Option 2: just punishment


In the case of gangster disturbance to public at midnight, the gangster member drove
motor bike with noise sound. They disturbed by passer, they shouted at loud mid night. Public
complained a lot to police force to control that kind of public disturbance.
There are mostly young boy in that kind of gangster. They are drinking alcohol /beer
and some are drug. In the case, police has to control the midnight public disturbance. In the
other side, as Myanmar polices regular practise, to prevent and deter any criminal case and
some minor police cases, before some of the big event period (like water festival, thadingyut
festival), police has to catch the gangster. In most of the cases, police cannot find the gangster
in time, the gangster run away by motorbike. Finally, police tried to catch other innocent
group rather than gangster.
In this case, Area police tried to catch some young boys who were playing guitar at
mid night on the platform of the main road. Some may be drink beer/alcohol. If police has
previous case of fighting /quarrel between young gangster, police try to catch the innocent
young boy group who are playing guitar at road to please public. The innocent boys are in
prison for public disturbance.
According to the public view, the punishment is just. They cannot classify the young
boy group, whether they are innocent or gangster. Anyway, they feel that they are safe and
believe that police perform their duty well. As consequentialism Punishing innocent people is
justified when it is useful and has good outcomes for society. Punishment will maximise and
deter for future crime.

According to the innocent young boy group, they feel that they are just playing guitar.
Their fault is they are sitting in public area, (on the roads platform). They are not gangster.
Gangsters are professional and they can run and disappear immediately, they commit the
crime. As consequentialism, if punishment is not improving society, it should be revised and
changed. The gangster will assume that they wont punish so they might try to commit
similar crimes.
In my opinion, the situation is consequentialism, police consider only for society/
public. Police try to reduce the tension of public. As Consequentialism, the state must act in a
way that maximises positive outcomes and reduces negative outcomes for society. On the
face of it though, this problem case is theoretical possibilities and this would seem to
undermine the consequentialist case.
