MASSACHUSETTS, INVOLVING MYSELF AND MY RESPONSE, TO DETECTIVE SERGEANT TIMOTHY
MCDONOUGHS FAX DATED 1/5/17 TO JANET DUTCHER, RESPONSE TO HIS INVESTIGATIONS,
RESPONSE TO THE STATEMENTS OF WITNESSES AND MY RESPONSE TO THE OFFFICERS INVOLVED
AS WELL AS THEIR STATEMENTS.

To whom it may concern,

SUMMARY OF ACTUAL EVENTS.


June 4th, 2016, I arrived at the Marriott hotel in Burlington Massachusetts as I have many times
before, to have a good time, to have a relaxing time and to have a break from working, I booked
2 rooms, I would never drink a sip of alcohol and drive the same day. Myself and my girlfriend
Michelle Griffin arrived for dinner at the Chopps restaurant located within the hotel at
approximately 1921. Dinner concluded at approximately 2048. Myself and Michelle Griffin each
had two beers and one small mixed drink along with dinner during this time. That is
the only thing we had to drink during the entire evening as evidenced by the receipt from
Chopps which is attached. Myself and Michelle Griffin went out to the lobby approximately
2250 and were discussing some personal business.
At this time, a front desk employee which I later learned to be Amanda Whalen approached
Myself and Michelle Griffin, and told me to get away from my girlfriend, I responded to
Amanda Whalen with what are you talking about.
Amanda Whalen then stated to Myself, Get away from her or I will call the police, I responded

with, I will call them myself as I have no idea what you are talking about. I was confused at
this point. Michelle Griffin then stated to Amanda Whalen, Why are you making him leave.
At this time, I proceeded to call the Burlington police, I requested assistance and they said they
would have someone one the way. A security guard whom I later learned to be Riguad Jean
Baptiste had walked over at this point and I let him know that I had phoned the police. At this
Point, Myself and Michelle Griffin and the security guard had proceeded to wait inside the
lobby, while Myself and Michelle Griffin continued to talk about what was going on, but by
the front doors until the police had arrived. The Police Arrived. Myself and Michelle Griffin
proceeded out the front doors to meet with them outside. I met Officer Otterbridge First
walking out the front door. After quickly greeting him. He advised me to go and speak to
Officer Minichiello, which I immediately proceeded to do. Officer Outerbridge remained to
speak with Michelle Griffin. They were closes to the doors of the hotel. I was along the road
with Officer Minichiello. Officer Minichiello immediately asked me what the fuck I
was doing here, I responded with I am a guest. Officer Minichiello, then stated I should get
the fuck out of here. I responded with I am a guest once again. At this point Officer
Minichiello starting walking up very close to me and in my face, trying to physically intimidate
me, while yelling, swearing and repeatedly telling me to get the fuck out of here. As I
attempted to explain once again why I had called for assistance, Officer Minichiello kept Yelling
at me, what the fuck do you want me to do about it, I responded with, Can I try and explain
why I had called for assistance, Officer Minichiello again repeated I am telling you to leave
now.
At this point, Officer Minichiello was getting more and more angry with me and was so close

to me he was breathing in my face while yelling and screaming at me FACE TO FACE WITH
ME. At this point I tried to advise Officer Minichiello that there were cameras watching,
which I had thought existed.
I just had a feeling he was going to attack me. Officer Minichiello then responded
with I dont give a fuck whats around. I proceeded to tell him just fuck off then. At that
point, Officer Minichiello attacked me, grabbed me and smashed me onto the ground, putting
handcuffs on me, I was on my side laying on the pavement. After I had handcuffs on me
while Officer Minichiello was sitting on my broken leg on top of me, I heard some commotion,
I heard Michelle Griffin yelling that I had previous injuries to my leg. She was obviously
watching the entire incident unfold as the moment I hit the ground I heard her screams. At that
point, Officer Outerbridge came over AFTER I was already handcuffed and AFTER Officer
Minichiello was on top of me. I did proceed to call Officer Minichiello, fat as he was sitting
on my broken leg, along with a few other names, but that was after I was attacked, already in
handcuffs and on the ground with Officer Minichiello on top of me. I then stated to
Officer Outerbridge when he came over. AFTER I was in handcuffs and AFTER Officer
Minichiello was sitting on top of me, that My leg was broken and I was requesting
an ambulance. After a few minutes of laying on the pavement with Minichiello sitting on top of
me, The Burlington ambulance came and then transported me to Lahey Clinic in Burlington.
Officer Outerbridge had absolutely no part in arresting me, touching me and or anything to do
with throwing me on the ground. He simply accompanied me to the hospital in the ambulance.

