SOALAN TIGA/QUESTION THREE
iamond Ria Co. Ltd. (DRC) mempunyai kira-kira 200 orang pekerja, dari pengurusan
atasan hingga pekerja peringkat bawahan. Kebanyakan pekerja merupakan abli kesatuan
sekerja. Sejak beberapa tahun lalu, telah menjadi amalan pihak pengurusan untuk
menawarkan kekosongan jawatan peringkat atasan di DRC kepada orang luar. Para
pekerja tidak berpuas hati dengan amalan ini lalu menuntut supaya pihak pengurusan
terlebih dahulu_mempertimbangkan kedudukan pekerja sedia ada yang memiliki
kelayakan yang diperlukan dan kemahiran yang sesuai bagi mengisi kekosongan jawatan
tersebut, jika ada. Pihak pengurusan walau bagaimanapun mendakwa bahawa pekerja dan

walau bagaimanapun mendakwa, sama seperti pekerja-pekerja lain, Amin mesti bersara
kerana setiap pekerja mesti meninggalkan jawatan sebaik mencapai usia 55 tahun.

Diamond Ria Co. Ltd. (DRC) has around 200 workers, from top management to lower
level workers. Most of the workers are union members. For the past few years, it has
been a practice of the management to offer outsiders for any vacancy in higher positions
in DRC. The workers were unhappy with this practice and subsequently demanded the
management to first give consideration to the existing workers with required
qualifications and appropriate skills to fill up the vacancy, if any. The management
nonetheless argued that the workers and the union have no right to dispute this absolute
right of management.
Due to economic difficulty, DRC had to exercise restructuring. As a result, a number of
workers had been retrenched. Few of the workers disputed this exercise. According to
them, the termination was illegal because DRC had failed to abide by the retrenchment
procedure when the newcomers are retained while the seniors are terminated.
Recently, Amin, an officer at DRC was asked to retire because of reaching the age of 55.
Amin refused to do so instead produce his appointment letter which mentions nothing
about retirement age. DRC however claimed that, similar to other workers, Amin had to
retire since every worker in DRC has to leave once attaining 55 years.
Give your advice to those affected above.
