NOTIFICATIONS BY GOVERNMENT ee MUNICIPAL ADMINISTRATION & URBAN DEVELOPMENT DEPARTMENT APCRDA- MASTER PLAN AMENDMENT REGULATIONS (CHANGE OF LAND USE POLICY) [CRDA-11024/4/2016-AP2-, PLNG-APCRDA, dated 31st March, 2016] PublieNotice ection 19 of APCRDA Act 2014) Iris lereby informed thai standing orders on change of land use policy in APCRDA Region was approved inthe executive Committee meeting of APCRDA on 3" March, 2016, In fture, all Change of Landuse proposals inthis region are dealt with the following procedure approved in the above said E.C. Meeting, MASTER PLAN AMENDMENT REGULATIONS (Change of Land use) as approved in Executive Committee of APCRDA on 3" march, 2016 1. General (1) Policies and proposals within the Master Plan represent the intention of Authority. Itis appropriate and necessary that the Master Plan be reviewed and amended regularly to ensure that it continues to represent community standards and valués, (2) Applicants submitting development and zoning requests cence ne ni - ~ + elements, must first request approval of an amendment to the Master Plan. Project proposals that are not in conformance with the Master Plan shall not be approved until such proposals are modified 6 be ". inconformance or the Master Plan is amended to allow for the proposal. (3) Change of Land Use (CLU) shall generally be discouraged up to five years. Any request fora CLU shall only be considered on grounds laid down in these regulations. N ANDHRA PRADESH GAZETTE EXTRAORDINARY Part (5) All Change of Land Use (CLU) cases shall be examined with reference to surrounding land uses and should not affect the integrity of the neighboring land uses. (©) Pollution creating activities shall be considered only after public hearing in a grarn/ward sabha held with local residents/land owners and AP Pollution Control Board. (7) Proposals for deletion of road network shall not affect the circulation pattem of that locality, (8) Authority shal levy special impact fée for CLU cases depending upon the usage and location on case to case basis. 2. Criteria (1) norder‘for a Master Plan amendmentto be approved, it must beshown that: (there is a factual defect inthe map, illustration or section ofthe plan with which the proposal isin conflict; or Gi) the proposal will further another important aspect ofthe Master Plan andits elements. Q)inorderfora CLU to be approved, it must be shown that: (@ master plan has omitted incorporation of approved layouts or buildings or changes in zonal plan; or pte proposal wil athe other important espectf the Master Plan endits elements suchas (@) © Largerinterest of the public, or (b) _largescale employment generation, or (©) economic development of the area; or ii) thereisarequestmade by government departments/ goverment agencies 3, Development Impact Assessment Inorderto show that the proposal meets one of the criteria specified in these regulations, the request must be accompanied by a formel analysis (Development Impact Assessment) which outlines: (how the profiosa! differs fiom the Plan andiitselements; * 7 Gi) how it meets one of the criteria; Gow the Plan andits elements would ned o be changed tallow forthe proposals Gv) the justification for the proposed change; (v) the positive and negative effects of the difference; and (vi) how the applicant proposes to mitigate the effects. 4.Procedure - (1) Prior to considering the CLU, the following shall be prepared: Gi Remarks submitted by the Local body Gil) Development impact Assessment ()After examining the proposal andin the event of recommending change land useit shall bé placed before the Executive Committee with a report end relevant plans with fall particulars of proposed modifications. 3) After approval by Executive Commitee, the same shall be published in two leading local newspapers calling for objections and susgestions ftom the interested / affected persons giving a time period of 15 days. (A) All the objections/ suggestions shell be examined in detail and if the CLU is approved by the executive committee, a gazette notification shall be published accordingly. Thaddition to the aforementioned method, on oceasion the Authority may find thatthe community supports an initiative that is not in conformance with the Master Plan. In such a case, itis evident that the Master Plan is incomplete, since it does not accommodate a new objective of the Authority. Itisnecessary, then, toamend the Master Plan ina consistent manner to reflect the will of he community. Amendments may also be approved periodically following formal review ofthe Mester Plan.
