Because the powers vested by our Constitution to
the several departments of the government are in the
nature of grants, not a recognition of pre-existing
powers, no department of government may exercise
any power or authority not expressly granted by the
Constitution or by law by virtue of express authority of
the Constitution.
Executive Order No. 68 establishes a National War
Crimes Office, and the power to establish government
office is essentially legislative.
The order provides that persons accused as war
criminals shall be tried by military commissions.
Whether such a provision is substantive or adjective, it
is clearly legislative in nature. It confers upon military
commissions jurisdiction to try all persons charged
with war crimes. The power to define and allocate
jurisdiction for the prosecution of persons accused of
any crime is exclusively vested by the Constitution in
Congress.
It provides rules of procedure for the conduct of
trials. This provision on procedural subject constitutes
a usurpation of the rule-making power vested by the
Constitution in the Supreme Court.
