AN ACT ESTABLISHING FISHING BOATS REGISTRATION OF CCTV UNDERWATER TO
ALL FLOATING BOATS IN ALLCOASTAL AREAS
IN ALL MUNICIPALITIES,CITIES AND PROVINCES AMENDING FOR THE PURPOSE EPUBLIC ACT NO.8550, OTHERWISE KNOWN AS "THE PHILIPPINE FISHERIESCODE OF 1998" AND FOR OTHER PURPOSES. Proposed bill by: Rep.Earl Mark Calingacion Be it put into law by the Senate and the House of Representatives of the Philippines in Congress got together: SECTION1. There will be established at least one 1 fishery officer station in every coastal city and municipalities in the Philippines. coastal protected area refers to any area of intertidal orsubtidal land, together with its overlying water and connected flora, animal population, historical and cultural features, which has been reserved by law or local rule to protect part or all of the enclosed surrounding conditions. Coastal areas will be used to make sure that lots of different plants and animals exist, manage valuable things from nature, protect animal that's in danger of disappearing forever, reduce user conflicts, provide educational and research opportunities, and improve recreational fisheries. It will include fishery reservations, fisheries reserves, fish safety/safe place and safe places and mangrove swamp reservations. SECTION2. The Department will be responsible in selecting/naming and managing coastal areas beyond the ten 10 kilometers from shoreline: given, that coastal areas established under RA 7586 will continue be managed by the Department of surrounding conditions and Natural Useful things and valuable supplies. SECTION 3.The LGU concerned, upon the recommendation of the FARMC,and with the help of BFAR, will be responsible for the identification, establishment and management of coastal areas within city-based waters with an area of at least fifteen percent 15% where related of the total coastal areas in each city will be identified, based on the best available scientific data. The fund for the creation of the beginning of the existence of coastal areas will be given by the LGU. Such coastal protected areas will be established within six 6 months from the approval of this Act. Coastal areas at least twenty-five percent 25% but not more than forty percent 40% of good inter tidal areas will be set aside for the producing crops that helps something to grow of mangroves to strengthen the home place where something the creating grounds of fish. Within these areas no commercial fishing will be allowed. SECTION 4.Every floating boats particularly the fishing boats shall be register to the fishery office , a CCTV must be attach under the boat for security purposes that such boat cannot be use for an illegal activities which may carry some contraband s by cables or by any language that violates the law.If caught violating this act will be revoked to operate and to be determine by the local authorities.
SECTION 5. All marine fishery reserves, fish safe places and mangrove swamp
reservations already declared or announced by the President or legislated by the
Congress of the Philippines will be continuously given/gave and supervised by the concerned private and government units functions . SECTION 6. Should an LGU do not establish as a coastal protected in this given, the Mayor,the and the members of the Sanggunian will be responsible for prosecution under Republic Act Nos. 3019 and 6713 and other clearly connected or related laws. SECTION 7. Suppletory Application For purposes of this Act, the Revised Penal Code and other applicable laws, shall have suppletory application. SECTION 8. Separability Clause. If any Sec. or provision of this Act is held unconstitutional or invalid, the other Sec.s or provisions shall not be affected. SECTION 9. Repealing Clause All laws, Presidential decrees, executive orders and rules and regulations, or parts thereof, inconsistent with the provisions of this Act are hereby repealed or modified accordingly. SECTION 10. Effectivity. - This Act will take effect fifteen 15 days following its complete book, magazine,etc. in at least two 2 newspapers of general circulations.
