Publications,whichstartedabroadafewdaysafterthe2015generalelectionforthe20 th
Knesset,andwhichwerelaterfollowedbypublicationsinIsrael,raisedsuspicionsof
materialcomputerfraudinthe2015generalelection.Therefore,IfiledaFOIArequestwith
theCentralElectionCommittee[CEC],inanattempttodocumentdevelopment,validation,
implementation,operationandsecurityincompliancewithbindingstandards.[1]
ThenamesofthreeattorneysappearonthepervertedCECsFOIAresponse:1.EladNaveh
FOIAOfficer;2.OrlyAdasCentralElectionCommitteeCEO,3.DeanLivnehCentral
ElectionCommitteeLegalAdvisor.[2]
ReplyontheCECsFOIAresponsenotesthattheinformation,whichwasprovidedinthe
response,waspartlyinvalid,partymisleading,andfailedtoprovidethekeyrecordswhich
hadbeenrequests,includingbutnotlimitedto:[3]
AccordingtotheCECsresponse,validityandintegrityoftheCECsITsystemsmostly
dependedononepersonMrLazarDudovitch,whoselawfulappointmentrecordthe
CECfailedtoprovide.TheCECalsofailedtoprovidetherequestedcertificationrecords,
pertainingtovalidationofthesystemsbythesameperson.
TheCEC'sresponsetriestorepresentthepublicationoftheelectionreturnsintheCEC's
websiteasanautomatic,nohumantouch,onetimeonly,unchangeableprocess.The
CECalsofailedtoprovidetherequesteddocumentationregardingtheperson,under
whoseauthoritysuchinformationispublishedintheCECwebsite.However,
adulterationsofthedataontheCECswebsitehavebeenrepeatedlydocumentedin
recentmonths...
TheCECclaimsinitsresponse,thesystemswereexaminedandcertifiedbythe
authority[ShinBetReemjz],buttheCECfailedtoprovideanyoftherequested
documentationofsuchcertification.Incontrast,theStateOmbudsman'sreportfollowing
the2015generalelectionindicatescriticalfailuresinsystemsecurity(novalidentrylog),
whichhadnotbeencorrectedfollowinghisreportonthe2013generalelection.
Theallegedcomputerfraudinthe2015generalelectionunderminesthefoundationofany
lawfulauthorityofthe20thKnessetandthecurrentgovernment.IfindeedtheShinBetis

involved,asclaimedbytheCEC,thematterhasseriousimplicationsrelativetocompetence
andintegrityoftheShinBet,andthenatureoftheregimeinIsrael.

standardspertainingtotechnicalspecifications,coremanagementofdevelopment,
independentexamination(includingvalidation)byaStateemployee.Yourresponse
(paragraphs23)statestheroleinthisregardofMrLazarDudovich,Committee
employee,whoservesasHeadofITandOperationsintheCentralElectionCommittee.
However,nodocumentationwasprovidedofMrLazarDudovichslawfulappointmentin
thisregard.

providedonlyoneCertificateofAcceptance,andwhyforthisparticularmodule,
whichissecondarytothemainfunctionofthesystems.
b)Therecord,whichisdescribedinyourresponseasModule30certificateof
acceptance(RecordNo4,Table1),wasfiledbyMalamSystemsIncascertificateof
acceptanceforModule30DesignFile.WhatDesignFileis,canbefoundin
ChapterRealization(RecordNo7,Table1),Article4.2.3.5.Itclarifiesthat
certificationofacceptanceofDesignFiledoesnotreflectdetailedexaminationprior
toimplementation,andthereisnowaytoconcludeanythingregardingcertification
ofthemodulepriortoitsimplementation(transferintoproductionenvironment)
fromsuchrecord,surelysuchrecorddoesnotrelatetoanyindependentexamination
(includingvalidation)byaStateemployee.
Therefore,Ihereinrequestagaindocumentationofindependentexamination(including
validation)ofthesystemsbyaStateemployeepriortoimplementation.
Paragraph2inmyrequestseeksdocumentationoftheperson,whoholdstheultimate
administrativeauthorityregardingthesystems.Yourresponsestates(paragraph5):The
ultimateadministrativeauthorityisheldbyCentralElectionCommitteeCEOAttorney
OrlyAdas.However,youfailedtoprovideanydocumentationofsuchstatement.
Therefore,IhereinrequestagaindocumentationtheCentralElectionCommitteeCEO
ultimateadministrativeauthorityrelativetothesystems(asfarassheindeedholdsthe
ultimateadministrativeauthorityinthismatter).
Paragraph3inmyrequestseeksdocumentationoftheauthorityofaStateagency(if
any)relativetosecurityofthesystems.Yourresponsestates(paragraph6):TheCentral
ElectionCommitteeoperatesthroughdeliberationswiththeNationalInformation
SecurityAuthority(Reem)[ShinBetjz],andactsaccordingtoitsguidelines.The
systemswereexaminedandcertifiedbyReem.
a) Unauthorizedresponse,whichwaspreviouslyreceivedfromaperson,whoappeared
asReemaffiliate,adamantlyclaimedthattheShinBet/Reemheldnodutyor
responsibilityrelativetosecurityofITsystemsoftheCentralElectionCommittee.
b) StateOmbudsmanreportregardingthe2013GeneralElectionstatesacriticalfailure
insystemsecuritynonexistenceofavalidentrylog.AndtheStateOmbudsman
reportregardingthe2015GeneralElectionstatesthatthesamecriticalfailurehad
notbeencorrectedfollowinghispreviousreport.Suchfailuresinsystemsecurity,in
systemsthatwerepurportedlyexaminedandcertifiedbytheShinBet/Reemwould
raiseevenmoreseriousconcerns.
Therefore,Ihereinrequestagaindocumentationofexaminationandcertificationofthe
systems,relativetosecurity,byaStateagency(ifany).

site.Yourresponsestates(paragraph7):Insuchinputlocations,pollingreturnsare
keyedindirectlyintothecomputingsystemattheendoftheprocesstheelection
returnsaremechanicallytransferredforpublication...Basedonthedescriptionthatyou
provided,thereadermayunderstandthattheprocessofpublishingtheelectionreturns
intheCentralElectionCommitteewebsiteisanautomated,nohumaninterference,one
timeonly,unchangeableprocess.
a) ChapterRealization(RecordNo5,Table1),Article2.19says:Thesystemwill
includeverysensitivedata,anditmustpreventanypossiblechanges,orevenreading,
absentexplicitauthorization.
b) Recently,repeatretroactivechangeshavebeendocumentedintheGeneralElection
returnsdata,whicharepublishedintheCentralElectionCommitteewebsite(Figure
1).

a)Theletter,referencedabove,isanelectronicrecord,bearingagraphicsignature.As
clarifiedbytheMay31,2012OmbudsmanoftheJudiciaryDecision(12/88/TelAviv
District)intheJudgeVardaAlshechFabricatedProtocolsscandal,suchrecordsare
invalid,merelydrafts.[3]Moreover,thatscandalandothersimilaraffairsclarified
thatthepublicationbygovernmentofficersoffalseandmisleadinginformation,with
theintentiontodefraud,undergraphicsignatures,isnottreatedascriminal
conductintheStateofIsraeltoday.Receiptofelectronicfilesbyemailstreamlines
theworkprocess,butabsenttheuseoflawfulelectronicsignatures,itisimpossibleto
acceptsuchrecordsasvalidresponpse.
Therefore,Ihereinrequestthatyourresponse,referencedabove,andyourresponse
oninstantreplybealsoprovidedbymail,onpaper,bearingyourwethand
signatures.