OFFICER MICHAEL MINICHIELLO ORIGINAL REPORT, SECOND REQUESTED REPORT, INTERVIEW.


Officer Minichiello states in his original report dated 6-5-2016 at 0254,
That Basler had walked up to me upon my arrival and stated I think you are here for me. This
is not true. I greeted Officer Outerbridge first while walking out the door and it was Officer
Outerbridge Who advised me to go and speak with Officer Minichiello while he Outerbridge
remained with Michelle Griffin.
Officer Outerbridges report dated 6/10/16 states Outerbridge first notes Basler was friendly to
him. Officer Minichiello states in his original report dated 6-5-2016 that Officer Outerbridge
arrived on scene after I was speaking to Officer Minichiello, not true. Officer Minichiellos
report dated 6/5/16 at 0254 states Upon my arrival, A male party later to be identified as George
Basler , walked up to me and said I think you are here for me. Officer
Outerbridge Interview dated 8/23/16 in which Officer Outerbridge states, Upon arrival he was
greeted by Basler and then moved approximately 25 feet away to talk to Griffin and Canales,
Outerbridge goes on to say that Minichiello and Basler were by the front door of the hotel near
the roadway. Which is it? Did Minichiello arrive first as he stated or did Outerbridge? Was I out
of control as Minichiello Implies in his first fictitious report or was I friendly as Outerbridge states
or as Minichiello states in his new revised fairy tale? Officer Minichiello states
in his report that he asked me to refrain from using profanity and lower my voice but the only
one using profanity at this time was Minichiello. Officer Minichiello states in his report dated
6/5/2016 at 0254 that His language only increased in volume yet Officer Outerbridge
Interviewed dated 8/23/16, stated He also could not hear much of what Basler what saying
then either. Which was it? Outerbridge was second closest out of anyone to Myself and

Minichiello, Michelle Griffin being the first. Officer Minichiello goes on to state in his report dated
6/5/16 at 0254, that a crowd had now gathered yet the only witness statements were 3
Marriott Employees who completely contradicted even Officer Minichiellos false reports.
Nobody in the crowd wanted to give a uniformed police officer an unbiased and impartial
Witness statement?
Officer Minichiello goes on to state in his original report dated 6/5/16 at 0254, I advised Basler
that he was putting himself in violation of disturbing the peace, For safety reasons
I advised Basler he was going to placed in protective custody for his own safety, I asked Basler
to turn around so I could handcuff him, As I reached for his arm he became volatile and was
actively resisting my attempts to place him in handcuffs As I grabbed his arm, he then became
harmful and started to fight with me, I brought Basler to the ground and placed him in handcuffs.
Which was it? Disturbing the peace and or Protective custody?
Officer Minichiello states in an updated report dated 7/6/16 and in an interview where he was
compelled to answer questions on 7/1/16 that Basler started out by being friendly, Basler then
use profanity at that point Minichiello thought Basler was going to swing at him, He grabbed
Basler in a bear hug and brought him to the ground, Minichiello did not know how far away
Officer Outerbridge was because he was behind him, Outerbridge did assist in handcuffing Basler
on the ground, Minichiello did say Lt McDade told him to uncuff Basler prior to transport to
Lahey. Officer Minichiello in his original report dated 6/5/16 at 0254 stated I brought him to
the ground and placed him in handcuffs. Officer Outerbridge never touched me a single time,
The only thing Outerbridge did was call an ambulance and take a ride with me to Lahey as stated
in Officer Minichiellos original report.

