EXTRAJUDICIAL DEED OF PARTITION

KNOW ALL MEN BY THESE PRESENTS: This AGREEMENT OF PARTITION entered into by and
between: SEAN VINCENT R. FORTICH, of legal age, Filipino, married to Jessica S.
Fortich, with residence and postal address at 1478 Begonia St., Ladislawa Villag
e, Buhangin, Davao City, Philippines; and JOSHUA C. DIONISIO, of legal age, Fili
pino, married to Mika M. Dionisio, with residence and postal address at 163 Sant
ol St., Buhangin, Davao City, Philippines, WITNESSETH THAT the Parties herein ar
e the registered co-owners of the parcel of land described in Transfer Certifica
te of Title No. 6557 of the Registry of Deeds of Davao City, more particularly d
escribed as follows: Beginning at a point marked 1 on plan of Ts-V-941-D, being N.
49-38E.,314.70 m. from Triangulation Station Davao Townsite; thence N.34-00 E., 4
0.00 m. to point 2; S. 5600E.,17.00 m. to point 3; thence to S.23-30E, 12.00 m. to
point 4; S.13-00W., 35.94 m. to point 5; N 56-00W m. to point 1, point of beginni
ng. Containing an area of ONE THOUSAND FOUR HUNDRED (1,400) SQUARE METERS. All p
oints referred to are indicated on the plan and are marked on the ground by PLS
cys.conc.mons. Bounded on the NW., along line 1-2 by Public Land (Lot 1, Block 4
, Dona Vicenta Subdivision); on the NE., and E., along lines 2-3-4 by Road; and
on the SW, along 5-1 by Public Land (Lot 3, Block4, Dona Vicenta Subdivision). T
his survey was executed under authority of Chapter XI, Commonwealth Act 141, as
amended, and in accordance with existing regulations of the Bureau of Lands, Reg
ie Andrei Lastimosa, Deputy Public Land Surveyor, on May 28, 2009 and approved o
n November 8, 2009. THAT the said Parties have caused the subdivision of the afo
resaid parcel of land into two (2) lots, each having an area of SEVEN HUNDRED SQ
UARE METERS (700), more particularly described as Lots 1 and 2 in the subdivisio
n plan (LRC) PSD-4829882 which was duly approved by the Land Registration Commis
sioner, to wit; Lot 1 (LRC) Psd- 4829882 A parcel of land (Lot 1 of the Subdivis
ion plan (LRC) Psd- 4829882 being a portion of the parcel of land described on T
S-V-542-C, LRC Rec. T.S. Sales Pat.) situated in the Res. Sec. B, City of Davao. B
ounded on the N.E., points 2 to 5 by Subdivision Road (10.00 m. wide); and on th
e SW., points 5 to 1 by Lot 2, of the Subdivision Plan; and on the NW., points 1
to 2 by Lot 1, Block 4 . Beginning at a point marked 1 on Plan. This containing a
n area of SEVEN HUNDRED (700) SQUARE METERS, more or less. Lot 2 (LRC) Psd- 4829

situated in the Res. Sec. B, City of Davao. Bounded on the SE., points 2 to 3 by S
ubdivision Road (10.00 m. wide); on the SW., points 3 to 1 by Lot 3, Block 4; an
d on the NW., points 1 to 2 by Lot 1 of the Subdivision Plan. This containing SE
VEN HUNDRED (700) SQUARE METERS, more or less. THAT the above Parties have agree
d and covenanted, as by these Presents, do hereby agree and covenant, that Lot 1
as above described shall appertain and belong to SEAN VINCENT R. FORTICH, his h
eirs and assigns, and that Lot 2 as likewise above described, shall appertain an
d belong to JOSHUA C. DIONISIO, his heirs and assigns.

NOW THEREFORE, for and in consideration of the above agreement, the Parties here
in shall have the Transfer Certificate of Title No. T-3805 CANCELLED by the Regi
ster of Deeds of Davao City, and in lieu thereof to ISSUE TWO (2) new certificat
es of title for the two lots in favor of the two owners, respectively. IN WITNES
