ORDER
Before this Court is a Motion to fix bail filed by the accused. It was alleged that
the evidence against him is not strong, hence he should be allowed to post bail.
In resolving accused's petition to bail, the Court is required to ascertain whether
there is a competent or sufficient evidence to sustain the indictment or support a verdict
of guilt.
After the Court has extensively scrutinized the evidence presented by the
Prosecutor, it found out that without the defense effectively rebutting the evidence
presented by the Prosecution, conviction of the accused may be had on the essential
elements of the crime the accused is charged of are present.
Besides, the accused is like facing two (2) other criminal Cases ( ) before this
Court, hence it should also be taken into consideration.
WHEREFORE, the petition to fix bail filed by the accused is hereby denied.
As ascheduled, let the initial presentation of defense evidence be set on as
previously scheduled.
SO ORDERED.