Officer Minichiello in his report #2 dated 7/6/16 states Basler stepped back, turned his body,
bladed, raised his fists and stood in a fighting stance. That was the new reason for attacking me.
FYI, the police stance knows as Blade is a defensive stance taught in academys, It is not an
Aggressive and or offensive stance as stated here.
Officer Minichiello states in his report dated 6/5/16 at 0254 Basler then complained of an injury
of his left hip. Officer Minichiello states in an interview dated 9/2/16 stated Minichiello
requested an ambulance when he realized Basler was in pain.
Officer Minichiello states in his report dated 6/5/16 at 0254 I noted Basler seem to move his
left leg and hip area with no complication or without showing any pain or discomfort,
Sometime later I went to the ER to check on the status of Basler. I was told he walked out
refusing treatment and that he created a large scene in the lobby of the hospital.
Nicole OLeary RN, Lahey Clinic Burlington states in a report dated 6/5/16 at 0136 Patient
requests to seek care at a different facility, Patient hopping WR. Patient hopped out of the ED
door.
Tim McDonough dated 7/14/16 I spoke with Lahey Clinic supervisor John Annese. Annese told
me there were no reports from his security officers concerning Basler at the ER. He also said that
any video of the ER (Showing Basler leaving or entering) would have already been erased if
uneventful.
Officer Minichiello states in his original report dated 6/5/16 at 0254 that there was nothing
wrong with my leg and or hip which again changes in his future statements. Minichiello then
travels to Lahey Burlington to try and gather support for his false statements and created further
false statements in report dated 6/5/15 at

0254. Minichiello states Basler created a large scene in the lobby of the hospital and then
WALKED
out. Turns out I did in fact have a broken Knee, I was in severe pain immediately after being
attacked and thrown to the ground without warning, there was absolutely no scene in Lobby in
which security was called on me at Lahey Clinic Burlington as stated in his report dated 6/5/16 at
0254.
I received no care and or relief from Lahey which in my opinion was due to Minichiello going and
talking to the staff at Lahey Burlington in an attempt to downplay my injuries as stated in his
reports Basler WALKS out of ER, Basler showed no signs of pain and or discomfort, Basler was
moving his leg and hip freely, Basler created a large scene in the lobby all of which are not true.
Why he was at the hospital inside the emergency department is questionable at the very least,
why he spoke to anyone in regards to my care is also questionable and in my opinion had a
profound negative impact on my treatment and or care at Lahey Burlington.

OFFICER DAVE OUTERBRIDGE REPORTS, INTERVIEW.

Officer Dave Outerbridge report dated 6/5/16 and confirmed in an interview dated 8/23/16
stated Upon arrival he was greeted by Basler and then moved approximately 25 feet away to
talk to Griffin and Canales, He said Minichiello and Basler were by the front door of the hotel near
the roadway. In complete contradiction to Minichiellos different versions of the same event.
Officer Dave Outerbridge in report dated 6/10/16 states Outerbridge first notes Basler was
friendly to him and then goes on to say that he observed Basler talk loudly to Minichiello and
raise his hands to his chest, soon after Outerbridge reports he observed Basler raise his fists
again, step back and get in a fighting stance, Minichiello then quickly grabbed Basler and brought
him to the ground where Outerbridge assisted Minichiello in handcuffing Basler. Officer David
Outerbridge in an interview dated 8/23/16 stated that he did not hear all of what Minichiello was
saying as he was far away at one point approximately 25 feet, Outerbridge goes on to state that
he also could not hear much of what Basler was saying then either.
In an interview conducted with Officer Mike Minichiello dated 9/2/16 stated Basler started out
by being friendly and then started to swear and use profanity. At that point Minichiello thought
Basler was going to swing at him, he grabbed Basler in a bear hug. Officer Minichiello in an
interview dated 7/1/16 stated Minichiello did not know how far away Outerbridge was because
he was behind him.
After greeting Outerbridge at the door and upon his arrival and same directing me to go speak
with Minichiello, Outerbridge stayed with Griffin, I assume to ascertain what was going on. I later
learned Outbridge had kept asking questions such as Does he hit you, Did he ever hit you To
Griffin. After being immediately separated I was not in a position to see Outerbridge or what they

