This case is about the propriety of lifting the Writ of Preliminary Injunction the CA

previously granted against Fortune Tobacco Corporation. The decision does not
discuss if whether there is infringement or not.
FACTS:
Philip is a corporation registered in State in Virginia and does not do business in the
Philippines. Same goes for subsidiary companies. Philip and its subsidiary
companies filed a case of infringement with prayer of preliminary injunction. Trial
court denied due to prematurity since the patent for Fortune, cigarettes with
mark, was not approved yet and that Philip does not engage business in
Philippines.
