That figure includes the consultation, exam, comprehensive case history, CBCT scan and analysis, report of findings (discussion of the findings of the scan and how the care would be administered going forward), adjustment, thermography studies, muscle testing and posture and weight discrepancy analysis. It is the most comprehensive study and scientific analysis available in the Chiropractic profession. All of this was explained to Mr. Sherrod in detail on his first and second visits. We are only going to request that he pay for his CBCT scan. Once he pays $200., he ean pick up his scan. We feel that Mr. Sherrod would benefit from specific Upper Cervical Chiropractic care and we would be happy to refer him to one of our colleagues if he so desires. Fiore, D.C 714 543 2430 I feel compelled to address your latest correspondence “fact by fact” since it contains so many discrepancies, misrepresentations, omissions, unfounded assumptions, false accusations and statements that are an affront to the rigorous scientific and ethical standards of Upper Cervical Chiropractic care at this clinic that have no basis in fact or research. I normally wouldn't waste my time on an issue like this, but your faets are so preposterous and distorted that the necessity to clarify them became the paramount concen. ‘We will address the issues in order: Fact 1. Mr. Sherrod, an Afro-American male, presented to this clinic on 7/21/16 seeking care for low back pain. Fact 3. Mr. Sherrod was asked to listen to the “cups and saucers” video BEFORE he came into the clinic. We ask ALL our new patients to do this before they come in for care so that they will know what we are doing and why. He watched the wrong video. Fact 4, We requested Mr. Sherrod watch the correct video when he came in on 7/21/16. If he had followed instructions, he wouldn’t have had to watch the correct one, and he had the choice to decline to watch it. My secretary, Mrs. Suanne Baker gave him 6 forms to {ill out — a patient history, basic info about his address, phone, who referred him.etc. This is the normal procedure in any doctor's office! He did not receive 25 forms to fill out! We have all his paperwork in his file. Our exam and consultation for Mr. Sherrod was extensive, not “preliminary” as you erroncously suggest. It took a good half hour and was very extensive. We explained, in detail, how we felt that our approach would aid in Mr. Sherrod’s recovery and what we would need to proceed. We explained that we could get a CBCT scan done for Mr, Sherrod and the reasons why the scan was important to help his body recover from his low back pain. At that time we also did a thermographic study of his, cervical spine and showed him what a CBCT scan looked like and reiterated its importance and relation to his low back pain. We never suggested any 3-D X-ray studies. We also explained that his course of care would involve more than his initial visit, that future visits would cost $50 and that if he needed another adjustment the cost would be $75, all of which were contingent on the analysis of the scan — we would be able to let him’ know how much time we needed to stabilize his spine especially taking into consideration that he had surgery on his low back while in the Navy (he disclosed this to us during his initial examination). We also explained how the visits would be structured over time. We were told by Mr. Sherrod that he might not be able to afford the $500 that it would cost initially. He was informed that we would be able to work out a payment plan with him to make it easier for him to get the care he needed to resolve his health care. We did have a CBCT scan scheduled for him, as this is the most cutting edge, scientific study of the cervical spine. He was instructed that post adjustment he might feel light- headed for a brief time and would probably be tired that night. We explained that he might need 12 weeks of care ~ 2 times a week for the first 2 weeks, then once a week for 2 weeks, then once every 10 days for 2 weeks, then once every 2 weeks for 2 weeks, then once a week for 3 weeks, afier such time we suggest one visit every month or two. This is standard procedure in our office for new patient care. We usually need some time to stabilize the patient's nerve system. We also asked him to refer others if he thought that this method of Chiropractic care was helpful. ‘After a 45 minute rest period, we re-examined Mr. Sherrod. We went through all the tests We did before he was adjusted and rested. He obviously neglected to inform you that his pelvis was level, his head tilt was gone and he was looking straight ahead, his shoulder and pelvic rotation were gone, his weight was balanced on both feet (pre adjustment there was a 15 pound weight difference) and his 1 inch leg discrepancy on his right leg was gone and his legs were even. ‘When it came time to pay for services rendered, Mr. Sherrod, who was told on his first visit the cost of care, informed us that he only had $70 to pay us and that giving it to us would mean that he couldn't afford to eat! We told him that we didn’t want to create a financial hardship for him so we told him he could pay us on his next visit and we would ‘work out a payment plan for him. On 8/11/16 my secretary sent him a letter explaining that he had missed his follow up appointment and presented a payment plan for him to consider. We asked him to contact us. To date, we haven't heard from him. At no time was the fee of $150 ever suggested or implied. The truth of the matter is that all the costs and course of care were explained to Mr. Sherrod on his first visit on 7PANG! At that time, as well as on 8/8/16, we explained to Mr. Sherrod how the course of care was specifically geared to help resolve his low back problem. We also discussed on 8/8/16 the fact that the surgery he had while in the Navy on his low back was an issue that compromised the stability of his low back and that was never going to go away. This was not an “after the fact” issue. Mr. Sherrod and I had discussed how detrimental this problem is on his first visit when we did the consult and exam. As I have stated previously, we explained all the charges and what they were for on Mr. Sherrod’s first visit, We follow these procedures with all of our new patients so that there is no misunderstanding and all their questions are answered. We have them sign a “Terms of “Acceptance” form so that we can work together toward achieving the goal of health for each individual through specific Upper Cervical Chiropractic care. Fact 7. In light of the information I have presented above, the inference that this is some sort of “bait and switch” tactic is not only preposterous and ridiculous, but an affront 10 the standards to which we adhere. I can only assume that you were not properly informed of the “full disclosure” we presented to Mr. Sherrod on both of his visits. D.C 714 543 2430 time and effort to explain to him what we could do to help him to specifically resolve his problem, Which brings us to Fact 16, 17 and 18: Having presented the facts relating to Mr. Sherrod’s visits and care, only an uneducated person would have the gall to assume that, this was a case of a “test subject” or have the audacity to claim that there was an intent to “swindle or deceive” patients, I have been a Chiropractor for 38 years and have never been confronted with such unfounded lies and accusations. As far as my secretary Mrs. Suanne Baker is concerned, she was doing her job ~ trying to follow up on a non- compliant patient who was trying to get care without the responsibility of paying for it. 1 really do not want to have anything to do with people of your caliber. If Mr. Sherrod would like his CBCT scan, he will have to pay $200. He can mail us a check. If he would like care, we can refer him to another Chiropractor because we certainly cannot give him care in our clinic. Consider this matter closed. Please do not contact us further.
