MANIFESTATION

COMES NOW, Defendant, __________________, through

the undersigned counsel, and unto this Honorable Court,
most respectfully states that:

1. Defendant ________________ received an order dated June 15,

2016 requiring the latter to submit its written manifestation

whether or not the case will be heard, tried, and decided by

the JDR judge.

2. In compliance of the said order __________ most respectfully

manifests that the case be heard, tried and decided due to the
disagreement of the heirs as to the compromise agreement;

3. ________ further manifests that it is willing to comply with the

condition in the amended compromise agreement but is afraid
that some of the parties therein may not anymore recognize
their conformity in the said compromise agreement.
___________ prefers to resolve this matter in one setting so as it
will not anymore be bothered by future litigation. If other
parties are changing their minds, the Court may just
terminate the JDR and proceed with the presentation of
evidence.
