At least two weeks prior to the scheduled court date, e-mail an entry of appearance to the courtroom clerk where the case is assigned and copy the courtroom prosecutor. Also, e-mail the courtroom prosecutor a request for guilty- plea recommendation. Include any information you choose relevant to the plea offer. if the court date is in less than two weeks, you must also e-mail the courtroom clerk a Motion for Continuance and proposed Order with a copy to the prosecutor. Within one week, the prosecutor will review the case and e-mail you an offer. 3. The following violations do not require a mandatory court appearance: speeding less than 25 mph over the limit; failure to display a valid driver's license; failure to produce proof of insurance; seat belt; other non-accident moving violations; and some animal and housing violations. This list is not exhaustive. If the original charge does not involve a mandatory court appearance you have two options to accept the offer and pay: a. Pay by credit card at www.kcmo.org/court and follow instructions on the website. b. Pay by cash, check or credit card in person at the Traffic Violations Bureau (TVB) line on the first floor of Municipal Court at 1101 Locust. 4, If the original charge involves a mandatory court appearance, you and your client must appear on the scheduled court date and be prepared to dispose of the case at that time. 5. If your client rejects the offer, e-mail the prosecutor notice of the rejected plea offer and appear in court on the scheduled court date to schedule a trial setting. Guidelines for defective equipment amendments The offer to amend a moving violation, including a speeding charge to defective equipment, is at the discretion of the prosecutor. If the prosecutor does offer such amendment, the fine amount is also discretionary. However, the base fine will be $175.00 plus court costs. The fine will increase in relation to the speed in excess of the speed limit. Generally, the excessive speed categories are: 1-15 mph over, 16-20 mph over, and 21-25 mph over. Previous defective equipment amendments will be determined by a rolling calendar year and will also involve an increase from the base fine. If the violation occurred in a school zone or construction zone the fines may be increased. Prior warrants for failure to appear may also increase the fine amount.
