No person, firm, company, association or corporation shall construct, install,
establish, or operate a radio transmitting station, or a radio receiving station
used for commercial purposes, or a radio broadcasting station, without
having first obtained a franchise therefor from the Congress of the
Philippines; Provided however, That no franchise from the Congress of the
Philippines shall be necessary for the construction, installation, establishment
or operation of an amateur station, an experimental station, a training
station, a station on board a mobile vessel, train, or aircraft, or a private
station in a place so outlying and so remote as to afford no public
communication system with the outside station in a place so outlying and so
remote as to afford no public communication system with the outside world:
Provided, further, That radio broadcasting stations established and operating
at the time of the approval of this Act without the franchise herein required
shall be exempt for obtaining such franchise. Unless otherwise specified,
station or radio station as used in this Act shall refer to a radio
transmitting stationand its receiving equipment, a radio receiving station
used for commercial purposes, or a radio broadcasting station. (As amended

4. Republic Act
A Republic Act is a piece of legislation used to create policy in order to carry out the
principles of the Constitution. It is crafted and passed by the Congress of the Philippines
and approved by the President of Philippines. It can only be repealed by a similar act of
Congress.

The regulatory body for the telecommunications industry is the National Telecommunication
Commission (NTC). It is a government agency created under Executive Order No. 546
promulgated on July 23, 1979, and conferred with regulatory and quasi-judicial functions taken
over from the Board of Communications and the Telecommunications Control Bureau which
were abolished in the same Order.
Primarily, the NTC is the sole body that exercises jurisdiction over the supervision, adjudication
and control over all telecommunications services throughout the country.
6. Resolution
The determination or decision, in regard to its opinion or intention, of a deliberative
or legislative body, public assembly, town council, board of directors or the like.
