DECISION
Maria Vda. De Manuel was formerly awarded the Transfer Certificate of Title
(TCT) No. 0108 with CLOA No. 37077 involving a landholding with an approximate
area of ten thousand two hundred seventy (10,270) square meters located at
Hacienda Intal, Baggao, Cagayan.
Pursuant to DAR Administrative Order No. 03, series of 1990, the Provincial
Agrarian Reform Officer issued an order of Cancellation of Award to her.
Antonio G. Miguel, the actual tiller applicant, was awarded the same
landholding and consequently executed an Affidavit of Assumption of Rights and
Obligations and prays for the cancellation of the previous CLOA and for the issuance
of another CLOA in his favor.
After judicious examination of the records, this office, finds the petition
meritorious and resolves to grant the same.
As prayed for, judgement is hereby issued, directing the Register of Deeds of
Cagayan to cancel TCT 0108 and directing DAR, Provincial Office to issue new CLOA
in favor of the petitioner.