were discussing as I was now speaking to Minichiello who was in front of me Blocking my view.
Officer Dave Outerbridge states in interview dated 8/23/16 Outerbridge said upon arrival that
he was greeted by Basler and then moved approximately 25 feet away to talk with Griffin and
Canales.
Outerbridge did not assist in handcuffing me, he did not see me getting into a fighting stance, he
did not see me raise my fists as this would have been physically impossible for him to do.
Officer David Outerbridge was in no position to see anything prior to my being attacked
and thrown to the ground as Minichiello was directly in between us and blocking both
Outerbridge entire view of myself as well as my own view of Outerbridge. Secondly,
He was communicating with both Griffin and Canales at this time. He came over to me after I was
already on the ground and in handcuffs. I then stated to Outerbridge that I felt like my hip was
broken as Minichiello continued to sit on top of me until the ambulance wanted to load me into
the truck. Once again, it would have physically impossible for Outerbridge to see any of what
transpired between myself and Minichiello after being separated.
Officer David Outerbridge in an interview dated 8/23/16 stated He had responded to a prior call
on 5/23/16 involving Basler. This is not true. I did see Outerbridge on a prior occasion at the
Marriot Burlington speaking to a front desk girl and asked if he wanted to take my Corvette for a
ride while it was out front and people were looking at it. I was not involved in a call with the
Burlington police dept.

WITNESS #3 AMANDA WHALEN NIGHT AUDIT SUPERVISOR MARRIOT EMPLOYEE


Amanda Whalen made a statement dated 6/4/16 to Tim McDonough Michelle Griffin requested
a Taxi to Pelham, NH. Amanda goes on to state that Michelle Griffin asked for George Basler
to leave her alone, They moved by a location near the fireplace and Griffin again in a raised
voice told Basler to leave her (Griffin) alone. Amanda then stated a few minutes later she went
to the front of the hotel and observed Basler swearing at the officers. Whalen said Basler was
threatening to fight then lunged at the officer, Basler was then taken to the ground as he was
struggling and cuffed.
Michelle Griffin in an interview dated 9/8/16 stated She was not trying to leave the hotel while
in the lobby. Griffin stated They (Basler and Griffin) were just talking in the lobby and not
causing a disturbance. Griffin stated Griffin asked employee (Whalen) why she wanted Basler
to leave, he wasnt doing anything. Griffin states They may have been loud but were not
arguing.

George Basler in an interview dated 8/9/16 states Griffin was not trying to leave the hotel.
Basler states (Marriot Employee) Whelan, thought they were arguing but they were not, They
(Basler, Griffin, Baptiste) moved to a location at the front and waited for the police.
Amanda Whelans statements are complete and utter fabrications False statements to police
As the Documented statements and interviews show. First, it would have been impossible
for her to view anything of what took place between myself and Minichiello as she would have
had to see through (Griffin, Canales, Outerbridge and Minichiello). Secondly, Whalens statement
completely contradicts even both officers version of events, All of them. Whalen also

mischaracterizes, adds things prior to and after the encounter with Minichiello which did not
occur for instance Griffin at no time ever requested a taxi to Pelham NH, Griffin also at no time
thanked Whalen and told her she did the right thing, I never Lunged at, threatened to fight
anyone at any time.

WITNESS RIGUAUD JEAN BAPTISTE, LOSS PREVENTION MARRIOT EMPLOYEE.


Rigaud Jean Baptiste in a statement dated 6/4/16 has a similar version as (Whelan) But Baptiste
stated Basler refused to leave griffin alone when requested to, Basler then became vulgar at the
officers and threatened to fight and lunged at the officer.
Rigaud Jean Baptiste statement are complete and utter fabrications False statements to police
Once again it would have been impossible for Baptiste to see what took place between myself
and Minichiello. He could not and did not see what happened between myself and Minichiello,
He would have had to see through (Griffin, Canales, Outerbridge and Minichiello). I
never Lunged at, threatened to fight anyone at any time. I also never refused
to leave Griffin alone, at no time did Griffin ever request that I leave her alone. Griffin
was by my side and accompanied me out of the main lobby to the doors to await the arrival of
the police.

