Unethical Behavior Case by PT.

Gudang Garam
Introduction:
PT Gudang Garam (PT) founded by Suryo Wonowidjoyo on June 26, 1958.
PT Gudang Garam (Tbk) is a brand / company from Indonesia popular
cigarette manufacturer based in Kediri, East Java, Indonesia.
Ethics Violation:
In 2014, Indonesian Broadcasting Commission (KPI) have found violations
of the Code of Conduct of Broadcasters and Standard Broadcasting
Program (P3 and SPS) on "Gudang Garam" cigarettes Ad commercial aired
by the TV One on May 10, 2014 at 19:43 pm. The program displays
cigarette advertising under 21.30. These types of violations are
categorized as a violation of the protection of children and adolescents
and prohibitions and restrictions on smoking charge.
Law Violation:
KPI decided that the actions of these views has violated:
- Broadcasters Code of Conduct of Indonesian Broadcasting
Commission in 2012 Article 14 and Article 43
- Broadcasting Program Standard of Indonesian Broadcasting
Commission in 2012 Article 15 paragraph (1), Article 58 paragraph
(1) and Article 59 paragraph (1 )
In accordance with Government Regulation No. 50 of 2005 on the
Implementation of private broadcasting institutions, it violated:
- Article 21 paragraph (3) about Cigarette Ads in which Organizing
institutions broadcaster and television can only broadcast Cigarette
Ads at 21:30 until 05:00 local time where broadcasters are located.
Troubleshooting performed by government:
According to the KPI, the program has received a First Written Warning
Letter 953 / K / KPI / 05/14 dated May 5, 2014 but being ignored by the
company and broadcasting station so KPI issued Second Written Warning
Letter 1337/K/KPI/06/14 dated June 9, 2014. For these violations, KPI will
continue to monitor and enhance the more severe sanctions if it remains
violate the provisions of cigarette advertising airtime.
