewed.
I.Surveillanceandregularreview(a)Thegrantoflicenceshallbefollowedbysurveillancevisits.
ThefrequencyandextentofvisitsshallbedeterminedbytheBureau.
(b)Thesurveillancevisitsmaybeplannedinconsultationwiththelicenseetoensurethatthemanagement
systemsandproceduresalreadyassessedarebeingmaintained.
(c)Specialassessmentvisitshallbenecessarywherealicenseefailstoobservetheconditionsofthelicence
orwheretherehavebeensignificantchangesintheorganizationofthelicensee.Thelicenseeshallbeliable
forthecostsofallsuchvisits.
J.Changesinthemanagementsystem(a)ThelicenseeshallinformtheBureaupromptlyabout
anyintendedchangesinthemanagementsystemorotherchangeswhichmayaffectconformancetothe
requirementsdecidedbytheBureau.

(b)ThelicenseeshallacceptthedecisionoftheBureauastowhethertheintendedchangesrequire
reassessmentorfurtherinvestigation.
K.UseofBureau'sStandardMarkThelicenseemayusethestandardmarkonlyasauthorizedbythe
Bureau.
L.Publicity(a)TheBureaushallmaintainalistoflicenseesandmakeitavailableforpublic
information.
(b)Thelistshallbeupdatedperiodically.
(c)TheBureaumaybringoutpublicationscontaininginformationregardinglicensees.
(d)Thelicenseeshallinformpotentialcustomers,purchasersorpurchasingauthorities,ofthefullandexact
detailsofthelicence.
(e)Thelicenseeshalldisplaythelicenceinhispremises.
(f)ThelicenseeshallmakeuseoftheBureau'sStandardMarkasauthorized.
(g)Thelicenseeshallstateindocumentationbrochuresorthroughadvertisingmediathattheorganizationor
locationtowhichthelicenceapplieshavebeenassessedandapprovedbytheBureau.Insuchadvertisement
theIndianStandard(s)onManagementSystems(s)forwhichalicencehasbeengrantedis/aretobestated
andanyotherlevel(s)ofapprovalthangrantedisnottobeimplied.
(h)Alicenseewhohasbeengrantedalicenceformanagementsystemcertificationshallnotclaimorimply
thattheproductmanufacturedbyhimhasbeencertifiedorapprovedbytheBureauunlessheisholdinga
validlicenceforthatproductundertherecognizedproductcertificationschemeoftheBureau.
M.ObligationsofthelicenseeAlicenseeongrantofcertificationformanagementsystemsshall,
(a)atalltimescomplywiththerequirementsofthelicenceassetoutthereinandcomplywiththese
regulationsoranyamendmentsthereto
(b)onlyclaimthatheisholdingalicenceinrespectofthecapabilitywhichisthesubjectofthelicenceand
whichrelatestotheproducts,processesorsystemsinaccordancewiththelicencerequirements
(c)notusethelicenceinanymannertowhichtheBureaumayobjectandshallnotmakeanystatement
concerningtheauthorityofthelicensee'suseofthelicencewhichintheopinionoftheBISmaybe
misleading
(d)submittotheBureauforapprovaltheforminwhichheproposestousehislicenceorproposestomake
referencestothelicence.
(e)uponexpiryofitsperiodofvalidity,suspension,orterminationofthelicence,howeverdetermined,
discontinueitsuseforthwithandwithdrawallpromotionalandadvertisingmatterwhichcontainsany
referencethereto
(f)notmakeanychangeintheManagementSystemwhichformsthebasisforthegrantorrenewalofthe
licenceandwhichpreventshiscompliancewiththeSchemewithoutpriorapprovaloftheBureau
(g)submittotheBureauanyamendmentstotheapproveddocumentedSystem
(h)documentallchangesmadetotheManagementSystemandmakerecordsofsuchchangesavailableto
Bureau'sdesignatedofficersonrequest.Achangeinkeypersonnelinrelationtomanagementofthe
licencedsystemsandtechnologicalfunctionsorseniormanagementshallbenotifiedtotheBureaubythe
licensee
(i)permitaccesstoateamappointedbytheBureauforpurposesofassessment,auditorsurveillance.The
licenseeshallgivefulldetailsofallactionstakeninresponsetofieldproblemsarisingfromallegationsof