I want to note here that two of the Marriott employees that were furthest away from the
incident (Batiste, Whalen) both state almost identical stories, both of which were beyond the
realm of possibility, it was not physically possible and simply did not happen.

WITNESS JAIMI CANALES BARTENDER MARRIOT EMPLOYEE


Jaimi Canales in a statement dated 6/4/16 Whalen threatened to call the police and Basler said
he would call first, when cops arrived Basler was mouthing off to them, Canales did not see all of
the events
Jamini Canales was the closest out of the three Marriott employees but was not in a position to
physically see what took place between myself and Minichiello as she correctly says in her
statement.

RESPONSE TO DETECTIVE TIMOTHY MCDONOUGH INVESTIGATION AND CONCLUSIONS


Detective Timothy McDonough in his conclusions stated that Minichiello eventually stated to
Basler that he had 2 options: go to his room or be placed in protective custody. Minichiello at
no time ever said such a thing me. Minichiellos own words depending on which version you
believe stated that either he was in fear and thought Basler was going to swing, That Basler
attempted to fight with him after attempting to grab his arm and or Basler used profane
language or Basler raised his fists in a fighting position at which point Minichiello THOUGHT
Basler was going to swing. Minichiello gave at-least three entirely different versions of attempted
justifications as to why he jumped on me, attacked me and smashed me onto the ground. At no
point did Minichiello ever ask to me to place my hands behind my back and at no time did
Minichiello tell me that I was going to be arrested and or placed into protective custody. Timothy
asked me during the interview if I had thought things would have turned out different if
Outerbridge had spoken to me. I responded I would hope that any officer of the law would not

act in such a way as Minichiello and that what Minichiello did was criminal, he was dangerous.
Timothy keeps going about this intoxication. However even after receiving receipts from the
hotel, a timeline of events he continues to use it as some basis for Minichiellos actions that
evening. Timothy also evidently disregards what doesnt fit and or support his positions,
completely ignoring logic and the evidence or is just not competent enough to put together the
facts that he has in his possession. There is a plethora of contradictory statements by both
Officers on scene that evening, 2 of the Marriott hotel employees made statements that defy
logic, could not have physically taken place and did not happen yet he continues to use it all to
justify his findings. Timothy also, mentions that I had made a statement on the recorded line that
I drank too much What he left out was the part that I was being questioned on the telephone
for attempting to get some sort of assistance and that it was in direct response to a question
posed to me that being Why are you staying at the hotel?
Timothy also states in his conclusions that There was certainly probably cause for criminal
charges, disturbing the peace or disorderly conduct, Yet once again he leaves out the fact that
Minichiello from the very beginning was swearing at me, yelling at me and telling me to get the
fuck out of there while I was simply trying to explain why I had called the police from the very
beginning. It was Minichiello that was completely out of control that evening. Timothy again
states in conclusions that Minichiello told me to go back to my room or be placed into protective
custody. Once again, this did not happen, Minichiello never said any such thing and once again,
depending on which version from Minichiello one wants to believe. Minichiello himself said that
he Minichiello grabbed my arm and Basler begin to fight in another Basler was using profane
language and Minichiello thought he was going to swing so Minichiello without warning

bearhugged Basler and brought him to the ground and in another Minichiello states that I raised
my fists and took a fighting stance and was then taken down Timothy is picking and choosing
which versions of the story, which facts and evidence he uses for his investigation, He is not
following the evidence. Is this how the Burlington Police department conducts investigations of
complaints into one of its own?
Finally, Timothy concluded by stating that What Basler thought Minichiello to be lying about
was Minichiellos subjective opinion of the event There is nothing subjective about calling the
police for assistance and having a cop yell at me, verbally abuse me, attack me, smash me onto
the ground and then make up numerous different versions of his so-called justifications for doing
so. Look at the statements and interviews, Look at the evidence.

Update.
While preparing this document, I received a fax from the Burlington Police department in regards
to my foia request as to an alleged previous call involving myself. It states That Burlington PD had
some formal interaction with me and made contact. This is not true and is the first time I am
hearing about the police being called on me for giving out tips. Fax transmission is included.
