BACKGROUND: The City of Livingston received a Roberti-Z’Berg-Hartis Nonurbanized Area Need-Basis Grant (RZH Grant) from the California Department of Parks and Recreation in the amount of $477,422. for improvements to the Joseph Gallo Park. Conditions for the grant award included that the City of Livingston file a deed restriction on the property where the RZH grant-funded improvements would be located, The City shall maintain and operate the property for a period of 20 years only for the purposes for which the grant was made and shall make no other use or sale or other disposition of the property, except as authorized by the deed restriction agreement, The deed restriction period shall be in effect up and until June 30, 2031.