defectsinproducts,processesorsystemscoveredinthelicenceandallowBureau'sofficersaccesstoall
relevantrecordsanddocumentsforthepurposeofverifyingsuchdetails
(j)berequiredtoproduceevidenceofcontinuingoperationsfortheproducts,processesorsystemscovered
bythelicence.LicenseeshallnotifytheBureauinwritingofdiscontinuanceinsuchoperationsexceeding
threemonths.Discontinuanceofalicenceinexcessofsixmonthsormoremayleadtocancellationof
licence.Insuchcases,afreshapplicationshallbesubmittedtotheBureauandanassessmentvisitwillbe
necessarypriortograntofanewlicence
(k)payallfinancialduestotheBureau,inthemannerspecifiedbyit,evenfortheperiodofdiscontinuance
orsuspensionoflicence.
N.SurrenderoflicenceAlicencemaybesurrenderedbythelicenseeatanytimeinwritingtothe
Bureau.Inthecaseofsurrender,thelicenseeshallreturnthelicencewithalltherelateddocumentstothe
Bureau.
O.PowersoftheBureauTheBureaumayatitsdiscretionundertheprovisionsofsection15ofthe
Act,
(a)Refusetograntorrenewalicenceorextenditsscopeorcanceloraltersoastoreducethescopeofthe
licenceprovidedthattherefusalforgrant,renewal,cancellationoralterationisarecommendationofthe
assessmentteamtowhichadecisionbytheDirectorGeneraloftheBureaushallbeconclusive.Therefusal
toreneworcancelalicenceforfailuretodischargetheobligationsunderitemM,shallbebasedonthe
reportofassessment/auditduringsurveillanceandregularrevieworreassessment.Suchdecisionsshallbe
communicatedtotheapplicantorlicenseeinwriting.
(b)AnyauthorizedofficeroftheBureaushallbeentitledtosuspendalicenceiftherearesufficientgrounds
ofnoncomplianceofthefollowing,
(i)ifsurveillanceprovesnonconformitytotherelevantrequirementsbutimmediateterminationisnot
considerednecessary
(ii)ifimproperuseofthelicenceismade.
(iii)ifrelateddocumentsarenotcorrectedtotheBureau'ssatisfaction
(iv)iftherehasbeenanycontraventionofproceduressetoutbytheBureau
(v)ifthelicenseefailstomeetfinancialobligationstotheBureauand
(vi)onanyothergroundsspecificallyprovidedforundertheprocedures,rulesorformallyagreedbetween
thelicenseeandtheBureau.
(c)TheBureaumayrevokesuspensionofalicenceaftersatisfyingitselfthatthelicenseehastakennecessary
actionstoremovethedeficiencieswithintimelimitsspecifiedbytheBureau.
(d)BeforetheBureaususpendsorcancelsanylicence,itshallgivethelicenseenotlessthanfourteendays
noticeofitsintentiontosuspendorcancelthelicence.
(e)Onthereceiptofsuchnotice,thelicenseemaysubmitanexplanationonhisbehalftotheBureauwithin
sevendaysfromthereceiptofthenotice.Ifanexplanationissubmitted,theBureaumayconsiderthe
explanationandgiveahearingtothelicenseewithinfourteendaysfromthedateofreceiptofsuch
explanationorbeforetheexpiryofthenoticewhicheverislonger.
(f)Ifnoexplanationissubmitted,theBureaumayontheexpiryofperiodofthenotice,suspendorcancelthe
licence.
(g)Wherealicencehasbeensuspendedorcancelledorhasnotbeenrenewedontheexpiryoftheperiodof
itsvalidity,thelicenseeshalldiscontinueforthwiththeuseofthelicencenotwithstandingthependencyof

anyappealbeforetheCentralGovernmentundersection16oftheActandshallreturnthelicenceandrelated
documentstotheBureau.
(h)Wherethelicenseeisunableinthespecifiedperiodorreasonableperiodoftime,torectifyany
deficiencieswhichmakethelicenseeunabletocomplywiththerequirementsofthisscheme,thelicencemay
becancelled.Cancellationofthelicenceinsuchcaseshallrequirethelicenseetolodgeafreshapplication
followedbytheprocedureprescribedintheseregulationsforthegrantofanewlicence.
P.MisuseoflicenceThelicenseeshallbedeemedtohavemisusedthelicence,ifhetemperswiththe
licenceinanymannerordoesnotceasetodisplayorotherwiseusethelicenceandtheBureau'sStandard
Markimmediatelyafter,
(a)Surrenderoflicenceoritssuspensionorcancellationorexpiryofperiodofvalidityofthelicence.
(b)ThelicenseehasmadeachangetoitsManagementSystemwhichhasnotbeenacceptedbythe
Bureauandwhichcouldreasonablybeexpectedtoaffectthelicensee'squalificationforlicence
(c)ThelicenseehasfailedtoimplementchangesasadvisedbytheBureauorfailedtotakecorrective
actionsonthenonconformitiespointedoutbytheBureau.
(d)Anyothercircumstancesarisingwhichcouldreasonablybeexpectedtoaffectadverselythe
ManagementSystemofthelicensee.
(e)WhenaStandardMarkhasbeenspecifiedinrespectofamanagementsystem,nopersonotherthan
thelicenseeinpossessionofavalidlicenceshallmakeanypublicclaim,throughanyadvertisement,sales
promotionleaflets,pricelistsorthelikethathismanagementsystemconformstotherelevantIndian
StandardorusetheStandardMark.
Q.AppealsAppealsagainstanydecisionoftheBureaushallbemadeundertheprovisionsofsection
16oftheAct,andtherulesmadethereunder.
