Hindi masasabing late registered ang birth ni Reynaldo dahil meron siyang
unang birth certificate. Dapat ang ginawa niya ay nagfile siya ng Petition for
Change of Name para sa maling name niya o kaya ay correction of entry.
Ayon sa Art. 376 ng New Civil Code of the Philippines ay nagsasabi na "no
person can change his name or surname without judicial authority". A
proseso sa pagpapalit ng pangalan o apelyido na may permiso ng korte ay
nasa Rule 103 of the Revised Rules of Court. Under Sec. 1 of said rule: "a
person desiring to change his name shall present the petition to the Court of
First Instance of the province (now RTC) in which he resides, or in the City of
Manila, to the Juvenile and Domestic Relations Court." Meron tayo bagong
batas na Republic Act No. 9084 at 10172 tungkol dito ngunit hindi lahat ng
mali o error sa entry sa birth certificate ay pwede nang ipa-correct sa Local
Civil Registrar. Kailangan muna alamin kung anong klaseng mali o error ang
nasa birth certificate upang malamang kung ano ang tamang proseso para sa
pag-correct nito dahil meron tayo dalawang proseso (1) Administrative
Summary Correction sa Local Civil Registrar; at (2) Judicial Correction of Entry
sa Regional Trial Court.
Ganun din, under Republic Act No. 10172, ang error o mali sa gender o
kasarian (Example: Ang "Male" ay naging "Female" sa birth certificate at ang
"Female" ay naging "Male") at ang error sa birthday (covered lang nito ang
Day at Month na error) sa birth certificate ay pwede nang ayusin at i-correct
sa Local Civil Registrar na hindi dadaan ng korte ayon sa Section 5 ng
Republic Act 10172. Sa proseso ng Administrative Summary Correction sa
Local Civil Registrar, ang pagcorrect ay madali dahil ito ay magfile lamang ng
petition, magsubmit lamang ng documents na required at ipa-publish ito ay
pwede nang mag-issue ng correction ang local civil registrar.
Kung ang ang error ay hindi typhographical error o clerical error sa name or
surname, o clear error sa gender/kasarian o birthday or birth month, at ang
error ay substantial katulad ng error sa name o surname, name of father and
mother, year of birth, place of birth, date and place of marriage, nationality of
the child or father or mother at iba pa, ang mga ito ay hindi pwedeng ipa-
correct sa local civil registrar at kailangan na dumaan sa proseso ng
correction of entry sa korte. Sa prosesong ito, kailangan ng
applicant/petitioner na magfile ng petition sa korte, ipa-publish ang petition
sa newspaper at patunayan ng evidence sa korte na mali ang entry at
kailangan itama at saka lamang magdesisyon ang korte na i-correct ang
entry.
Upang makansela ang ikalawang birth certificate, kailangan din na dumaan
ito sa proseso sa korte under Rule 108 ng Rules of Court.
