INFORMATION DAO # 16024551 Bail: $ Warran/Release: Warrant ‘Defendant, Case No, 1136112 ‘The undersigned Detective Brandon Moore - SANDY CITY POLICE DEPARTMENT, Agency Case No. SY2016-53328, upon a written declaration states on information and belief that the defendant, III, committed the erime(s) of COUNT 1 ATTEMPTED MURDER, 76-5-203 UCA, Fitst Degree Felony, as follows: That on or about October 25, 2016 at 615 Hast 8000 South, in Salt Lake County, State of Utah, the defendant did attempt to (a) intentionally or knowingly eause the death of another; (b) intending to cause serious bodily injury to another, commit an act clearly dangerous to human life that caused the death of another, (©) acting under cirenmstances evidencing a depraved indifference to human life, knowingly engage in conduct which created a grave risk of death to another and thereby caused the death of another; TW, DAO # 16024551 Page 2 (@) (@ engage in the commission, attempted commission, or immediate flight from the commission or attempted commission of any predicate offense, or was a party to the predicate offense. COUNT 2 FELONY DISCHARGE OF A FIREARM WITH SERIOUS BODILY INJURY, 76-10-508.1 UCA, First Degree Felony, as follows: That on or about October 25, 2016 at 615 Bast 8000 South, in Salt Lake County, State of Utah, the defendant did, (a) knowing or having reason to believe that any person may be endangered by the discharge of a firearm, discharge a firearm in the direction of any person or persons; (b) with the intent to intimidate or harass another or with intent to damage a habitable structure, discharge a firearm in the direction of any person or habitable structure; or (©) with the intent to intimidate or harass another, discharge a firearm in the direction of any vehicle. Furthermore, the aforementioned violation caused serious bodily injury to any person. COUNT 3 FELONY DISCHARGE OF A FIREARM, 76-10-508.1 UCA, Third Degree Felony, as follows: ‘That on or about October 25, 2016 at 615 East 8000 South, in Salt Lake County, State of Utah, the defendant did, (a) knowing or having reason to believe that any person may be endangered by the discharge of a firearm, discharge a firearm in the direction of any person or persons; (b) with the intent to intimidate or harass another or with intent to damage a habitable structure, discharge a firearm in the direction of any person or habitable structure; or (© with the intent to intimidate or harass another, discharge a firearm in the direction of any vehicle, COUNT 4 POSSESSING A FIREARM ON SCHOOL PREMISES, 76-10-505.5(3)(b) UCA, Class A Misdemeanor, as follows: That on or about October 25, 2016 at 615 East 8000 South, in Salt Lake County, State of Utah, the defendant did possess a firearm, or sawed-off shotgun, as defined in Utah Code § 76-10-501, at a place that the person knew, or had reasonable cause to believe, was on or about school premises. Frampton, Erin Hemingway, M Pickarozyk, and Iii DECLARATION OF PROBABLE CAUSE: ‘Your affiant bases probable cause for this Information on information and evidence collected by Sandy Police Department, Case No. SY2016-53328 and the following: The statement of Officer M. Pickarezyk that on October 25, 2016 he responded to a school shooting at Union Middle School located at 615 East 8000 South in Salt Lake County, Utah, Officer Pickarezyk stated he arrived on scene and noticed a male, who was later identified as ll MRE | ying 07 the ground bleeding heavily fiom his face. Officer Pickarezyk stated he asked bystanders where the shooter was, and a male on the ground stated, “Iam.” ‘The male was identified as The statement of Detective E. Alexander that he responded to IMC Hospital wherellli was receiving treatment for two gunshot wounds. Detective Alexander stated he observed two ‘wounds on the right side of Iiihead and face. Detective Alexander stated one appeared to possibly be an entrance wound on the right side of Il skull above his ear, Detective Alexander stated he was told the exit to this wound was on top of SSRI head that was covered by his hair. There was another wound on Iii right cheek that had more tissue trauma and was possibly an exit wound. ‘The possible entrance to that wound was found on the left side oI neck a couple of inches behind his ear. Detective Alexander stated he was advised that one of the rounds appeared to have “nicked” the carotid artery and fractured one of his vertebrae. Detective Alexander stated was intubated and sedated. Detective Alexander stated on October 26, 2016 he returned to IMC and found iilwas still sedated and was being prepared for another surgery because more bone fragments had been detected in his brain and his jaw was broken, ‘The statement of Detective J. Frampton that he met with IEEE mother, Cynthia Manzano, who advised Detective Frampton that her firearm was missing from her closet. ‘The statement of Erin Hemingway that she is a teacher at Union Middle School, and was outside ‘on duty when the incident occurred. Ms. Hemingway stated she saw Il walking toward (GRBWIM yith his hands up and realized there was a fighting scenario. Ms. Hemingway stated as she was about 150 fect way {om IEEE and INE she heard a shot that sounded like a “popper.” Ms. Hemingway stated as she got closer to the scene she saw MEM standing up and pointing a black gun, andW@l starting to fall. Ms. Hemingway stated she heard the first shot and then had visual contact and saw SRM try 10 shoot Il egain, but the gun “jammed” or something. Ms, Hemingway stated ill was on the und and she saw blood squirting from the victim. Ms. Hemingway stated she turned to RRM io oppo to his knees, and prabbed the sun out of his hand. Ms. Hemingway stated HB was lying on his back and gurgling blood, ‘The statement off that IINNINNNIE showed her andll a gun in his backpack. IINNIIIH stated he brought the gun to school and all tha happened, MME stated walked up to him and said, “Let’s just do this right now,” and he —_) pulled the gun out and pulled the trigger, MINNIE stated he shot illagain in his head, MINIM admitted he shoIIIlI twice, IIIB also admitted he had toldllllfthat he would reunite bim with his mother, who had passed away.
